Sales staff are obliged to know how many bedrooms are in a unit #of bedrooms may greatly affect resale prices Why was the unit still listed as a 3BR when the buyer returned to the sales office weeks later? The buyer was told he was " not Shea's type of buyer" when he asked if he could accept the home "as is" or purchase another home at the above visit The buyer was told t hat there were no other homes available, yet buyer continues to receive e mails about available units at the complexBuyer was not offered a chance to buy another property should it become available Why was the buyer told that a single resident does not need a third bedroom? Buyer continues to request that Shea make good on its advertising and sales sheets and honor the reservation for a BR unit or offer acceptable alternatives It is puzzling to this day why a qualified buyer is not " Shea's type of buyer." For your reference, details of the offer I reviewed appear below. Unfortunately, Shea Homes has been totally uncooperative in resolving this matter. The home was clearly listed as a 3 BR home and in good faith a deposit was made. Numerous attempts to contact the sales manager to clarify the status of this unit failed. The sales manager told me to contact the design manager. The design manager told me to contact the sales manager. My real estate agent attempted to have Shea Homes honor the listed agreement. Shea insisted that I pay extra to have the "option" of an office plus a bedroom, then pay again to have the office converted back to a bedroom at my own time and expense. I had flown down from Sacramento to make this transaction and left with the understanding I had purchased a 3BR home. Due to confusing messages and non-receipt of my deposit check, I again personally visited the sales center and spoke with the sales manager. I asked if it would be possible for me to accept the unit "as is" and was told, " You are not Shea's type of buyer. " I found this comment demeaning to me as a person and inappropriate. I was also berated for having asked to speak to a higher authority in the company to resolve this matter. Shea's response does not explain why I was told that as a single person I don't need the third bedroom. Shea did not put any final offer in writing , just sent my check back, causing me to lose my home. Shea Homes has demonstrated a lack of integrity and lack of commitment to the San Diego community by engaging in misleading and confusing advertising and sales practices. When I returned to the sales center, they continued to list Lot 148 as a 3 BR unit. It is beyond me that a corporation this size fails to make good on their own errors, even when it would only involve installing a closet. Regards, [redacted]

THERE HAS BEEN NO OFFER FROM SHEA HOMES. THERE HAS BEEN NO RESPONSE FROM SHEA HOMES TO OUR COMPLAINT TO THE Revdex.com. THE LAST DATE SHEA CONTACTED US WAS FRIDAY APRIL 18, WHEN THEY SENT A REPRESENTATIVE TO VISIT US. We complained about the visit via email to Shea Homes. There was no response. Therefore, on May 6, 2014, we sent a formal complaint by registered mail to the corporation's legal address for service. THERE HAS BEEN NO RESPONSE TO THAT LETTER That is when we decided to contact the Revdex.com, the State Contractors State License Board, and other consumer agencies.
The only conclusion we can possibly reach is that the statement that Shea is attempting to settle with is simply not true.
We believe that Shea is attempting delay because the year construction warranty will begin expiring next year. The weep screed rust problem has affected every neighbor we have spoken to. To date, we have made no effort to contact the entire neighborhood, but we believe the entire tract was constructed with defective weep screed material
As to the Better Business Complaint, we originally filed in San Jose with a response deadline of July2. The San Jose Revdex.com called and stated that Shea Homes had a response to send to us and they were just waiting for the file to be transferred to San Diego. That delayed a response from the Revdex.com even further. After investigating Shea, I have discovered that complaints about the company follow the exact routine: non-responsiveness to consumers. I will assume from that course of response, they hope the homeowner will "just go away"

This letter is in response to your correspondence from October 7, We have reviewed the
additional information that Mr*** submitted and regret he remains upset that we were
unable to convert the Plan unit in question (Lot 148) from a 2BR with den to a 3BR unitAs we
previously mentioned, as soon as we learned that the price sheet showed Plan as a 3BR unit,
which was prior to having entered into any purchase contract, we notified Mr*** of the
mistakeAt that point, the unit on Lot *** was past the stage of construction where his request to
add a closet could be accommodatedWe explained this to Mr*** and apologized on
several occasions for the misunderstandingWe are changing the price sheet for Plan at
sociaiGarden so that it more clearly reflects that Plan may be either a 2BR with den or a 3BR,
consistent with the options price sheet and our other marketing materials
Thank you for the opportunity to respond to this complaintWe wish Mr*** the best in
searching for a new home

Mr. [redacted] first visited our socialGarden community on August 31 , 2014. At that time he viewed the community
models and walked the unit he was interested in (Lot 148). He also received a price sheet, floor plans and option
price sheet for the unit as well as a print out of options...

which were included in the purchase price of the unit. Mr.
[redacted] came back the following day to reserve Lot 148. At the time of the reservation, he left a deposit check,
and signed a reservation agreement to hold Lot 148. The reservation agreement expired on September 5, 2014, and
Shea Homes never entered into a binding purchase contract with Mr. [redacted].
The following day, September 2, it was discovered that the unit was built as a two bedroom unit with a study, not a
three bedroom unit. Although the price sheet listed our base unit as a three bedroom, the option price sheet did state
the unit on Lot 148 was a two bedroom with a study in lieu of a third bedroom.
We explained to Mr. [redacted] that Lot 148 was a two bedroom unit with a study, and not a three bedroom unit. We
apologized to him for the misunderstanding and tried to explain that it was an honest mistake. He then requested
that the missing closet be included to make the unit a three bedroom unit. Unfortunately, since this unit was past the
drywall stage in construction, we could not grant his request. From September 2 through September 8, Mr.
[redacted] asked us repeatedly to change the unit, and again we explained that we were past this stage of
construction and were unable to make the accommodation. Since the change could not be made and we could not
satisfy Mr. [redacted], and because the reservation had expired, we returned his deposit. We wish him the best in
his home search.

Buyer continues to request that Shea make good on its advertising and sales sheets and honor the reservation for a 3 BR unit or offer acceptable alternatives.
It is puzzling to this day why a qualified buyer is not " Shea's type of buyer."  Does this mean I am not eligible to purchase any Shea Home?   Please explain.
