In answering complaint from [redacted] :In 2014, the concrete was installed by Spencer Custom Concrete.In answering complaints:The deck was not installed incorrectlyIt was configured by homeowner [redacted] andDarren, the owner of Spencer Custom Concrete, agreed upon and installedThe correction ofany issue did not cause a sealant issueThere is no such thingThe homeowner was told byDarren, that sealing concrete is crucial to maintaining the life and beauty of concrete and thatALL concrete cracksThe sealant is a way to protect the surface and it cures in timeShading andsunshine will cause it to be multi colored, which is what it is supposed to doAll samples areshaded, different tones in stamped colored concreteAll customers sign a joint waiver contractat the time of signing the contract for work which [redacted] signedAs far as the sealant bubbling, the issue isn't Spencer Custom Concrete, the installer it is theproduct itself, which again there is an easy fix for thisAll concrete contractors deal with thisissue, as far as the sealant which is why there is a product to correct thisIt is called Xylene,which is a product that melts the little bubbles and flattens them, and the surface is smooth.But, concrete must be properly maintainedDarren Spencer went to [redacted] 's house with the Xylene, but the customer had not keptup on maintenance of concrete, so it needed to be power washed and sealed again, before theXylene product could be appliedMrSpencer, had a face to face conversation with [redacted] , and explained, that once again, he will do the maintenance which included powerwashing and sealing and labor, a very timely processHe stated he would only charge her$500.00, not what he should have charged her which is $per sqFt about $ [redacted] said " it needs to be done", nodded her head and said, "o.k., go ahead and do thework " [redacted] was told and well aware of the charge of $500.00, and verbally agreed topay to have the work done and completedMrSpencer again, giving the customer a financialbreak, paid for the Xylene, out of his own pocket to get rid of the bubbles on surface ofconcrete, correcting the issue at no charge to her of courseSo [redacted] wasn't chargedfor Spencer Concrete to come back for yearly maintenance, wasn't charged for correctingbubbles in sealant of course, that isn't any parties fault, just the product itselfOnly charged forpower washing and Resealing concreteWhich again, she nodded and agreed uponAll customers are charged for Power washing and Resealing each yearALL! Spencer CustomConcrete charges a standard fee of $persq ftBut [redacted] was notPhone Calls: The phone calls were back and forth between [redacted] and Darren Spencerand the office and Staff at officeWhen [redacted] missed Darren's call she returned it andDarren Spencer did the sameIt was a phone tag for a whileThere was no harassmentinvolved, on our partIf you call and leave a message, it is returned, and if you call again, it isreturnedThis isn't harassment in any way [redacted] called many times to the office, andwhen the calls were returned it went to voicemail many timesSo naturally we are customerservice, we will try back again to reach customersThis again isn't harassment this is beingconscience of customers and their issues or concernsAs far as the phone call to [redacted] and [redacted] in regards to reporting them to thecollection agencyThis is our right as a companyThe customer agreed to pay for service, thework was done, completed and now we expect to be paidIf they don't we will take the correctavenues to get paidThis is all company's policiesNot only Spencer, but all, just like the creditcard companies, if you don't pay, they will send you to collectionThis is no way a threat, but itis enough nowThe customer wants all the services, but doesn't want to pay for themWe at Spencer Custom Concrete have a greater that 95% satisfaction rate, and happycustomersWe stand behind our products, our services, our integrityLastly, If [redacted] states that she shouldn't owe any money for any services because theywere done wrong originally, as she stated in her" Statement of problem", then why does shestate in her desired settlement she should only have to pay $200.00? If Spencer CustomConcrete did such a horrible job, right from the start then why would she want him to returntime after time again, and continue to call and ask him to come back if she has been sounsatisfied with our services? [redacted] certainly could have hired another concretecompany to handle these simple quick fixes and never had any contact at all with us.Desired Settlement:Pay $the agreed upon amount.Wedo hold the right to report to any credit agency, andwill if it is not paid within days of this letter, 11/9/

