Revdex.com:
I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this proposed action would not resolve my complaint.  For your reference, details of the offer I reviewed appear below.
PLEASE READ ALL COMMUNICATION BELOW - AS ABC ACRYLIC SPAS OF ARIZONA (Located in Gilbert Arizona in the [redacted] area) DOES NOT FIX OR REPAIR THE BROKEN "LEMON" OF A HOTTUB THEY SOLD ME.
10-14-2014 - It is now over 2 weeks since filing the complaint with the Revdex.com of Arizona. If you read in the email dated below from the previous week you will read how a lady claiming to be with the ""NEW"" REPAIR COMPANY ABC Acrylic spas of Arizona is using, called me, had no idea of anything going on in regards to what all was not working, damaged, and leaking with mold and green mold forming under the hottub in 2 locations from the water leaking. I had to explain all of this to her again. As she was pretty rude on the phone, said she would call me back after she found out if ABC acrylic spas was going to pay them for the service call or not........YET NEVER CALLED ME BACK.
So then after 2 days had went by, I called this repair company phone number they left back, now a guy answers the phone, he has no idea who I am, why I'm calling and what repairs need to get made. I then re-explain the situation to him and I set an appointment. He comes out with a younger guy on October 6th 2014 and after being out at my house for around an hour here's what they write on the invoice of all the repairs that they said were leaking, broken and needed repair, all which they stated was not from old age, it was from me receiving a BAD "LEMON" OF A HOTTUB.  They stated , "ABC acrylic spas of Arizona has sold you a hottub, that obviously was damaged with multiple areas and problems associated with it, these damages are manufacture not assembling the hottub correctly, damage that occurred during delivery from the shipment from California to Arizona and to delivery and that ABC acrylic spas of Arizona should be fixing all of this.
READ BELOW:  This is the email and attached and saved photos from the repair company, which I have a copy of all of this and the original invoice they left me stating so;
The repair company just left my house from accessing the hottub. I have attached the work order of all the items that are leaking, not working, and what they fixed while being here, as well as the items they need to order to fix the hottub completely.

Here are the list of the items needing repaired that are broken as can be seen on the invoice and photos provided (these are only a few of the photos we have the rest of them):
1- Power supply broken, needed to be replaced with new power supply
2- Needs new pressure switch -its leaking (PART 1 OF THE WATER POOLING UNDER THE HOTTUB CAUSING THE MOLD)
3- 2 speakers don't work, need to be replaced (this is after the last  repair company ABC Acrylic spas sent me, and which I paid money to, told me the stereo didn't work that I should pay them or go to [redacted] and buy a new Stereo - and they would then charge me again to put the stereo in) -yet come to find out, the power supply wasn't working and the speakers don't work - but yet ABC acrylic spas of arizona's first repair company charged me a service call charge, then told me a new stereo was needed, and then they would charge me again
4- pump #1 needs to be checked for leaks as there is water  and green slime, and mold directly under the area where pump #1 is (PART 2 OF THE WATER LEAKING AND MOLD AND GREEN SLIME UNDER AND AROUND THE HOTTUB).
5- Pump #2 is definitely leaking and needs to he replaced (PART 3 OF THE MAJOR WATER LEAKING, AND MOLD AND GREEN SLIME), they need to move the spa away from wall to access the panel that needs to come off, but when he crawled under the inside from the adjacent side he could tell it was leaking really bad and needs to be replaced. Its very obvious - as I was outside the entire time they were here, I could see all the problems and I took my own photos of all the leaks, water, and mold, and wiring as the repair people showed me it all.
6- Pictures were taken both by the repair guys (2 of them were here) and myself, there was a wire that was left unhooked going into the main circuit board-photos of this and the circuit board were taken by myself and the repair guys before they touched anything as they didn't want to be liable for it.
7- Also photos were taken both by myself and the repair guys of the leak that is coming down from one of the lights (water is leaking around the LED lights on the top of the inside of tub, the water is leaking underneath the LED light, down to the inside of the tub, around the yellow sprayed in foam, which is shown and evident by the water dripping on the yellow foam- needs to be sealed. (THIS WAS ANOTHER PREVIOUS PROBLEM I HAD WHEN FIRST BUYING THE HOTTUB, JUST LIKE THE SPEAKERS, JUST LIKE THE JETS COMING OFF AND FLOATING IN THE WATER, JUST LIKE THE OZONE UNIT QUIT WORKING AND HAD TO BE REPLACED, ETC...ALL OF THIS HAS BEEN AND ONGOING SET UP PROBLEMS WITH THE HOTTUB SINCE I BOUGHT IT....I'VE CALLED [redacted] AND ABC ACCRYLIC SPAS OF ARIZONA SO MANY TIMES REGARDING ALL OF THIS- SO FOR THEM TO TELL ME THAT THE WARRANTY DOESN'T COVER THIS BECAUSE ITS PASS THE WARRANTY DATE.....ALL OF THESE PROBLEMS HAVE BEEN ONGOING SINCE PURCHASING THE HOTTUB FROM DAY ONE.
ABC ACRYLIC SPAS SOLD ME A """""LEMON""""" AND NOW THEY DON'T WANT TO FIX THE NUMEROUS PROBLEMS.

