This letter is a rebuttal response in reference to ID [redacted] claiming that SPC did not honor our warranty.ATTACHMENT #shows the packs (SPC8250/2S) sent to the customer in NEW condition.ATTACHMENT #shows the photo sent to us by the customer showing the damaged hole in each packAlso obvious is abrasion and/or wear scraping near the area of the yellow warning label which is partially worn off and similar scraping on the front label.Our Pre-Sale Agreement to the Terms and Conditions is stated on our website and clearly reads:Please read our Terms and Conditions listed belowBy agreeing to these conditions you acknowledge full understanding of the Terms and Conditions, including the SPC Racing (SPC) warrantyAfter agreeing you will then be able to proceed with your purchaseIf you do not agree with these Terms and Conditions, please do not attempt to order a product from SPC.(ATTACHMENT #is a complete copy of the Terms & Conditions as listed on the website www.spcracinq.com)During the checkout process prior to confirming an order a customer must check the box which reads “I have read and agree to the Terms and Conditions" in order to continue to the confirmation page, (ATTACHMENT #4) if the customer does not check the box just noted, the ordering process cannot proceed.Therefore, this customer DID check that box in order to finalize a purchase.ATTACHMENT #shows the original Sales Receipt of customer showing the date of purchase of May 6, 2015.Our Warranty Policy as noted above in ATTACHMENT #clearly states “SPC LiPo packs come with a warranty against manufacturer defects for days from the date ofpurchase." Also stated in that “Warranty”, “SPC will not warranty a battery pack physically damaged as a result of abuse and/or impact of ANY kind."In conclusion, it is very obvious to me and our in-house Engineer with years of RC experience; in viewing the photos provided by the customer, that both battery packs were damaged by outside forces which mostly likely occurred during the operation and use of the packs by the customerAs noted in ATTACHMENT #which includes our official “Warranty Policy”, damage such as this from outside forces is not covered by our warranty and the terms of this warranty were agreed to by the customer at the time of his purchase.Lastly, our official warranty policy is days from the date of purchaseHe contacted SPC by email on August 7, which is days beyond the day warranty period.SPC made numerous attempts to explain the damage to the packs and how it applied to our warranty and conditionsThe last email was sent to customer dated August 10,stating, “The photos you sent in the first e-mail very clearly show damage to the packs that was the result of an outside force of some typeThis type of damage is not covered under our warranty policy,” and signed by our Engineering Manager, [redacted] (ATTACHMENTS ####9)No email reply was received from customer after August 10, 2015.Sincerely, [redacted] *Spec Point Concepts / SPC Racing

Review: Business did not honor warranty. Two LIPO batteries sold by SPC developed burns and charring and leakage due to manufacturing defects rendering the batteries unsafe to use. Upon inspection I detected burned plastic, aluminum foil and other materials; also, when I rubbed my finger in it I collected soot and it smelled like sour burned plastic. When I contacted, SPC they required photos of the batteries.I sent four photos. They replied "From the photos it is obvious that both packs have experienced the same abrasion and/or impact in similar locations on the pack surfaces". also they suggested "Take a look inside the battery bay of the Traxxas Summit and in the top of that battery bays look for any screws that may be protruding down from the top. It is not unusual for a screw to be protruding down into the battery bay and if so it will create the abrasion issues you are experiencing" I sent 13 photos of the batteries bays hopping to demonstrate that there are no screws protruding into battery compartments and also I did not make any modifications to the original equipment but they replied "damage to the packs that was the result of an outside force of some type" When the batteries are installed they are well protected from all six sides because a good manufacturing design I think is impossible to get abrasions especially only after 7 uses Unfortunately I can't email the soot or the burnt smell.Desired Settlement: refund or repair or replacement
