Did not receive full disclosure prior to signing purchase agreement which most definitely would of affected our decision on purchasing the vehicle
In the third week of June 2018,our eye caught a truck that we were interested in at Spelmers. We went to the dealership and was amazed at how well the employees were treating us thinking that it was true customer service.
First contact person, was I believe his name was ***. We talked and he ensured us that we would receive a very good deal, paying what we were paying in monthly payments on our 2016 *** 1500 or lower and a lower interest rate and receive a customer discount an additional 1000 dollars. Selling price was over 42,000 plus the other charges that we would have to pay, ie. taxes, etc.
Next he introduced us to ***. *** got the payout that we owed on our previous truck, we still owed just over 40,000 dollars on it. We had known the payout ourselves prior to this. We were paying a higher interest for the 2016 due to a consumer proposal I had filed in 2010.
*** questioned us on this, "need you's to be honest here and tell me why the high interest rate". Were completely honest and the reason why the consumer proposal had been done.
*** went out to our truck, took pictures and the directed us to ***, the sales manager. Prior to that no mention was made of the trade in allowance.
*** took our financial details and said he would said it to the banks to see if we would get approval. No mention of the trade in allowance by him.
Next day, I received a call from ***, he said it was difficult but they did manage to get financing for us. Could we come in over next few days and sign the papers.
We did, unfortunately neither *** or myself had our reading glasses and can really see nil without them. *** had told us what the payments were but no mention that they were going to be over 96 months nor what we were actually being offered for a trade in. He highlighted in pink and blue highlight where we were to initial and put our signature. Having been very excited that we had got financing in the first place, it did not even occur to us to ask many questions as we had believed that they were not going to give us a raw deal. After getting home that day, we discovered that they were only offering us 25,000. We had already paid 2 years on our previous truck and would of only had 5 years left. There is absolutely no way we would of agreed to their deal if it all would have been disclosed. I sent *** an email and then about an hour later I received a call from ***. It went back and forth and it was very clear to me that his demeanor on the phone was in complete opposite of the prior times we meant him. I became very frustrated with him on the phone, he asked what we were going to do, feeling that we had no other option because we had signed the purchase contract that we would be there on the 30th of June 2018 to pick up the 2018 *** 1500. At no point did he offer any other solution to this ie. the contract can be nulled. He did say that he would work on it from their side to see how they could make it right for us.
On pick-up, there were a few scratches that we pointed out to *** and he had said that *** would take care of them. Did not hear back from him about this, we got the scratches taken care of ourselves. *** told him about my conversation/dealings with *** and he reassured us that he would follow-up with it, *** went as far to say maybe a few oil changes, something that would ensure us of feeling like we are a valued customer like they did when we first went there. Nope, did not hear anything further about this.
In July I believe while looking at the contract, I had noted that *** had asked us to initial a box checked off. The box was to say that we declined life insurance/disability. At no time ever did we ever say that we did not want it, it was never discussed by ***.

We are sorry to hear that the *** are unhappy as this is quite a change from the excitement and thrill of when they took delivery. To accuse us of not fully disclosing everything is absolutely untrue. Our process is very customer focused unlike many other dealerships in Ontario. I am proud of the customer service and transparency that we provide. This is why we have customers sign and initial in many places throughout the contracts to make sure all is understood. Sometimes customers do not give contracts the respect they deserve.
The trade value of $25,000 was fair market value and the were aware of that value before delivery and had the option to not move forward with the deal. They choose to complete the deal and take delivery. Life Insurance should still be able to be added after the fact and we can call on the customer's behalf to try to facilitate this but it would raise their monthly payment.
It is unfortunate that the customers are unhappy and if they want to get into a cheaper vehicle and lower their monthly payments we could try to work with them on that. ***, *** and *** are more than willing to assist and provide exceptional customer service with the highest integrity.