MrSpencer is both a great salesman and a poor businessman, I will begin by apologizing for the lengthy response. However I would like to take the opportunity to address MrSpencer's comments. MrSpencer is correct the deck is exactly the shape and size that we agreed upon and it was poured in August 2014. What he fails to mention is that we ordered a stamped concrete deck and it was very poorly done. We addressed our concern regarding the color and stamp pattern prior to the original sealant being applied on the deck. We were advised not to worry about it as all the issues would be blended in once the sealant was on. When the concrete was sealed, we were at work. When I came home, the irregularities that we had addressed were worse not better. I attempted to contact MrSpencer several times. When he did not answer my calls, I had no choice other than to place a stop payment on our check in the amount of $9,941.50. Not surprisingly, MrSpencer calledNot about my concerns but about the money. He needed it to continue to do his other jobs. He assured me that customer service was his primary goal and he would fix any issue we had. I believed that MrSpencer was being honest and agreed to meet him at the bank where I gave him cash(A strange thing for someone who doesn't want to pay for their service to do). Before I gave him his money, I asked him to sign an agreement that once I paid him in full he would rectify any dissatisfaction we had until we were satisfied with the work. (signed agreement is attached).MrSpencer did come out a fix the color and irregularity issue and the re-sealed the deck without stripping the original sealant off (which when we questioned it, we were assured it wouldn't be a problem). Again, this was done while I was at work. When I came home, there were raised bubbles all over the entire surface of the deck. This was not a small contained area but the entire surface of the deck. If there was an issue with a product the concrete company was using and they knew about it as MrSpencer asserts, he should have switched to another product. Knowing the issue prior to using the product does not absolve you of the responsibility if it causes problems when applied to your customers concrete. In fact the opposite is true. If you know there is a potential defect and use the product anyway, it is your responsibility. I called MrSpencer immediately and left a message when my call was not answered, I took photos and texted them to MrSpencer again with no response. I had to go to the company where we purchased our pool and ask for assistance. After that, MrSpencer did contact us and made several appointments to come out and address the issue where he was either a no show or called to cancel at the last minute because he was so backed up due to the rainy season (2014) we had. Finally in November of 2014, I called MrSpencer to advise that we could no longer keep our filter running and needed to close our pool. (we could not have the cover on the pool when the service was provided). I asked if there was a problem with waiting until the spring to address the issue. MrSpencer said no it would not make a difference.In May I received a call from Nancy at Spencer Custom Concrete. She wanted to know if we were interested in having our deck re-sealed. I advised her that MrSpencer needed to come out and correct the open issue from last year and that I was not paying for it. I advised that my pool would be open on April 15,and I was having a party on May24, and the work needed to be done by May 15,2015. MrSpencer finally came out to look at the issue for the first time in October, over year later. While out there, he noticed that the color was peeling off the deck and he said it was his fault because he applied the sealant to thick because he was trying toand he stopped(could it also be that he did not strip the original sealant prior to fixing the color and resealing as we questioned)? The deck was not maintained improperly, it was treated improperly. Spencer Concrete did not pressure wash the deck, my husband did. In fact, MrSpencer told me to tell my husband not to shy away from the peeling color in fact he wanted him to" hit it hard" so all the loose and peeling stuff came off. While at my home MrSpencer asked if I wanted the deck re-sealed. I said if the sealant was going to be disturbed by the process they were using the yes I wanted it sealed and to go ahead and do it. At no time face to face or otherwise did MrSpencer bring up cost in any manner. I thought this was all part of the agreed upon corrective services. There was no application of a sealant prior to the xylene. This statement makes no sense. MrSpencer did apply the xylene treatment early on a Saturday morning and told me that he had to go out to another customer in Attica but would come back later that day to apply the sealant. MrSpencer called my husband after dark to let him know he would not be coming out that day.An employee of Spencer Concrete did come out and apply the sealant to the deck. I happened to be home that day because I had to go to the veterinarian with my daughter to put her pet down. His employee met us in the driveway as we were leaving and said I assume that you and Darren discussed the price? (why would he say I assume you discussed the price? Why wouldn't he give me an invoice if I agreed to the price)? I responded by saying I thought this was all part of the original repair and he said he would relay that to Darren. We both left. Due to the nature of the situation and out of respect and sympathy for my daughter, I turned the ringer off on my phone. It wasn't until later that I realized that MrSpencer tried to call me