I am rejecting this response because:On Tuesday Aug. 18, I replied and offered Mr. S[redacted] the first available opening on [redacted]'s calendar, which was today, Thursday Aug. 20, between 1 and 3 PM. Forty-eight hours notice is the best I was able to offer; I had warned Mr. S[redacted] before that if he were going to insist on meeting with [redacted], he would have to be more flexible in his meeting times. I also noted that any future meeting that involves [redacted] will need to be quite early in the morning, likely between 6:30 and 7 AM on a Tuesday or Wednesday morning, since these times are before [redacted] is usually scheduled for conference calls with clients or coworkers, and are unlikely to be preempted.The next time [redacted] is in town and is available to meet is 6:30 AM Tuesday Sep. 1. This availability is subject to preemption however if [redacted] has to go on travel or is otherwise called away by the needs of his employer or customers.I am, of course, available to meet with Mr. S[redacted] at almost any time, if I am given notice by the end of the previous day (5PM). Please note that we have been asking Mr. S[redacted] to come out and inspect the problem areas since he notified us of his return from his vacation on July 13.

I am replying to this response:I originally suggested August 20th as the day for us all to meet. Once I requested that [redacted] be present [redacted] said they would be entertaining out of the country company and the 20th wouldn't work. Then I get a response on August 19th asking for an August 20th meeting, but I had already made other business plans. I understand [redacted]'s needs when it comes to his employer or customers, but I would like the same consideration for my business needs and customers. I have no problem meeting with [redacted], but I am not comfortable discussing the stucco issues without the owner of the home present. Again, [redacted] had plenty of time to visit with myself and the crew during the progress of the job during business hours. Surely he can clear a small portion of time to meet with me in the near future. I have said that Saturdays are fine as well. Dan

I am rejecting this response because:Mr. S[redacted] is incorrect on several points, but the only relevant two regard the front wall and breeze way wall and his availability to meet and view the damage.We did not wet either of the walls that are showing problems. [redacted] did wet down a side wall of the house, because the crew foreman, Manuel, told him that it would be a good thing to do and helpful.  The front wall that is badly cracking was not even finished at that time, but was spray finished a couple of days /after/ the side walls were wetted down per Manuel's suggestion. So not only is Mr.S[redacted] incorrect in saying that the cracks are our fault, he is incorrect when he says we were told that all of the water curing is his responsibility.I gave up communicating directly with Mr. S[redacted] when, after numerous emails, it became apparent that he had no intention of even looking at the damaged wall, much less correcting the problem. I told him I would meet him any time he could assure me he would show up, but after more than two weeks of wrangling, once he finally agreed to come look at the house, he added a new requirement: that he would only come out when both of us were available to meet with him. This is not feasible because we have out-of-country house guests for the one day Mr. S[redacted] said he was available, and I expect [redacted] to spend his time out with his family, not sitting at home waiting for a contractor. It is also highly difficult for both of us to meet with anyone, because [redacted] travels for work almost weekly and often on very short notice. Mr. S[redacted] knows this, and his demand for our mutual presence, practically speaking, prevents us from meeting at all. I also find it an unreasonable request because he was happy to deal with just me when we went over the house for the estimate, when his crew started work, and when I talked with him about the damage to the AC units and other areas of the property. I have cc'd [redacted] on every email to Mr. S[redacted], but Mr. S[redacted] chose not to send [redacted] any of his replies, so it does not seem that Mr. S[redacted] has added this condition because he is concerned about miscommunication. My last communication from Mr. S[redacted] said that I should call him after August 15. (This 6 weeks after his crew's last day here, and still no reason to believe that he will be willing to come look t the work, much less correct the cracking. In the meantime, we still have additional work to be done on the house and need to have all stucco work finished first.)I would like to respond to one other point, even though it is not really relevant to the issue of the cracking front wall. As to his complaint that we should have covered the drain hose on the AC unit to prevent damage, Mr. S[redacted]'s estimate states: "*Trenching, masking, clean up and hauling of all trash included." I never saw these units covered (which would have caused damage if they had been covered while running) and I can provide pictures of stucco spilled on the fan blades of the units, which would seem to indicate that they were not, in fact, covered. This is in any case a separate issue from the cracking, and I thought it was settled when Mr. S[redacted] accepted the invoice from 5K Plumbing for the repairs we'd paid for, and sent us an adjusted invoice for the final amount due to himself. However, when we asked him again to come and look at the cracking front wall, he brought this up as a reason why he wouldn't come to the house, and  accused us of lying about the damage: "Well, on my behalf I feel we were taken on the repair of the so-called heat pump. If that hose that was dangling from the pump was so critical, you folks should have secured it or at least told us of its importance. We masked and covered the units entirely. You also said you cut off the damaged end of the hose to show me but never did. So I feel we paid for a pump that was faulty or already broken." For clarity, I have pasted the estimate in its entirety below. This is all the 'information we received from Mr. S[redacted]. We received no instruction from Mr. S[redacted] that we should mask anything, or do anything else. I have provided him with a picture of the stuccoed-up hose, which is white, not clear as he states in his reply to my complaint.The amount of the repair was $176.92. This is less than 2% of the pre-tax amount of $9250 that we paid Mr. S[redacted] for the work. This doesn't really sound like he was "taken" to me.Also, while we were trying to persuade Mr. S[redacted] to just come LOOK at the cracking, he told us that if we weren't happy "you can hire a couple of my guys to spray them. It will be cheaper that way " That sounds very much to me like a refusal to honor his warranty.These statements, accusing us of lying, and saying after the fact that we should or should not have done certain things,  indicate to me that Mr. S[redacted] is not dealing in good faith with us. Which is why we are now trying to resolve this with the help of the Revdex.com.

