Review: I was looking to purchase a dump trailer for my business. The sales rep had printed me two different types to compare. Besides the fact that the more expensive one came with a three year warranty compared to the other which only came with a one year, I selected the one with the three year mainly because it also came with a tarp that is required to bring a load into the dump in most states. See more at: [redacted] leaving a deposit for the trailer on a Tuesday, I came back to pick up the trailer on Friday and the trailer they were selling me did not have a tarp on it and would be extra money if I wanted it. I stated that the advertisement they gave me described the tarp but to their defense they stated that the vin# was not the same and it was not the trailer I had seen in the picture that I had signed for. I asked for the trailer that the flyer showed me and they said they did not have that one. If I was to walk away from the deal at that time then I would lose my $500 deposit because I broke the sales contract. I believe this is bad business especially for a small town in which my family has been a part of for over 50 years. I am a contractor who is always honest, up front, and fair with my clients. All of my work is from referrals and word of mouth. After speaking with my consultant, they advised me how much more money it would cost to pursue action in court rather than just purchasing this extra equipment elsewhere. I would like for the average consumer to be aware and verify vin #'s of what they are actually purchasing from this company because of their false advertisement.Desired Settlement: They can offer to supply me with what I thought I was originally purchasing. It will be very difficult to ever recommend this company to anyone. My concrete contractor was on the phone with me when I was in there and asking me to price a 7x14 trailer for him because he was in the need right now and ready to make the investment but he will no longer be going to do it through this company.

Mr. [redacted] arrived at our dealership in December 31, 2013, New Year's Eve. He inspected the dump trailers we had in stock and had a salesperson print him information from our dealership website. He left the dealership and returned a few hours later, informing the salesperson that he wished to finance one of the dump trailers he had inspected. The printed information on the brand of trailer he was purchasing was for a different trailer, with a different VIN number, and not the trailer he was purchasing. The trailer he was purchasing did not include a tarp kit. On January 3, 2014 when Mr. [redacted] returned to pick up his trailer and sign documentation, he informed us that he did not wish to purchase the trailer because it did not include the tarp kit. He was informed at that time that he could cancel the sale. A few minutes later, he informed the salesperson that he had changed his mind and wished to proceed with the purchase. Mr. [redacted] was also informed that he could purchase a tarp kit at dealer cost for $256.00, plus tax. At no time was Mr. [redacted] told that this dealership would not return his downpayment, nor was he informed that he could not cancel the sale. Mr. [redacted] did not make this purchase without inspecting the trailer before the purchase, and he did not wish to cancel the sale. In addition, all of this dealership's printed ads include the following verbage: "While every effort has been made to ensure accuracy, Southwest Trailer Sales assumes no responsibility for typographical or pricing errors. Please speak to a sales representative to verify any questionable information from this document before your purchase."

This dealership has never falsely advertised. VIN numbers are always included in all of our printed ads, together with the accuracy verbage. Mr. [redacted] has possession of this information on his printed ad, and knows that the trailer he purchased was not the trailer shown in the printout. He physically inspected the trailer, which had no tarp kit, before his purchase and he was also offered the opportunity to not proceed with his purchase and receive a full refund of his downpayment. We do not believe that Mr. [redacted] has any grounds for his complaint. We are sorry that Mr. [redacted] feels that there was a false advertisement, but this dealership has been up front and honest from the very beginning. We believe our offer to provide him a tarp kit at dealer cost is a fair resolution to his complaint.

] THIS BUSINESS STATED THAT I HAD LEFT AND CAME BACK A FEW HOURS LATER AND I HAD NEVER LEFT. THEY NEVER OFFERED MY DEPOSIT BACK. I WAS TOLD IF I WERE TO BREAK THE CONTRACT, THEN I WOULD NOT RECEIVE MY DEPOSIT BACK. I HAD ASKED HOW MUCH IT WOULD COST ME TO PURCHASE THE TARP KIT AND THEY TOLD ME IT WOULD BE A LITTLE OVER $250 + SHIPPING. THEY ALSO RAN OUT INTO THE PARKING LOT AFTER I HAD SIGNED THE ORIGINAL CONTRACT TO STOP ME AND BRING ME BACK IN BECAUSE THEY WANTED THEIR $500 DEPOSIT. THEY ALSO STATED THAT VIN #'S ARE ALWAYS INCLUDED ON PRINTED ADS WITH ACCURACY AND VERBAGE. ATTACHED IS THE ORIGINAL FLYER I WAS GIVEN ALONG WITH AN ADD THAT I PRINTED MY SELF AT 9:10 PM ON 1/3/2014. (SAME ADVERTISED VINS AND ONE EXTRA VIN IS OF THE TRAILER I HAD PURCHASED WHICH THEY NO LONGER HAD)

Thank you for your input. Despite the fact that this customer (a) personally inspected the trailer twice before the purchase and saw that it did not include a tarp kit, (b) was allowed to cancel the sale with a return of his down payment, but decided to purchase the trailer anyway, (c) the dealership website flyer showed a different trailer with a different VIN number, and (d) all of the dealership advertisements have a disclaimer, this dealership has decided to provide the customer with a free tarp kit. The tarp kit will be ordered and the customer will be notified when it arrives. At the time customer picks up the free tarp kit, he will be required to execute a document promising to no longer slander this dealership.