So the fact that abc Acrylic spas of Arizona in Gilbert arizona says they have done what they promised, by selling and dropping off a hottub, is ridiculous!!! And obsurd. YOU SOLD ME A LEMON OF A HOTTUB THAT HAS MULTIPLE PROBLEMS AND NOW THEY WON'T FIX IT, REPAIR IT, REPLACE IT OR EVEN RETURN A PHONE CALL. TERRIBLE, TERRIBLE SERVICE!!!
Attached are some of the photos taken of what's described in this email. The repair men left saying they need to speak with [redacted] and abc acrylic spas to "see if they are going to approve" the work so they can get it repaired and/or replaced. TODAY IS NOW 10-15-2014 AND I HAVEN'T HEARD FROM ANYONE, AND NO ONE HAS CALLED TO REPAIR ALL THE DAMAGED AND MOLD AND WATER PROBLEMS.

Regarding the complaint I filed recently against Acrylic spas of Arizona in gilbert Arizona. They have not contacted me. They did have a lady contact me stating she worked for a repair company associated with them, she was extremely rude. She had no details of the situation. I explained to her the ongoing problems, and she stated to me that unless the hottub is under warranty that I would have to pay them. I told her again about the ongoing problems, the complaint I filed with the Revdex.com of Arizona and she rudely said well someone has to pay us. She said she would talk with Acrylic spas of Arizona - [redacted] and the owner and call me back to see if they were going to pay them. She never called me back. I then called the repair company number back 2 days later after not hearing from them, now a guy answers, he has no idea of what's going on. Terrible service!!!
Terrible customer service.

I am sorry to get back to you so late.We have Mr. [redacted] scheduled for Delivery at 11am on Friday, May 22nd.

I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this proposed action would not resolve my complaint.  For your reference, details of the offer I reviewed appear below.

Regards,

We have never refused service for repairs on our spa. I will

contact AZ Spa Repair, but maintain that they did not come to service our Spa

when they said they would. AZ Spa said Acrylic Spas of Arizona keep trying to

point the finger to the other one company.

The end result is that I have not gotten any service.  I also want

repairs on damages that was done to our Spa because of the neglect of timely

repairs.

Re:

ID #[redacted]

Dear

Sir/Madam:

When the Spa was delivered to the customer, we had Mrs. [redacted] sign a "Spa Delivery-Customer Acceptance From", attached, that asks for spa condition, and has a space where they can note down any comments,

example, problems, suggestions, etc. And have them sign it Mrs. [redacted] did not notate  anything, just sign that everything was all ok.

This is actually not an Acrylic Spas of Arizona

problem;this is an AZ Spa Repair

concern. Acrylic Spas of

Arizona does not do repairs, the customers are advised to call AZ Spa Repair, and on the last invoice;attached; you will see that she refused their service. As far as Max Holtrop is concerned,he  is not

a licensed technician and has never been advised through Acrylic Spas of Arizona

to repair any Spas. He does have his own spa cleaning business,

Dutchman Spa Service,

and may have been cleaning

her spa and may have taken it upon himself to take care of what Mrs. [redacted] had stated, but again, that was not under Acrylic

Spas

of Arizona's advisement.

