Dear Sir/Madam: We sincerely apologize to Mr [redacted] for any inconvenience that this incident may have caused him I have reviewed our file in regards to the subject incident and found that the file was originally placed with our office by Oak Hollow apartments on June 26, From the file notes it appears that we did not contact Mr [redacted] previously as we did not have a current telephone number for him until late September We are unaware of when Oak Hollow Apartments placed the file with a second collection agency, and did not know such placement had occurred until receiving this complaint Unfortunately, it is not a rare occurrence for a business to place debt files with multiple collection agencies Never the less, we have updated Mr [redacted] 's account file to notate the new information and will be closing his file as satisfied Please do not hesitate to contact me if I may be of further assistance Sincerely, [redacted] ***

Dear Sir/Madam:
Per our representatives conversations with Ms***, a request to delete this request from her credit report was submitted to the three main credit bureaus on June 30, via the e-oscar system utilized by the bureaus. Unfortunately, our
office has no control over the credit bureaus as to the speed with which they update reports. In the past we have found that it may take as long as 90-days for changes to be reflected on a credit report.
We would be happy to assist Ms*** in any way possibleHowever, the solution that she desires, i.etimely updating by the credit bureau, is beyond our control. I would strongly encourage Ms*** to contact the credit bureaus regarding their delay in updating her reports.

I am rejecting this response because: What Mr*** has failed to include in his response is that I was lied to more than one time, he led me to believe that the letter was going to be in the mail in three days, I waited days and was told on two different occasions that it was put in the mail that day,( two different days) I wonder if he happens to have those recordings? There should be about of them, I would love to hear his lies again. Please see the attached.Consumer lodged a complaint with the Revdex.com on August 15, 2015.  This company responded, and on August 21, 2015, the consumer rejected this company’s response.  In the consumer’s rejection, he reiterated the same objections of his original complaint. Consumer reiterated that he does not owe money and that proof should be produced immediately.  Since this response may be viewed by the public, this company will not produce proof through this forum.  However, as stated in our original response, consumer has two delinquent accounts with the original creditor.  The original creditor hired Talbott, Adams and Moore d/b/a Spears, Dewitt & Hall to collect these debts on its behalf.  Proof of debt has been mailed via certified mail, return receipt requested.   In consumer’s rejection, he stated that he will report this to the federal trade commission and any other parties to remove the debts from his credit reports.  As stated in our original response, if the consumer does not believe the credit agencies are reporting the debts accurately, he can dispute the debts with the credit reporting agencies under the procedures outlined in the Fair Credit Reporting Act.

2015.2)  Customer files Complaint ID Number 10653995 at 12:20 pm on June 4, 2015.  This is a mere 63 minutes after paying thebalance in full. 3)  Customer states that, “This company refused to delete an unnecessary and negative account from my credit file despite the fact that the balance was paid in full.”4)  Customer states in his Desired Result that, “I would like the account DELETED from my credit file immediately.” In response to the Customer’s complaint SDH make the following rebuttal/response.A)  The account was not paid in full until 11:17 am on June 4, 2015.  SDH will report the account as paid in full at its earliest possible opportunity.  SDH cannot respond within 63 minutes and the entire process between SDH and the Credit Reporting Services may take up to 30 days.B)  SDH cannot delete a valid account.  SDH can only update the balance to show a balance of 0.00 that has been Paid inFull.C)  Further, SDH management has reviewed the recording of the conversation between the customer and our agent.  Our agent never promised that the account would be removed, but only that it would be updated as paid in full.  The recording is available but we will not attach it at this time, as it contains sensitive information concerning the customer.

