I am rejecting this response because:  make no assumptions Mr. [redacted] you can assume all you want but you're not gonna keep my boat. I have been trying to get my boat just like I have been trying to contact you for the past 12 months   Now if in fact you were unable to work on our boat for the past seven months I would think as a man and professional business owner as you claim to be you would've given my wife or I a courtesy call explaining the situation.  As for the price you quoted me of $3500 , And keeping in mind we paid you $1700 cash upfront in which we have a receipt for. That would leave a balance of $1800 You and I have now been bickering for the past week. So I ask you now, were you able to start on my boat this past week,  or  as so many times in the past has something came up once again  that has  unable due to work on our boat?  Bottom line how long will it take you to finish our boat?  Give  my wife or I a date in which the job will be completed. And on that date we will arrive with the balance of your money $1800.  My #  once again [redacted] or Shannon's # [redacted] or Email : [redacted]

I am rejecting this response because:here is an example of my constant correspondence in trying to contact and communicate with [redacted]n, this is the last text message of many that have been sent over the last eleven months; Hello [redacted], this is [redacted]. The last time we spoke was the very beginning of September. I will cut to the chase. I am a very understanding person. And I feel that I have been more and passionate / understanding as to why we keep having this conversation. I brought you my boat back in November 2014 with the understanding that you would have my boat for approximately two months. Being the person that I am my fiancé and I paid you $1750 for a estimated job of 3500 upfront. By no means am I telling you how to run your business. We came to you as a customer seeking your service. But as a businessman with customer relations, me / us being the customer. I am left to wonder? What in the hell is going on. This is no longer acceptable. And I am letting you know now. Via text message. Since you do not respond to my calls. Or feel that you owe me the common courtesy as a customer. You have left me and my fiancé with a very aggravating and uneasy feeling with a project that was supposed to be fun. I am left with no choice but, to pursue this matter in a legal manner. Again I ask you? [redacted]n with Southwind boats. [redacted]. Why do you continue to treat us in the manner that you have.

Review: I took my boat to [redacted] for some bodywork, paint, and tanks July 2013. The work was originally suppose to take less than 3 months yet it took 2 months for him to even start work on it. Once the bodywork was done in Nov2013 he sent it out to be painted; the paint job got messed up in Jan2014 and had to be redone. He asked for a cash advance for more paint; it was repainted and returned to [redacted]s shop in Mar2014, where I saw that the quality was extremely poor so we both agreed it had to be redone a 3rd time. He sent it to another shop where they fixed it but [redacted] left it sitting there for a month. While it was there a rack fell on it so it had to be fixed for a 4th time. In July2014 [redacted] told me to go get it but my work schedule didn't allow me to for 3 weeks and by that time in Aug2014 [redacted] had brought it back to his shop. He said he would install the tanks and call me. But then in Sept2014 he called asking if I wanted the tanks installed. I said yes, I waited for him to tell me it was ready. Finally in dec2014 he called saying it was ready and I needed to pay my [redacted] in full. I went to see it only to find there were no tanks or mounts but he wanted me to pay for them. I tried to talk to him about it but he wouldn't budge on the payment. I thought about what to do about the situation for about a month when he called again on Jan 29 2015 wanting me to pay him. I went to his shop Jan 31 2015 with my invoice and tried to work it out. He cussed and screamed at me, my brother, and father who came to help me load my boat. We finally came to terms and I got my boat back home only to see that my new trailer had paint drips and scratches all over. And the paint on the boat wasn't much better than the 1st time. I paid the settled price but if anything I feel I should get money back because it still isn't right and isn't the quality I paid for. Also now my trailer is messed up. total: $3700 settled: $2800Desired Settlement: I want this to go away I don't want any money back and I won't pay anymore out. [redacted] was suppose to be a top of the line best around boat builder so I was willing to pay for the quality but what I got in return was not quality but pure lazy work that got brushed aside and drug out for a year and a half I am highly dissatisfied with the outcome and him screaming and cussing at me and my family was very unprofessional. This whole experience has been a nightmare.

Business

Response:

Business states that the consumer brought in the boat, the scope of work changed. It turned out that it needed more work than first thought. The boat was sent out to get painted. The first job that was done was not done to business standards so it was sent out to a different shop to fix the paint issues. The consumer was instructed that he would be able to pick it up at the shop but consumer did not have the funds. Boat was done and stored at the business for months. Consumer then came and decided that he was not going to pay amount owed due to business having it for so long. Consumer was told that he was the one who failed to pick it up because he did not have the funds. In the end he admitted to owing the money and made a payment arrangement. The amount owed was brought down from $3,700 to $2,800. Once payments of $2,100 were paid consumer showed up wanting to pick up his boat but not willing to pay the full remaining amount of $700. Business decided to release the boat to him and accept a $500 payment with the promise that he would return to pay the remaining $200 dollars. To this day the remaining balance is still owed.

Review: On November 22nd 2014 I dropped off our 1974 [redacted] Shovelnose Hydro boat and a custom built trailer to [redacted] to have the floor and stringers were to be replaced. He quoted me / us $ 3500 for the job and approximately 4 to 6 weeks to do the job. My wife one week later dropped off $1,750 cash in good faith and upon request to get the job started. We were told by Mr. [redacted] we would revive pics via email as the job started / progreesd from start to finish. over the past 11 pluss months we have Ben given nothing but excuses as to why the job has not Ben compleeted. In our passing from Nevada to Ca. We have stopped by Southwind boats never to seem able to make contact. Upon numerous phone calls and left messages by phone and text. With little to no response. The last time I was actually able to speak to Mr. [redacted] was the 3rd week of Augest by phone again was given another excuse as to why the boat was not done and told and again promised the boat would be completed and teady for pick up by September 3rd 2015 my birthday. Once again we have not / never received a single phone call. I Along with my wife have left numerous messages by phone and text once again with no response. My last attempt to contact Mr. [redacted] was again unsuccessful and with that left a message via text message explaining how unhappy and concerned we are due to the nature and expenses that have ben spent on this project. Again left to wonder as the werabouts and condition of our boat and trailer and explained we were left with no other choice but to seek legal action against Mr. [redacted] / Southwind boats by phone message and text message on Oct. 25th 2015 at 5:10pm and still to this date have heard nothing from him concerning this matter. Unprofessional is no longer the case in this matter. This has caused and continues to cause a great deal of hardship and arguement between my wife and I. Unacceptable is only the begaining on how we feel about this matter.Desired Settlement: Keeping in mind this has gone 10 months since past the promised delivery date. And with no perfessional contact from Southwind boats / [redacted].We want what we were told and promised by Mr. [redacted]. A perfesional, correct and safe floor and stringer replacement on our boat. And or the return of our property in the condition of no less than what it was when he took possession of it.