I am rejecting this response because:Because [redacted]'s work demands make it impractical for him to deal with contractors during business hours, [redacted] has been acting as [redacted]'s agent throughout this process, including soliciting bids, choosing the contractor, discussing concerns over damage, and negotiating adjustments to the final bill to cover damage done by the crew. Either of us could have written the checks to Mr. S[redacted]; who actually signed the check is incidental. Mr. S[redacted] never previously demanded the homeowner's presence at any step of the process. I am assuming that Mr. S[redacted]'s reply means he is declining to meet on Aug. 15 as he previously had said he would.Mr. S[redacted] may wish to know that every surface of the house that was lathed is now showing cracking, including the courtyard and upper story, and that the stucco is crumbling away from the windows on the lower floor.

I am rejecting this response because:Attached is a copy of a limited power of attorney, authorizing [redacted] to act on behalf of [redacted] in relation to the maintenance, repair, and improvement of premises at [redacted]Because of the nature of his work, [redacted]'s availability is sporadic and unpredictable; at the moment, his calendar is clear between 1 and 3 PM on Thursday August 20. However, this time may be pre-empted by the demands of his work. After Aug. 20 he will be on travel for a week; when he is back in town, his best option for availability is between 6:30 and 7 AM, on Tuesdays and Wednesdays, before his conference calls with customers usually begin.Given the restrictions and unpredictability of [redacted]'s schedule, I strongly urge Mr. S[redacted] to either meet with us on August 20, or to acknowledge the POA and meet with me, [redacted], at his earliest convenience.

I am rejecting this response because:My last communication with Mr S[redacted] was July 26, and read as follows:Call me after the 15th and let me know what day and time works for you both.As I noted before, we are not able to meet his condition that both of us be present. He has not heard from me directly because he told us not to contact him until after the 15th.

I am rejecting this response because:I have stated repeatedly that we can at no time guarantee the presence of both [redacted] and myself. If Mr S[redacted] would agree to drop this condition, I am available to meet at our previously agreed on time of 11 AM on Saturday Aug. 15. I will be happy to make a video recording of the meeting and the inspection of the problem areas.

I reject this response as a one day notice for a meeting is not appropriate nor fair. I already have commitments for tomorrow that I will not cancel on other customers at such a short notice. Please give me at least a few days notice for a meeting and I will be glad to attend. Dan S[redacted]

Our company began the stucco renovations for [redacted] and [redacted] on June 24th and completed the work on July 2nd. All the work spelled out in the estimate and work proposal was followed and finished. The house had multiple surfaces to prepare for the final color coat including;...

painted stucco walls, remodeled areas of existing cement and wood areas that were papered, wire lathed and cemented prior to the color coat. As the job progressed, it became apparent that the final color would be somewhat inconsistent because of the different surfaces receiving the color coat. So we took it upon ourselves to cover some entire walls with cement to help even out the color. We also sprayed a few walls after they dried to also even out the color. We did this at our own expense so the customer would have a better finished product. We never asked for any compensation, but when I mentioned to [redacted] the extra steps we took to make the walls more presentable her response was as follows. “We have given you credit for the work that was done properly; the back of the house looks great. If that work cost more than you planned for, that is your responsibility, you did the estimate.” We also sprayed a few more areas as well. The existing problem is a wall in the front of the house and the atrium that has cracking. On the last day of work, after having just applied the color coat the previous day, when the workers showed up in the morning, the owner, [redacted], was soaking the front wall with the hose. All of the water curing of the stucco was our responsibility as stated in the estimate. Soaking the color coat less than 24 hours after application is not good. They then went in the atrium and saw those walls were also, very, very wet. The cracking the customers are complaining about is partially, if not mostly, because of the soaking of the walls too soon after application. Nevertheless, I said I would come out to look at the cracking but could not do so until August 15th or later because of a serious family matter I explained to [redacted]. So when [redacted] insisted on a date for inspection I said August 15th, my first available day. She then asked for a time and I replied 11am. I also asked that both she and [redacted] be there since [redacted] owns the house and personally gave me the down payment. I thought [redacted] would be satisfied with a date and time established. Her response was: “I am willing to accommodate any time you can assure me you will show up, but we have out-of-country house guests and I cannot guarantee that we will both be able to attend you. If you are going to impose additional conditions, you need to be more flexible about the meeting time.” As for the a/c, heat pump units. When we were ready to color coat the west wall that has two units on the ground up near the house wall, we covered and masked both units completely and uncovered them as soon as the wall was completed a couple hours later. Unbeknownst to us, there was a clear hose dangling from one of the units which, according to [redacted], got plugged at the open end with some stucco that hindered the performance of the unit causing damage that we paid for. My concern is that if this hose was so critical to the performance of said unit, why were we not informed so we could have taken precautions, or why did the homeowners not protect that hose prior to the work on that wall. Nonetheless, we paid for said damage. Again, we have completed and performed all the work according to the estimate/proposal. The cracked walls in questions are at least partially because they were water soaked improperly and untimely. I also have given a day and time in which I will look at the problem as the customer requested. The only response I have received about that meeting is this letter I am responding to. [redacted] is the one who said he owned the house at [redacted] and he is also the party that paid us for the work that was completed. [redacted] needs to be present at any meeting discussing the concerns on this job. Thank You   Dan