Unfortunately it is both ***'s and my belief that we did not receive transparency with this deal. They can argue that 25,000 dollars for the trade-in value for our previous truck was fair market value but even before we signed the papers without having full disclossure of the deal that they were offering, we would of never agreed to it. When I discovered that there was no Life Insurance on this vehicle I called *** loans and they had said that nothing could be done about it because it is the dealerships fault. Again, ? do they really think that we are not smart enough to know that having life insurance on a loan payment does not increase the payments. ? do they have proof that what we are saying is untrue that they fully disclosed everything. ? are other dealerships aware that they are saying that their process is very customer focused unlike many other dealerships, ? again not a very nice thing to say in my opinion and what proof to they have of this. They focus on us being unhappy, it has nothing to do with the truck we received, the unhappiness is because of despite being treated as such wonderful people that they had when we first inquired about the truck, the tables turned once we signed the papers. The excitement and thrill we displayed was that we had received financing as we had not expected to due to our previous credit history. I do have emails that I have shared with ***, ***, Mr *** himself and most recent the ***. ???? where has it ever come across by us that we may want or even would consider wanting to get a cheaper vehicle as stated in their response. The payments are not far off from what we we making on our previous truck and it included life insurance and 5 years left to pay. This one, 96 months minus what we have been paying since we received it June 30th. To say we are disappointed in their response, we are not surprised and definitely after our very first dealings when they treated us so well, we would definitely not recommend Sphelmers to anyone looking to purchase a vehicle. We took delivery because *** seemed to not give any other option when we discovered the trade in value, having signed the papers it was our belief that we would not be able to do anything. *** definitely email *** re: the possibility of seeing about adding on life insurance BUT in the previous response from them it was their claim that the accusation that we had said that everything was not fully disclosed was absolutely untrue and had asked that they show proof of this which to us would make it seem that we were possibly making this up in the attempt of gaining something. The day we signed the agreement, I had sent *** an email about the trade in that they were offering and the possibility of not going through with it. About 2 hours later *** called, we discussed many things about the deal and he never gave an option, ie because we signed the papers, are we legally bound because of this. There was no discussion with *** when we signed the papers re the life insurance, told us payment each month, did not mention for how many months, no mention of life/disability insurance and no mention by ***, *** or *** of the trade in being offered.
Having felt we had no choice, that was the reason why we went through with it.
They stated they are very customer focused, "unlike many other dealerships in Ontario". Through the years we have had many different vehicles, traded in previous vehicles and have NEVER felt that any of the dealerships were not completely transparent in our dealings until we dealt with Spelmers. Treated very well but completely changed after the pink/blue lines were signed/initialed. Previous emails I had sent to ***, ***, Mr *** himself and the last one were completely unaddressed expect for *** email about us focusing on the negativity.
? the comment made re sometimes customers do not give the contracts the respect they deserve makes us feel that they are making a comment to our lack of intelligence. I can assure them that we are not stupid by no means, have faith that people would not mislead on and place a lot of trust in people but Thanks to them, this *** NEVER, EVER happen again.
Lastly, their offer to get us into a cheaper vehicle was never something for us to even want to consider. ? What would there be to be gained by us doing this. Being unhappy is not because of the truck we have now, it was the way things went after signing the loan agreement. We owed just over 40,000 dollars on our 2016 *** 1500, we received an unknown amount of 25,000 dollars when we signed the agreement, the truck we purchased was 42,000 plus dollars, how would getting a cheaper vehicle be of a smart decision for us to want to do. Thanks, but No Thanks for this offer. Very unfortunate that this deal was made, as I had stated in my email to ***, *** and I having worked with the public for many years are well aware that despite ones best attempt, it is not easy keeping everyone happy but respect must always be shown.
Despite our concern that they not suffer a financial loss with our trade-in, we also have to make the right choice in going through with something and the only way we can to this is to have complete trust in those we are dealing and with and feel that they are being completely transparent with us.It is our belief that their goal was to make a deal and once the deal was made, you are no longer, or less of an importance to us.