several times. Apparently when I did not answer, he called my husband at work. When my husband answered his phone, MrSpencer immediately accused him of not paying his bill and went on to say if we were going to "stiff" him, he would report us to the credit agency. My husband had know idea where this was coming from and told MrSpencer he would have to talk to his wife. Interestingly MrSpencer then said to my husband," the deck didn't even need to be re-sealed but your wife told me to go ahead and do it anyway". That was the first I heard that the deck didn't need to be resealed. MrSpencer never said that to me. Why would I agree to pay $for something that didn't need to be done? The next morning, MrSpencer called my phone times prior to my arriving at work and also called my husband several times. By definition, that is harassment. I was in no way addressing the calls back and forth to do business. To answer MrSpencer's questions of why if I was unhappy with his service would I continue to call for him to return, this is quite simple. I paid a great deal of money ($10,191.00) for a service that was not provided properly. MrSpencer agreed to come out to rectify the situation and now wants to recoup the money he spent fixing his errors. Why did he call my husband they way he did? He had no idea what was going on yet because I didn't answer my phone immediately, he called and threatened my husband with ruining our credit by reporting us to the credit agency for not paying. (don't we have at least days of non payment before that is even an option? He did not attempt to have a conversation. Why didn't he call and ask what was going on and let my husband know there was some confusion that we needed to discuss? He IMMEDIATELY threatened our good name and credit as a way to get money. That in no uncertain terms amounts to EXTORTION.To address MrSpencer's question on why I did not call on another contractor? I did actually have another company to come out and look at the situation back in the beginning when the stamping and color was an issue. I then questioned why I would pay for a service that was already paid for and should be rectified by the original company. I was not calling MrSpencer to provide a new service, I was calling him to complete/correct the original service. Addressing his final issue on why if I felt I owed nothing would I offer to make a settlement of any kind. It is because after dealing with this company for over a year, I was making a good faith effort to come to some sort of compromise to end this situation and any further contact between the parties. This is no way was an admission that I owe this man anything and I still assert that I do not owe MrSpencer money to come out and fix the job he originally did incorrectly. The fact that over a year had gone by before I could get him out to my property does not negate his responsibility to the original job.

(A strange thing for someone who doesn't want to pay for their service to do).  Before I gave him his money, I asked him to sign an agreement that once I paid him in full he would rectify any dissatisfaction we had until we were satisfied with the work.  (signed agreement is attached).Mr. Spencer did come out a fix the color and irregularity issue and the re-sealed the deck without stripping the original sealant off (which when we questioned it, we were assured it wouldn't be a problem).  Again, this was done while I was at work.  When I came home, there were raised bubbles all over the entire surface of the deck.  This was not a small contained area but the entire surface of the deck.  If there was  an issue with a product the concrete company was using and they knew about it as Mr. Spencer asserts, he should have switched to another product.  Knowing the issue prior to using the product does not absolve you of the responsibility if it causes problems when applied to your customers concrete.   In fact the opposite is true.  If you know there is a potential defect and use the product anyway, it is your responsibility.  I called Mr. Spencer immediately and left a message when my call was not answered, I took photos and texted them to Mr. Spencer again with no response.  I had to go to the company where we purchased our pool and ask for assistance.  After that, Mr. Spencer did contact us and made several appointments to come out and address the issue where he was either a no show or called to cancel at the last minute because he was so backed up due to the rainy season (2014) we had.  Finally in November of 2014, I called Mr. Spencer to advise that we could no longer keep our filter running and needed to close our pool.  (we could not have the cover on the pool when the service was provided).  I asked if there was a problem with waiting until the spring to address the issue.  Mr. Spencer said no it would not make a difference.In May I received a call from Nancy at Spencer Custom Concrete.  She wanted to know if we were interested in having our deck re-sealed.  I advised her that Mr. Spencer needed to come out and correct the open issue from last year and that I was not paying for it.  I advised that my pool would be open on April 15,2015 and I was having a party on May24, 2015 and the work needed to be done by May 15,2015.  