In November of 2014 I received a complaint from the property management company representing the [redacted]'s that the laminate flooring we installed in September of 2014 had failed at the rental property of [redacted] located at XXXXX [redacted]...

[redacted] CA XXXXX. I immediately scheduled an appointment with the tenets to inspect the flooring. My initial inspection I observed 2 areas where the laminate flooring had swelled and the photo finish was peeling. One area was in front of the dishwasher and the other next to the recliner in the family room. I called the manufacturer and scheduled an immediate inspection on December 4, 2014 to determine the cause of the flooring failure.(see attached report). It was determined the cause was consumer related issues, water damage. After submitting this report to [redacted] she nastily demanded I replace her floor or she would file a complaint with the CSLB. I in turn demanded that she hire an independent inspector and if his findings demonstrate we are at fault I will replace her floor and if not she will have to address these issues with her tenants. The inspector she hired found the same results as the one I hired. In fact her inspector found animal urine in the laminate as well as water damage from consumer related issues. At this time I requested the balance of $1869.83 she still owed. [redacted] ignored my request for payment and I sent her a letter stating that I would place a lien on her property and initiate small claims action to recover my money. I did exactly that April 27, 2015 and on March 23, 2015 she issued a check to us for the amount she owed of $1869.83. We told the county recorder to release the lien. Several months later, May 12, 2015 [redacted]'s property management company called on at 5pm and left a nasty message on my voice mail stating that if I didn't release the lien by end of day Wednesday I would be sorry. I responded the next day May 13, 2015 and stated that we instructed the county recorder to release the lien and to speak with them please. I don't know if they called the county recorder or not. I retrieved the release of lien papers we had on file and sent them to the property manager. The property manager said we need to notarize the papers so I did and sent the notarized papers to her. We called the County recorder June 1, 2015 and they stated they are at least 1 month backed up with their recordings and all parties need to wait. Recently I have received numerous nasty and threatening emails from [redacted]. She

This response is a total lie. As previously outlined in my original filing as per the dates cited, The INSURANCE COMPANY was processing his SUPPLEMENTAL billing. As previously stated he was paid ALL money due including the fee he demanded to release the lien. There is NO money in dispute EXCEPT our money being held in escrow because this person has failed to this day 6/5/2015 to provide RECORDED copies of a lien release. As previously stated, the only copies he has provided are the useless copies we received on May 20. As for his claim of my wife being rude, demanding and nasty suffice it to say, this is a total lie and describes his own behavior. As to the work he did, those same reports he refers to indicate that there is shared responsibility on his part as to why the floor had to be completely redone. Again that IS NOT in dispute here.
