Good Afterno10/20/we conducted settlement for the property located at [redacted] , in which [redacted] was our sellerThe certification for taxes paid and outstanding showed a balance owed of $3,602.33, I am attaching it to this email for your reference, this is a lien able itemAt closing she was unsure if she has paid her taxes or notI showed her the tax certification showing that the taxes were still openWe then called the tax collector and left a message with herBecause we are providing title insurance to the buyer, part of our responsibility is to make sure that all outstanding debts are paid and satisfiedWe collected the amount indicated on the tax certification at closingI have attached the final ALTA and the sellers CD, signed by [redacted] After closing we remitted the outstanding payment to the tax authorityShe accepted payment and posted our check from closing on 10/27, I am attaching a copy here for your reference.I have been in constant contact with her Real Estate agent [redacted] , since closing, and sent her copies of the items in this email for her and her clients referenceI let her know that if her client feels that a duplicate tax payment was made she need to contact the tax collector directly so she can find out why her original payment was not posted correctly to her account and to request a refund from her.I am truly sorry that [redacted] feels that we have wronged her in any wayPlease let me know if you require any further information

Good Afternoon-The facts are as stated in my previous email along with the paperwork from closing as collateralAs a settlement agent I am responsible for making sure that the buyer has marketable titleIf I were to have not collected for taxes when I have a tax certification showing open taxes on a certification, I would have been negligent, and the buyer would have lien put on their propertyThe seller at closing was unsure if the taxes were paid and she or her agent had no evidence at the closing table that they were paid, and the monies were received by the tax collector. We did leave a message for the Tax collector who was not in the office at the time of closingThe seller knows very well what happened at closingThat is why she signed the final settlement statement reflecting the collection of said taxes.I would love to make this better for our seller, but the fact is, that I have no money to refund to herThe tax collector accepted the outstanding tax payment that we sent in for closingThe reimbursement should come from the Hatboro Horsham School District tax collector if there was a duplicate payment.Thank You

I am rejecting this response because:Correct, I most certainly DO know what happened at the settlement table - that Carmen made me sign a piece of paper saying the taxes were not paid and SSA most certainly knows that Carmen was indeed negligent in her duties because I was never asked to confirm that the taxes were not paid! Had I been asked by SSA to confirm that the taxes were not paid, at that time I would have given submitted: 1 - a copy of my personal check AND 2 - a bank statement showing the money came out of my checking account!Not only is Carmen negligent by not confirming with me - BEFORE settlement - that I did not pay the taxes, she is also negligent because she did not in a timely manner after proof was submitted to SSA of my having paid the taxes in full attempt to get my money back from the township within a week of settlement. Instead here I sit, MONTHS later waiting on my money!Regards,