Ultimately, Acrylic Spas of

Arizona has completed all that we have stated we would do, therefore, please close this complaint as satisfied.

If you have any questions, please  feel

free to contact us. Sincerely,

Accounting Dept.

Acrylic Spas of Arizona has been notified that AZ Spa Tech has gone out there one 10/6/14 and advised that a power supply is needed for the stereo to work - which they installed on 10/6/14; also needed was 2 speakers, which Acrylic Spas of Arizona has agreed to cover (pay for). As far as the pump damage, according to the Technician, it is not caused by a warranty issue, but chemical damage, therefore, we cannot cover that, same decision that the manufacturer would make. I am sorry to get back to you so late.We have Mr. [redacted] scheduled for Delivery at 11am on Friday, May 22nd.

Acrylic Spas of Arizona has done our part in what our business has called for and that is selling and delivering the requested spa to Mrs. [redacted]. We will state, however, that the customers purchase price was $8,710 not $12,000 and it was delivered on Feb. 13th , 2013. Our...

The charge that she is questioning is not an Acrylic Spas of Arizona charge, that charge is implemented by the Spa Repair Company. NON –REPUTABLE company.  George assured

me that the cover would be delivered in a day or so, so I believed him.   Initially

we were just asking for a broken cover to be fixed.  As you can see by the attachment, [redacted] the

person that sold us the spa wrote out a repair order.  As you can also see, there was a warranty for

repair of the stereo system.  The

warranty reads:  “warrants to the original

purchaser … any part thereof proves to be defective within 1 year from the date

of purchase, it will be repaired or replaced (at company discretion), without charge

to the owner.”   When I would talk (either on the phone or in

person) with [redacted] from Acrylic Spas of Arizona, she would say I was to call

Virginia at SPA movers.  [redacted] even helped

me fill out work orders to get these repairs accomplished.  When I talked with Virginia she would tell me

that [redacted] was not taking care of her customers.

In their letter Acrylic Spas of

Arizona states “This is actually not an Acrylic Spas of Arizona problem; this

is an AZ Spa Repair concern.”  It doesn’t

matter to me who concern it is as long as it gets fixed.  Since they have failed to repair the cover,

water has gotten into the electrical system and has caused further damage.

2.  They stated we

have refused service from Acrylic Spas of Arizona.  We have NEVER

refused service.  We have been

available whenever they have stated that they would come.  On November 29, 2012, my daughter took a day

off work, but they did not come as they had arranged.

3. As you can see from the business card, Max Holtrop was or

is a manager of Spas of AZ.  He was an employee

of the store where we bought the SPA.

His card specifies that he is a manager of that store.  Why would we not trust that he could help us

with fixing broken jets?  The broken jets

could not be detected at the time of delivery; we had to fill the spa with

water.  No delivery person would wait

that long.  Also there is a warranty for

the broken jets. “In the event of any defect covered by this Limited Warranty,

Dyasty Spas or its authorized agent will correct such defect.”

4.  We could not

detect the problems with the draining system, until we tried to drain the SPA.  This too is under warranty.

Acrylic Spas of Arizona has not completed all that they

stated they would do.  They have not

complied with the work orders to fix the SPA, which led to even more damage to

the spa and the electrical system.  They

have not honored their warranty.  They

have stated that this problem was someone else’s problem and AZ Spa Repair

stated it is Acrylic Spas pf Arizona problem.

We have not refused any services of any of the providers.  We have gotten a run-around until further

damage was done to the SPA.  This action

fits under the Arizona Lemon law.

Therefore we still are requesting a refund of $6356.

Review: On March 15, 2015, I purchased a Cal Spa 737L spa from Spa Man Spa. The contract states delivery in 3-5 weeks.

I paid $6200 for the spa.

I have called several time, left messages, ect. and have not received a return call as to the status of the spa.Desired Settlement: I would request either the delivery of my order, or a full refund in the amount of $6200.

Thank you for your time.

I will be out of town from 5/3-5/19/2015.

Response:

I am sorry to get back to you so late.We have Mr. [redacted] scheduled for Delivery at 11am on Friday, May 22nd.

