I am rejecting this response because:
I have called both Larry *** (cell phone) probably times after I finally got his new number by calling his ReMaxx Agency which he is a realtor I also have spoke to his girlfriend twice who is also a ReMaxx agent (and works for Southwind
Builders)before she stopped answering my phone calls I got hold of her one more time only after calling her from my husbands phone I also called the office number several times and left voicemails I said all I need to know is who installed our doorsI did finally get a text message from the electrician (who is Larrys son in law) with a company name and stated that they are no longer in business Larry himself has NEVER called me back My number and my husbands number has NOT changed and has never been disconnected If he had ever called and it went straight to voicemail....how come Larry did NOT leave a voicemail??? I do believe maybe he doesn't have any open work for us because he has had a series of employees that don't seem to stay employed by him for more than a few months I can pull the emails that I have sent, text messages I have sent and if need I will call and get my phone records For him to say he hasn't heard from me is a complete lie!! Wouldn't expect anything less though. As far as him doing work here Kyle (who doesn't work for him anymore) tried to adjust a pantry door by putting cardboard behind the hinge He did spackle some nail pops and like I stated before he left a sanding block and said this work is not covered by my warrantyI pulled out our contract and asked where it says it isn't covered He said we were under Southwind Builders old contract before they added that nail pops weren't covered So, they WERE covered After several more conversations, Larrys painter finally came only after I contacted the building inspector who sent Larry *** a letter saying that it was coveredThe painter (Alex) came and did a great job He told me that we were under the old contract and that Larry since had added that he won't cover that work Alex said he came because it was the right thing to do and that he didn't know if Larry would even be paying him for his work.I attached a screenshot of the only text I received from the electriciannot Larry! Why would he have the electrician text me if he claims I haven't been contacting him?? Why did the electrician text me about who installed the doors? Clearly Larry knows I have been calling him

Initial Consumer Rebuttal /* (3000, 11, 2015/11/10) */
The two windows in questions where brought to Southwinds attention on the original walk through before I moved into the house
The builder had there trimer come out to the house to fix the doors that where not closing correctlyThe door going into the Den is warped so bad that it drags on the carpet and also leaves a cap of about 1/on the topI mentioned it to the trimmer and he advised me I need to contact the builderThe builder was aware of this on the one year walk throughThis door needs to be replacedI have emailed the builder about this last week and am hoping this will be resolved tomorrow when they are out looking at the windows with the supplier

As an update in regards to the *** *** residence a meeting was set up for Tuesday November 10th, 2015, at the homeIn attendance was Kyle *** Project Manager, Southwind Builders Inc, Pat Zahler representing ABC Lumber and Anderson Window Corporation, and myselfThe homeowner was not present but did provide access to the home through the garageIn examining the rear living room window which is a three wide unit we found that the window was installed correctly, it is perfectly square and plumbThis is a "single hung" unit made from composite material and the trade name is Anderson seriesAll three of the units operated without using any extraordinary meansFacing the unit the left hand sash required a bit more effort to openThe sash was removed, in examination of the sash it was found to have granular dirt in the guide system, the sash was cleaned and adjusted back to the manufacturers specifications and reinstalledIt operates as it was intended to, and again is within the window specifications for tolerancesWe then moved up to the laundry room windowAgain the frame is square and plumbThe sash works freely and is again within the window manufacturers tolerancesHowever it was determined because of the size of the window sash (36" wide by 18" high) that if the window is pulled into the close position by pulling the center of the sash rather than the top edges the window may not track straightA window shim was applied as a fix, but it was decided that Anderson Corporation would replace the sash and ship it directly to the *** residencePlease advise us if any other action is needed on our part, otherwise we will consider this matter closedRegards,

Mr***, Please see the attached email and picture concerning the *** *** ResidenceHis home closed November 13, Throughout this past year we have tried to take his concerns and resolve them allWe have gone above and beyond "normal" warranty work and have spent hours both administratively and at the residence answering his questionsHe consistently emails and texts staff here so I have informed him that he must only communicate with us through mailI believe we have answered the window question satisfactorily and will continue to assist as needed, and honor any warrantable issues

[redacted] Hard Copy Attached [redacted] I have reviewed the correspondence we have received through the Revdex.com to date. In addition I have looked through our records here at the office regarding your home. We have absolutely no idea what you are claiming as a warranty issue. Obviously you did have warranty issues that were raised. These items were addressed and completed in a timely manner. in addition you received work items that were outside the scope of what you should have. Your home includes what is covered by and per the Minnesota State warranty chapter 327A. Housing; Statutory warranties. No other warranties apply. If you wish to read the warranty, it is available to you online or by contacting the Office of Revisors of Statutes. I urge you to review 327A in its entirety so you can become educated on what your home warranty included as it appears that you are not currently. In the event you then feel you have an issue that Is specifically referenced and covered under the 327A guidelines you may at your option send us a letter or a fax describing what you feel this is. Feel free to include a copy to the Revdex.com as well. Southwind Builders will respond to your written letter within 15 days of the receipt. If we determine that there is indeed an issue and it needs our attention we will address it promptly. Note: We will not accept text, email or phone messages from you as any and all communication addressed to us must be in writing and sent via fax or delivered mail, in order for them to be addressed. Finally and in conclusion, we will NOT engage In insults and derogatory comments, as you seem to continue on doing. You are entitled to your opinion and we are entitled to ours. However, I want to inform you here that if you persist in the type of dialog as you have been doing in any type of public forum, this will not be tolerated. So, upon the advice of our attorney, you are hereby advised that we will seek out and use any and all remedies available to us in a court of law, against you both personally, for any insulting, defamatory, slanderous or disparaging comments you set forth against Southwind Builders Inc. or Larry [redacted] now or in the future. I want to stress to you, if you do not understand what is being written here, I advise you to consult competent legal representation regarding this. (The consumer indicated he/she DID NOT accept the response from the business.)
Because the contractor is lying and was only at my house once besides the 1 year...

walk through for the HVAC equipment. The other issues that where brought up on this complaint where included in the latter that he received in December. I had contacted the HVAC supplier and he will not due anything. This falls on the builder. I would like this resolved.

Mr. [redacted], Please find this letter as an update from our conversation this past Monday. Mr. [redacted] has not contacted Minnesota Mechanical regarding the noise in his furnace at all. However, Minnesota Mechanical has contacted the representative from Tempstar (the furnace manufacturer) and they will be setting up a site visit with Mr. [redacted] in about 2 weeks but definitely before the end of the month. They will assess the issue and provide a written report.