Mr. Spencer finally came out to look at the issue for the first time in October, 2015 over 1 year later.  While out there, he noticed that the color was peeling off the deck and he said it was his fault because he applied the sealant to thick because he was trying to....... and he stopped. (could it also be that he did not strip the original sealant prior to fixing the color and resealing as we questioned)?  The deck was not maintained improperly, it was treated improperly.  Spencer Concrete did not pressure wash the deck, my husband did.  In fact, Mr. Spencer told me to tell my husband not to shy away from the peeling color in fact he wanted him to" hit it hard" so all the loose and peeling stuff came off.  While at my home Mr. Spencer asked if I wanted the deck re-sealed.  I said if the sealant was going to be disturbed by the process they were using the yes I wanted it sealed and to go ahead and do it.  At no time face to face or otherwise did Mr. Spencer bring up cost in any manner.  I thought this was all part of the agreed upon corrective services.  There was no application of a sealant prior to the xylene.  This statement makes no sense.  Mr. Spencer did apply the xylene treatment early on a Saturday morning  and told me that he had to go out to another customer in Attica but would come back later that day to apply the sealant.  Mr. Spencer called my husband after dark to let him know he would not be coming out that day.An employee of Spencer Concrete did come out and apply the sealant to the deck.  I happened to be home that day because I had to go to the veterinarian with my daughter to put her pet down.  His employee met us in the driveway as we were leaving and said I assume that you and Darren discussed the price?  (why would he say I assume you discussed the price?  Why wouldn't he give me an invoice if I agreed to the price)?  I responded by saying I thought this was all part of the original repair and he said he would relay that to Darren.  We both left.  Due to the nature of the situation and out of respect and sympathy for my daughter, I turned the ringer off on my phone.  It wasn't until later that I realized that Mr. Spencer tried to call me several times.  Apparently when I did not answer, he called my husband at work.  When my husband answered his phone, Mr. Spencer immediately accused him of not paying his bill and went on to say if we were going to "stiff" him, he would report us to the credit agency.  My husband had know idea where this was coming from and told Mr. Spencer he would have to talk to his wife.  Interestingly Mr. Spencer then said to my husband," the deck didn't even need to be re-sealed but your wife told me to go ahead and do it anyway".  That was the first I heard that the deck didn't need to be resealed. Mr. Spencer never said that to me.  Why would I agree to pay $500.00 for something that didn't need to be done?  The next morning, Mr. Spencer called my phone 9 times prior to my arriving at work and also called my husband several times.  By definition, that is harassment.  I was in no way addressing the calls back and forth to do business.  To answer Mr. Spencer's questions of why if I was unhappy with his service would I continue to call for him to return, this is quite simple.  I paid a great deal of money  ($10,191.00) for a service that was not provided properly.  Mr. Spencer agreed to come out to rectify the situation and now wants to recoup the money he spent fixing his errors.  Why did he call my husband they way he did?  He had no idea what was going on yet because I didn't answer my phone immediately, he called and threatened my husband with ruining our credit by reporting us to the credit agency for not paying. (don't we have at least 30 days of non payment before that is even an option?   He did not attempt to have a conversation.  Why didn't he call and ask what was going on and let my husband know there was some confusion that we needed to discuss?  He IMMEDIATELY threatened our good name and credit as a way to get money.  That in no uncertain terms amounts to EXTORTION.To address Mr. Spencer's question on why I did not call on another contractor?  I did actually have another company to come out and look at the situation back in the beginning when the stamping and color was an issue.  I then questioned why I would pay for a service that was already paid for and should be rectified by the original company.   I was not calling Mr. Spencer to provide a new service, I was calling him to complete/correct the original service. Addressing his final issue on why if I felt I owed nothing would I offer to make a settlement of any kind.  It is because after dealing with this company for over a year, I was making a good faith effort to come to some sort of compromise to end this situation and any further contact between the parties.  This is no way was an admission that I owe this man anything and I still assert that I do not owe Mr. Spencer money to come out and fix the job he originally did incorrectly.  The fact that over a year had gone by before I could get him out to my property does not negate his responsibility to the original job.
