Had no time have I been unwilling to address the concerns of the primary contractorWhich in this case happens to be the homeownerI am unaware of any issues the primary has that I have not addressed, the concerns that have been brought to my attention have been addressed, which is what the primary is supposed to do find a concern, inform and have concerns addressedOver the course of building a home many things can and do occur, changes to the plans happen on this job also.Several places on the print work against each other he basement area, and basement two steps, and first floor kitchen area to stepKitchen closet word change, door dimensions would change due to larger trim, which wasn't specified by printBathroom window was moved print didn't have correct number for Plumbing had to be moved, some spaces had to be moved or widen due to larger trim being added to printWrong header in garage had to be removed and replaced.To personal issues came up during the buildOne was my lead man was hospitalized for personal issues and was not able to workIf you need confirmation on this let me know and I can provide documentationSecond was [redacted] ***.My records indicate we lost about a week's time.After Roof was singled I asked homeowner primary contractor when would the windows be available to setHe informed me based on what he has seen so far that I wasn't going to do the windowsI informed him that we have a contractI think he shrugged his shouldersMy concerns about the windows are this areRO Or rough openings were provided by the homeowner primary contractor and we're done to his specificationsAt no time during the process was I informed otherwiseIt was after the windows were installed that I found out the openings were wrong he is aware that a change order would have been added to any Roo that he provided that didn't work for WindowsChange orders are clearly stated in contract.As a business man I'm going to protect myself by all legal means available, in this case, I lean would be appropriateThe contract that is signed by the owner primary contractor as required by law has space mean notifications attached to it

My company will move forward with the legal means at my disposal

We will be following through with legal proceedings.  We are simply following the company's contract language in breaking the contract and paying for all work that was completed by the company.  We are not required to pay for work not completed per contract language.  The company is not abiding by it's own contract that the owner provided for us to sign, so we will follow up with a lawyer.