RE: Second Response to Complaint [redacted]  The Texas Finance Code, Section 392.101, states that a third-party debt
collection agency may operate in the state of Texas with the issuance of a surety bond
from the Department of the Secretary of State. Talbott, Adams & Moore DBA Spears,
DeWitt & Hall is bonded in the state of Texas, under Texas Finance Code Section
392.101, and is incorporated by the Secretary of the State of Texas to do business as a
collection agency.
In addition, Talbott, Adams & Moore DBA Spears, DeWitt & Hall has been
contracted by International Bank of Commerce as a third-party debt collections
agency.
Also, the complainant entered into an agreement with the original creditor
which gives this company the authorization to contact the complainant, at any
address or phone number provided, to collect a debt. Page 16 of the International
Bank of Commerce Deposit Account Agreement states,
“Each Authorized Signatory shall be jointly and severally liable for any and all
overdrafts on this Account, including all service charges and fees and interest charged
due to such overdrafts, and for any attorney’s fees and related collection costs
incurred by Bank regarding any and all efforts made to collect such overdraft, whether
or not the overdraft was incurred by one or more of the Authorized Signatories,
without the knowledge of, agreement from and/or any benefits resulting to, any other
Authorized Signatory.”
Having established that Talbott, Adams & Moore DBA Spears, DeWitt & Hall
has the right to collect debt in the state of Texas and has the right to collect on behalf
of International Bank of Commerce, this company has acted within the law when
attempting to collect this debt.
This company has verified the debt as valid with the original creditor and have
sent proof of such, via certified mail. This account has never been resolved and is still
an active collectible account.
The complainant is correct in that this activity falls under the FCRA
regulations. This company has not only followed the regulations under the FCRA but
has complied with all regulations under the FDCPA.

The complainant states that the phone number we had in regards to the account placed with
Spears, Dewitt & Hall (SDH) was the wrong number. We retrieved the phone records and we
show the number called is [redacted] matching...

that of the complainant. The complainant
refused to verify her identity on multiple calls. On July 24th 2014, the complainant called back
requesting the name of the company and verified her identity by date of birth with our
representative. After finding out the reason for our call, the complainant then claimed that she
was not [redacted].
On October 21st 2014, our representative called the number [redacted], the
complainant claimed she was not [redacted] and that we had the wrong number.
On April 27th 2015 our representative called [redacted] asking for [redacted], the
complainant said she was [redacted] and then claimed she wasn’t “that one” and didn’t verify her
identity with our representative and terminated the call.
On May 11th 2015 our representative called [redacted] the complainant claimed the
number was a place of business and no one named [redacted] was there.
On October 9th 2015 we received a call from the complainant calling about an item on her
credit report.
The complainant claims our company divulged her personal information to another
individual. We deny such allegation. After reviewing all recordings, the voice for all the calls
are the same. The complainant, after verifying their identity, was misrepresenting themselves.
No personal information was divulged to anyone other than the complainant. The complainant
has a valid debt and the information from the original creditor has been verified as accurate and
true.
SDH operated within the laws when reporting the debt to the Credit Bureaus' and for all
calls made regarding the account both incoming and outgoing.

We have confirmed with the original creditor that the debt is valid. As
per contract, signed by complainant, with the original creditor, this agency has
the right to charge collection costs and interest....

This agency has attempted to
make contact with the complainant multiple times and the complainant would
not verify themselves during the call.
Spears, Dewitt and Hall conducted an audit on our accounts and rereported
to the credit agency. This company has operated within the law as
there is no time limit to first report accounts to the credit bureaus.
Complainant claims that they did not break the lease. However, moveout
notice was given less than one month from the actual move-out date. Per
the TAA contract, signed by the complainant, there is a requirement to give a
60 day notice prior to moving out, otherwise the lessee will be responsible for
re-letting charges and broken lease charges. Complainant claims they were on
a month-to-month rent payment and was not aware of any outstanding
charges for rent for the month of March, 2010. Per the TAA contract, signed by
the complainant, the move-in date was March 20th, 2009 with the lease ending
on February 28th, 2010. Notice was given by complainant on February 19,
2010, which fails to adhere to the signed TAA agreement stating that a 60 day
notice is required. As it is, the complainant provided notice only 9 days prior
to the lease ending.
However, Spears, Dewitt & Hall agrees to remove all interest from the
account. Due to consumer confidentiality, we ask that the complainant
contact us directly to receive the adjusted total so that payment arrangements
can be made.

