Review: on oct. 10th, I drove from Bakersfield, to Paso Robles yo pick up my 5th wheel. which was damaged when it was picked up from my drive way. The damage was not even anything big. it was the cover of the shower breather, it was not even a big damage, a piece was broken when the 5th wheel was pulled and a palm tree was in front of it, nevertheless it was damaged. I took pictures of the pieces of plastic let in the drive way. when I got to Paso Robles, I saw where the pieces in my driveway where from. the appointment was at 3 pm, I got there at 2PM. they say I had to wait, which I did. 3pm comes around they come out with the paperwork, and on one page I had to sign that the trailer was in good condition and that no damges where found. I questioned that what about the shower cover that was broken, they said it was like that when they picked it up. they even showed my a picture they took afterwards, and it still had a piece of palm tree leaf stocked on the shower breather, from when they pulled it out. at thsi moment the owner John comes out and said to me that I was a lair, son of #@$%%, and continued to curse me out with very dicriminatory words, such as wetback, beaner,...Very bad attitude, it was almost like a switch went off. the polite john I had spoken with earlier and a new person came on, a really nasty attitude, disrespecting me to the fullest, and I do not think it was any bad word I did not hear that day, he threten me to kill me, to come to my house and take everything I own, but not before he would beat the %$#% out of me. he took off his jacket and wanted to fight me, he got so close to my face that he spit all over my chest, (he is short I am 6,1') This is a very bad business practice, he tried to intimidate me so I can sign his paper and I was not going to file any claim against his company. But he is wrong, no person should be humiliated the way he humiliated me that day, I was by myself, and they were2 guys 1 woman. This is a real RACIST person, needs to be investigatedDesired Settlement: I need my shower cover fixed. and an apology, I did not deserve to be treated that way only because I am a Mexican decendent. I am a US citizen, and I deserve the same respect as any American citizen. This is descrimination, and racism. this is against the law.

Unit was repossessed from this debtor on 10/9/13 at the debtors home at 2405 Spruce, Bakersfield, CA. I was accompanied by two other people, michelle and Jon. The unit was backed into the debtors driveway and there was a palm tree that was in front of the unit. We backed in at a 45 degree angle and hooked up to the unit. There was nothing blocking either side of the unit and the back was also clear from any obstructions. While preparing the unit for transport the debtor came outside and asked what was going on. I advised him the unit was being repossessed for non payment. He advised that he made a payment online a couple of days prior. I contacted my client who advised that the payment was not enough to stop the repossession and to continue with the repo and have the debtor contact them and make the remainings delinquent payments. The debtor asked if he could remove some personal property from the unit and I said yes. The debtor gave me the key to the unit. We took photos of the unit prior to taking repossession of the unit and ALL damage was clearly evident in the photos. While removing the unit we were careful not to allow any palm tree branches to cause any damage to the unit. I showed the debtor the palm tree branches and he advised "don't worry about the branches causing any damage to the roof". Regardless I had Jon stand in the back of our truck and push the branches out of the way of the roof line so there were absolutely no damage done by the debtors palm tree. The piece that the debtor is claiming was broke off is located on the flat part of the roof more than half way down the trailer, not in front where the tree was located. Pulling the unit out at a 45 degree angle (the only way possible to pull the trailer out since the tree was directly in front of the trailer) there was no way possible that the tree, branches, or anything else could have caused the damage to the plastic piece located on the flat part of the roof away from the edge. The debtor was angry that we towed the unit to our office in Paso Robles, CA, a distance about 110 miles from his home. When the debtor was advised that he had to pay for storage and redemption fees of $150.00 he became angry on the telephone on 10/9/13. The debtor was angry that we would not tow his trailer back to his home in Bakersfield, CA. I advised Baldo that he had to have the bank authorize us to bring it back and the bank would not authorize it. The debtor had an appointment to pickup the trailer at 3:00 PM on 10/10/13 at our office in Paso Robles, CA. I was on my way with another agent to our office with other repossessed vehicles when I started recieving calls from both Michelle and Jon that the debtor showed up early for his appointment, around 2:00 PM. The debtor refused to sign any of the release documents and was upset that he had to pay the $150.00 in fees. The debtor advised that if we waived the storage fee he would sign the documents and not claim any damage to the unit. When he was advised that we did not damage the unit in any way and that he would be responsible for the storage fees he became angry. He accused Michelle for lying about the damage to the unit. Michelle then showed him multiple photos of the damage to the unit that were taken in his own driveway prior to the repo of the unit! When I arrived I also showed the debtor the photo of the damaged piece of equipment on the roof. The debtor then claimed a part of the tree was sticking out of the roof. When we advised that it was infact a pine needle, not part of a palm tree, the debtor became angry. When I approached the debtor and told him that we did not damage the unit in any way and he became angry. While standing in the street near the unit the debtor exited his vehicle and walked up to me and pushed me aside yelling that that the photos were not of his trailer and that we were lying. I tried to show the debtor additonal photos but he would not look at any of them. The debtor called me a liar. I showed this debtor respect and even though he was becoming increasing angry. I realized that the debtor was not going to listen to anything I had to say, even though the day before at his home prior to me leaving he shook my hand, so I walked away. I went to town to check the mail and when I arrived back Baldo and Michelle were talking and he had signed the paperwork. I never demanded that he sign the paperwork. Infact, I never had the paperwork in my hand since I had just arrived from Bakersfield, CA. Michelle handled all the paperwork and money during the transaction. Michelle and Baldo continued to speak outside and I was in the office. I never intimidated the debtor or tried to cause a fight. I could never go to his house and take everything he owns. This is a ridiculous statement and clearly shows the great lengths this debtor will go because he was upset about having to pay for the storage and redemption of the unit. During the conversation between Baldo and Michelle he advised that he would have never filed the claim for damage if he had known that she was half hispanic and that her married name was spelled the exact same as his Barragan. I am not a racist. I have immediate family members who have married other races and I have mixed children in my own relationship. If Baldo feels he was discriminated by me in any way then I apologize. When we are assigned units for recovery we do not let race play any role in us doing our job. It does not matter to us the ethnicity of the debtors. I showed the debtor respect during the repo and he shook my hand before I left his home and I thought everything was alright. The debtor signed all of our documents including the release documents advising that he agreed that "I AGREE THAT I HAVE CAREFULLY EXAMINED THE ABOVE SAID AUTOMOBILE AND MADE SURE THAT THERE IS NO DAMAGE" and "BY SIGNING THE RELEASE I FULLY UNDERSTAND THE ABOVE STATEMENTS AND DO AGREE TO RELEASE AND HOLD HARMLESS SPEEDY RECOVERY INC AND THE ORIGINAL LIEN HOLDER AND OR ITS AGENTS FROM ALL CLAIMS, DEMANDS, AND OR ACTIONS, WHATSOEVER, IN LAW OR IN EQUITY WHICH I OR MY REPRESENTATIVES SHALL, OR MAY HAVE AGAINST SAID COMPANY, ITS AGENTS, OR EMPLOYEES, BY REASON OF ANY MATTER, CAUSE OR THINGS, WHATSOEVER, PRIOR TO THE DATE THEREOF".