Review: We ordered and paid for a Spa from Mr. Spa, or whatever their name is, July 30th 2015. We were told to expect delivery in 4-6 weeks. To date we have not received it. We have been told that they can't afford the shipping, then that it has not been manufactured by Bull frog Spas. There is no clear answer or delivery date thus far.Desired Settlement: Delivery by Nov. 15, 2015 or full refund with interest paid to date.

Review: I Purchased a hottub from ABC spas of Arizona from [redacted] - the manager in Gilbert, Arizona. Since receiving my hottub from them I have had numerous problems with the hottub, which include; the ozone going out on it, the radio has stopped working, the speakers have quit working on it, the jets have fallen off and were floating in the water, other jets are hard to turn and stuck, it is leaking from the inside of the tub somewhere and creating a mold and green sludge around one side of my hottub, the multicolor lights have quit working, the electrical adapter underneath the spa had to be replaced (took them 3 weeks to return to replace it).....I have repeatedly over the course of 2 years been calling [redacted] at ABC spas of Arizona and it has become a constant conversation of "let me talk with the repair company and I'll call you back", "have you called the repair company, but you will have to pay them because it is past your warranty time", "let me speak with the owner and I'll call you back", "the owner and main manager is here in town, let me speak with him and tell you all the problems you've had since day 1 of buying this and let me have him call you directly"......BOTTOM LINE- THEY NEVER CALL ME BACK, NO MANAGER CALLS ME, NO REPAIR COMPANY SHOWS UP TO FIX THE HOTTUB, AND THE OWNER HAS NEVER CALLED ME BACK. ITS PRETTY OBVIOUS I BOUGHT A "LEMON" - AND THEY ARE UNWILLING TO FIX ALL THINGS ASSOCIATED WITH THE HOTTUB. I have been more than patient over 2 years with one thing after another breaking down, stop working, but its been one thing after another since buying this. And the fact that [redacted] or their Owner/Manager doesn't have the decency to call me back and get this squared away when I spent over $8,000.00 dollars with them is unethical and ridiculous!!ABC Spas of Arizona has sold me a "LEMON" FOR A HOTTUB - THEY DON'T HAVE THE DECENCY OF RETURNING MY CALL NOR FIXING THE PROBLEMS WITH THE HOTUB AFTER I'VE CALLED THEM NUMEROUS, NUMEROUS, NUMEROUS TIMES OVER 2 YEARS. BAD BUSINESS!!!Desired Settlement: ALL I AM ASKING, LIKE I'VE EVER ASKED IS TO FIX THE PROBLEMS AS THEY COME UP. I'M ASKING THEM TO SEND A REPAIR PERSON TO MY HOUSE AND FIX THE PROBLEMS. AND I HOPE THEY LEARN TO HAVE A LITTLE ETHICAL DECENCY AND IF THEY SELL SOMETHING THAT IS BROKEN, HAVE ENOUGH DECENCY TO FIX IT. TREAT A CUSTOMER LIKE YOU WOULD WANT TO BE TREATED. Response:

READ BELOW: This is the email and attached and saved photos from the repair company, which I have a copy of all of this and the original invoice they left me stating so;

As far as the pump damage, according to the Technician, it is not caused by a warranty issue, but chemical damage, therefore, we cannot cover that, same decision that the manufacturer would make. We have enclose a copy of the Repair Technician's invoice, showing that the customer, Mr. [redacted] is aware of the problems and causes.

Review: We purchased a [redacted] Spa from [redacted] at [redacted] spring of 2013 at a purchase price of for $12,000. Upon delivery of Spa our cover was the wrong size so they had to redeliver cover which took several weeks. Upon filling up spa we had a leak so we called [redacted] to have this issue repaired which again took several weeks and an entire day off work because they needed someone over 18 to be home between 8am and 2pm however repairman did not actually arrive until after 6:30pm. When the spa was about 6 months old our spa cover developed mold, after doing some research we found that there was a manufacture defect in the cover which allowed moisture and mildew to set in thus causing the mold. [redacted] sent a new cover out but it was not as good quality as the original one we purchased. Recently we noticed that the water in our spa was draining very quickly and the pavers around the concrete pad our spa is on started shifting. I called [redacted] and spoke to [redacted] who told me that we how have to pay for the service call which is $89 for them to come look at our leaky spa that’s only 1 year old. I called the service company as directed by [redacted] and was informed that [redacted] is notorious for quoting the wrong service call pricing and that the price will actually be higher than the $89 I was quoted by [redacted]. I called back to [redacted] and spoke to the GM named [redacted] who told me that any issues we have with the spa should be taken up with [redacted] and not [redacted]. I asked if they would at least pay the service call since they were the company that sold us the spa and per [redacted] was told NO very firmly. [redacted] further told me that 3% to 5% of spas that they sell arrive and are delivered to customers leaking and if they pay for every service call they will lose money. [redacted] said that no exceptions will be made PERIOD to assist us with service call and we are on our own to do whatever is needed to fix the leak. At this point we are not sure if [redacted] manufactures poor spas or if [redacted] are knowingly selling poor quality spas but I can say that [redacted] of [redacted] and their GM [redacted] have exhibited unsatisfactory customer service and I will never recommend them to anyone or buy from them again.Desired Settlement: [redacted] to pay for the repair of leaky Spa