Mr. [redacted]'s debt account placed with Talbott, Adams & Moore Inc by our client is valid and true. Our client was unable to convince Mr. [redacted] to pay so they placed the account with us to collect on it. Mr [redacted] has made payment in the amount of $103.57 to Talbott, Adams & Moore on...

the original balance of $414.81 placed with us leaving him a balance of $311.24. That payment has been forwarded to our client.  In accordance to the Fair Credit Reporting Act, we will continue to report the account to the credit bureau's. complainant called Spears, Dewitt,& Hall she spoke with one of our agents named [redacted].  [redacted] thought he was making a call throughthe company’s dialer for [redacted]’s Lawn Mowing Service.  Therefore, when the call was transferred to him,he answered the phone by saying, “is this the lawn service company.”  When the caller replied no [redacted] stated,“is this [redacted].”  He never asked if it was[redacted] as can be demonstrated in the attached recording of theconversation.  (Labeled [redacted] Call).  [redacted], believing that he had tried to callthe lawn service stated that he was sorry and disconnected the call. 2.  Complaintconcerning collection manager: The collection manager, [redacted], politely gave the complainantthe address of the company three separate times.  That is when the collection manager found outthat the complainant was driving and told her that she should call when thecomplainant was not driving so that the complainant would not put anyone indanger.  The audio of this call is attached.  (Labeled [redacted]’s Call). 3.  Complaintconcerning Paid in Full Letter: In the calls complainant makes several statements that shehas made numerous calls to Spears, Dewitt, & Hall concerning this account.  Complainant has made a total of three callsand was treated with respect in all three calls.  The letter has been waiting at the CorporateOffice in San Antonio for pick upby the complainant, which she requested. Based on the complaint it is being sent today for certified mail RRR andis attached to this response.  (CMR# [redacted]). Any further questions or concerns can be addressed to thecompany’s Corporate Counsel, [redacted], at [redacted] or[redacted].

Spears, Dewitt & Hall has investigated the call recordings for this incident. The
representative Tery Kelly is no longer with the company. A paid in full letter has been mailed to
the address provided. We apologize for any inconvenience this may have caused you.

I have reviewed the response made by the business in reference to complaint ID [redacted], and find that this resolution is satisfactory to me. However, the statements made by SDH/TAM are not accurate. Equifax completed their investigation to this matter on January 16, 2016. They updated my credit report as to saying PAID IN FULL. SDH/TAM was fully aware since January that they were reporting this information on my report twice and did nothing to correct it. I then sent a dispute letter with all my documents supporting documents requesting they delete the account from my TransUnion and Equifax reports. After waiting 30 business days for a response and never receiving one, I sent a follow up letter and disputed the negative account again through TransUnion and they ruled in my favor as well. It was only AFTER I filed a complaint with the Revdex.com did SDH/TAM sent a request to remove the information from my credit report 4 days after I filed my complaint! Hmmm, makes you wonder! Thank you for deleting this from my file!

The consumer's complaint alleges that a dispute letter was sent to Spears, Dewitt & Hall (hereinafter "SDH") during the month of February 2016 and that SDH never responded to the request. SDH verifies receiving this letter on February 4th, 2016, at which time SDH immediately marked the account...

as dispute and reported the account, as such, to the credit bureaus. SDH has no control on the amount of time the credit reporting agencies take to update consumer credit reports. SDH submitted the dispute in a timely manner, well within the 30 day period required by the FCRA. After careful investigation of this matter, it has been determined that the disputed debt is rightfully owed by the consumer. However, in good faith, SDH will send a delete request to the credit bureaus and close the account. See attached proof (Exhibit A) showing cancellation of account. SDH will also send Exhibit A to the consumer by mail.

I am rejecting this response because: I originally requested documents on February 25 2015 when I put the first payment of 850 dollars detailing what the total amount and balance and every month after when making my payments was reassured by agent the statements were in the mail never received any letters from spears dewitt and hall 6 months passed debt was paid off spoke to secretary . The company was full aware of who I was and what I was requesting.I explained situation to secratary and wanted to be transfered to employee who could help me get situation resolved explained to her I was a paying customer and asked if I needed to get a lawyer to get this resolved.. I even asked if I needed to do this in writing was told no that they were sorry issue was never resolved that is when I was transfered to mr *.when I told him I wasnt [redacted] and said I was transfered to him he hung up I was told I would receive a letter stating debt was paid in full and would be reported to credit agencies. I received a letter on 8/72015Stating debt was paid in full but still shows a penny balance wish they can sale to other debt collection agency and reflect negative on my credit. I paid my debt even paid twice in april 2015. mrs. [redacted] could of stated it was a misunderstanding on mr * part never stated that asked if I got his name and I said no and she stated she could not do anything
