The complaintant came on as manager for the property I was already servicing in SeptemberI want it to be known that payments for Oct, Nov & Dec were not paid until late January and the ONLY reason they were paid was because a manager higher up in the company (if you need the manager's name and number, I would be happy to provide it) got involved and I have the check dates to prove it! Nothing this manager did was in a timely mannerThe complaintant efused to return phone calls and communicate - that is until I got upper management involvedThe same day that she was contacted about non-payment by upper management, is the same day we had our first contact from her and it was a day noticeAlso, management was aware that pool logs were kept on my person because of theft

I am rejecting this response because: I really don't care about when invoices were paid, on time not on time I am not embarrassedI only control a portion of the payment system and whenever they are approved they are approved I have no control over thatI have written affidavits from several pool experts and employees stating that his service was not done in over a month (accounting for the weather conditions of January)Also if that is the case he invoiced me for THE ENTIRE MONTH OF JANUARY, when he clearly stated in writing that he only serviced us until the 25th of JanuarySo some sort of refund is in fact owedI have provided the Revdex.com with plenty of proof to back up my claimsI also have in my possession txt messages (rude and disrespectful and unprofessional) from Sparkling Clear Pools letting me know that in fact they refused to speak to me to address this issue and threatened to contact the Revdex.com and make complaints about the property in retaliation if I contacted the Revdex.comI am not going to sit here and go back and forth with [redacted] or [redacted] in regards to thisA decision needs to be made, given now both parties have shared their sides

If I understand this correctly, Ms [redacted]’s chief complaint is about the quality & care of the pool in the month of January.  As anyone in Sacramento (or California for that matter) is aware, the month of January 2016 was fraught with torrential rain fall & heavy wind.  Auberry Park was on winter rates that they established - once a week service every Monday.  My last day of service was Monday, January 25. Despite a pool company’s best efforts to maintain a high level of performance, those adverse weather conditions create an undeniable, inescapable fact – the pool will always have some form of debris in it.  Ms [redacted] thanked me for my service when I returned the keys. Had she any complaint, that would have been the time to express it.  (As a side note, her comment about the ‘new’ pool service claiming the pool had not been cleaned, a new business might say anything to garner a positive response).  As for visual proof (i.e. pictures) that Ms [redacted] claims to have in her possession, those were taken after a storm in the month of February.Her comments about previous months quality are false.  As she herself said, I’ve been servicing her pool for many years and if there was a problem, it would have been addressed.  And the remarks about the pool logs are nonsensical in that she has never once mentioned keeping pool logs on site. My company has never engaged in unlawful practices so I am at a loss to respond to her remarks vilifying us because we were directed to send the past due invoices to someone higher up when they were not being paid.  Plain & simple we believe the root of this complaint stems from Ms [redacted]’s anger & embarrassment at being late in paying our invoices.  When she was called on the carpet (so to speak) by us having another manager get involved, that was when she terminated our service. Furthermore, in regards to her comments about my wife sending rude texts, my wife did not send them.  It was me and not my wife who she was texting (she needs to double check the phone number & get her story straight) - she was harassing me and interfering with my daily job performance.  Just as she is harassing the Revdex.com with these fraudulent, excessive, time-wasting queries. This is our last response. I am an extremely busy pool service owner. I would like to stress we have adequately explained our position & any further libel on Ms [redacted]s part, will be reviewed by our legal counsel.  We refuse to refund any monies.  In closing, we thank you for your time.  We sincerely hope Ms [redacted] moves on in her quest to find the perfect pool company and we wish her new pool company good luck.

[redacted] from Sparkling Clear Pools has cleaned my pool for several years. At times I would have to have a talk with him about his less than stellar performance. But it always seemed to improve. Once I put my 30 day notice in to change to a different company [redacted] insisted that I pay the bill but he did not clean our pool for an entire month. My new pool company took pictures and confirmed that in fact it had not been cleaned in at least 4 weeks if not more. [redacted] refuses to take my calls or refund my payment.

Review: [redacted] has done business with Sparkling Clear Pools for a number of years (I believe). In that time we have had to have a few talks with [redacted] or [redacted] (the owners) about their less than stellar work performance. Finally it got to the point where we had to put in our 30 day notice (along with our sister property). We put the notice in around the middle of December 2015 and stated that Jan 31, 2016 would be our last day of service. [redacted] has paid all amounts owed including the January billing (which is my dispute). When our new pool service took over they stated that the pool had not been cleaned in at least 4 weeks if not more. They took pictures of the sm on the walls and the green water and the debris in the pool. (Which I can provide you if needed). When I reached out to [redacted] he did not return my calls. I called [redacted] and discussed my complaint with her she said she would speak to [redacted] and get back to me. A few days later she sent me several nasty and rude text messages (which I also can provide you). I let her know if I did not hear from them by today I would be contacting the Revdex.com. She in turn replied that she would then file a retaliatory claim against us with the Revdex.com if I did contact them.

They are going to say our bills were always late (which is true, but they always got paid), even though they never sent any invoices to me always to a 3rd party. I came on in Sept and started paying bills in Nov, since that point everything has been done in a timely manor. Regardless of all this, they simply cannot bill us for service not rendered. I paid the Jan invoice in advance and they did not follow thru with their end. I do have pool logs that have not been filled out either to submit as proof he has not been cleaning the pool.

I have given them my personal cell phone to call if they cannot reach me at the office, so there should be no reason they cannot get a hold of me.Desired Settlement: I want the $195 that I paid for January refunded. Also I would like refunded the second half of Dec (from the day we put our notice in).