Business

Response:

Acrylic Spas of Arizona has done our part in what our business has called for and that is selling and delivering the requested spa to Mrs. [redacted]. We will state, however, that the customers purchase price was $8,710 not $12,000 and it was delivered on Feb. 13th , 2013. Our policy is to cover any warranty issues within the first month from delivery of the spa, and we have. Mrs. [redacted] was explained that at the time of the sale. Acrylic Spas of Arizona is not liable for any charges for trip charge, labor or warranty after the first month. The charge that she is questioning is not an Acrylic Spas of Arizona charge, that charge is implemented by the Spa Repair Company. We have no say in the matter and in Mrs. [redacted]'s warranty paperwork she received with the spa; it states that the Manufacturer does not cover trip charges; exact wording- "There will be a reasonable trip charge, for services performed after the initial delivery." This is an industry standard, and in Arizona, the normal charge ranges from $100-$150, whereas the Spa Repair company is only charging $90.I have attached a signed copy of Mrs. [redacted]'s sales agreement, the signed Spa Delivery Acceptance Form and her warranty paperwork from the manufacturer given to her at time of spa delivery.

Review: We purchased a Bay Hill CLB7L (lounger) from Spas of Arizona on September 24, 2011, which was delivered October 2nd. The item delivered was broken. A history of the problems encountered with the spa are as follows: 1. On delivery, the cover for the stereo was broken and a purchase order was sent for repairs. This repair order was sent by SPA Movers. 2. The overall topper cover was broken, also on delivery. After numerous calls, this cover was never replaced. On November 11, 2011, I stopped at SPA-Man Spas at [redacted]. This is where the spa was purchased. [redacted], sales person completed another repair request form. This cover has still never been repaired. 3. When it rained, water got into the stereo because of the faulty cover so that the stereo no longer works. Water receded into the electrical system causing even more damage and creating a fire hazard. 4. The jets on the seats were broken at time of delivery. Max Holtrop (sales person) took these Jets on December 7, 2011, and promised to replace them. To date these jets have not been repaired or replaced. 5. After the Arizona monsoon rains in 2012, the remaining jets and the control panel malfunctioned. Because of this, we drained the SPA to ensure safety for the family and to avoid a potential house fire. 6. Numerous calls have been made to [redacted] (owner) and they have gone unanswered with no return calls. 7. A letter of intent outlining the concerns was sent to Spa Manufacturer, [redacted] on October 12, 2012. They sent out a repair person but still no repairs have been made or compensation given.Desired Settlement: As a result of all these problems, I request that a full refund of the amount paid in the sum of $6356 be sent and that what is left of the spa be picked up. There remains the Spa, the cover, the cover butler, and the steps. These accessories are unusable without the SPA. Removal must be at the manufacturer or business expense. This transaction comes under Arizona's Lemon Law.

Dear

Sincerely,

Response:

I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this proposed action would not resolve my complaint. For your reference, details of the offer I reviewed appear below.

Regards,

Response to Acrylic Spas of Arizona:

The letter from Acrylic Spas of Arizona has several inaccuracies

in their response.

1. When the SPA was delivered

I did not sign that the cover was broken.

I had never bought a SPA before and I did not know I was dealing with an

I also want

repairs on damages that was done to our Spa because of the neglect of timely

repairs.
