We can certainly understand Mr***'s frustrationAs Mr *** stated, a downspout drain-line which travels underneath the intended sidewalk slab to be lifted was filled with grout like materialThis material is injected with a high pressure grout pump beneath the slab through small holes which
are drilled through the surface of the slab. There is a good possibility that the downspout drain line was struck while drilling through the slabWhile this is an unfortunate occurrence, it does on occasion happenInterwest has been successfully lifting concrete for yearsIn that time we have amassed truckloads of knowledge and professionalismOur customers have typically never experienced the concrete raising processTherefore, we try, through the terms and conditions of our contract, to bring these types of potential problems to the attention of our customersMr ***, admits he did not read the terms and conditions of the contract. We are more than happy to return and lift the concreteNow we know where the downspout, I feel that the slab will lift right up because we will be able to achieve proper line pressure and not lose pressure through the downspoutOur crew did make an effort to clear the blockage and as I understand Mr***’s wife was there and did observe the problem and our effort to clear the lineMr *** was offered a $discount but refuses to pay our $mobilization feeThe fact that the job didn't go perfectly (because of conditions he clearly signed he understood) does not mean we didn't pay a crew to mobilize to his home and spend time trying to lift Mr ***s ConcreteAlso, Mr *** did not mention in his statement that there were other areas of work performed that were lifted just finePlease see attached files of Mr***’s initial and signature of the work to be performed and agreeance to the terms and conditionsYou can also see a sketch of the agreed upon scope of workI have labeled where the downspout’s path is beneath the slab and the area we were unable to lift because of the drain line which caused us to lose pressure I have also, in a separate color, outlined the other areas we were able to lift or stabilizeAs you can see, what was un lifted only represents about 25% of the scope of work and Mr *** was offered a 33% discount

I am rejecting this response because the firm was negligent, and as a result of their negligence, did not complete the work that they contracted to do. The problem was very avoidable. The existence and location of the drain pipe is evident to a casual observer, so it could have been easily located by a professional contractor who does this sort of work routinely. I mentioned that the firm failed to have the area marked as evidence of neglect rather than as a claim that marking the property would have avoided the problem. I submit that the lack of marking is an indication of their level of professionalism.The firm wishes to collect $400 for a partial repair. They fail to acknowledge that the partially repaired concrete now needs to be removed to repair the damage they did, so I receive no benefit or value from the partial repair that they did. I evidently need to hire someone else to tear out the work they did, repair the drainage pipe, and replace the concrete. I don't believe that it is fair to ask me to pay anything, and if the firm wished to be fair, would make some attempt to compensate me for the expenses I will now incur due to their negligence.
