Initial Business Response / [redacted] (1000, 5, 2017/03/07) */ I understand the complainants frustration regarding their title They received their title the day this complaint came to my attention on Revdex.com I was just as frustrated during this process as they were and unfortunately it was a clerical error not made by my office that was the issue for the delay I complained on the customers behalf to where I purchased their vehicle from pleading to them to get their job done correctly because I knew it was making my customer upset and reflecting badly on my business Once enough phone calls and visits had been made, the issue was resolved and the title was delivered to my customer I apologize for the inconvenience this has caused customer I never said that I would keep the car and their money There was an extreme language barrier between the customer and I during our conversations Initial Consumer Rebuttal / [redacted] (2000, 8, 2017/03/08) */ There was no language barrier my wife speaks perfect English and he did said " He can bring the car back but he is NOT getting the money back", my wife then said " that's stealing and he hang up! I did finally received the title on the same day I put the complaint, also there was no signs of them showing they were trying to do everything in their hands to help, it felt more like we were bothering them too much, I think we were very patient since it took over a month for to receive the title, that they keep saying they already sent in the mailBut I hope they do a better job with future customers, I don't want anybody else to go through this frustrationI now have the title and that's all we wanted, I would like to thank you Revdex.com for taking this matter into your hands and investigating the issueI'm glad this is now just a bad memory

noted that Mrs*** defrauded a business owner and has made no attempt to make arrangements to pay her remaining balance after she stopped payment on that contractual obligation to payFormal charges will be pursued against Mrs*** as I have done nothing wrong as the business ownerEvery requirement of me by the Missouri State Department of Revenue Dealer Licensing Section was completed on this vehicle and I as a business owner went above and beyond repairing additional items on this vehicle at Mrs***' request prior to the sale

This letter is in follow up from our phone call on 09/18/where you proceeded to disconnect the callAs I explained to you earlier, you and your son both drove the car on three (3) separate occasions including a trip to the local *** store in Branson West to obtain cash for the down paymentAt the time you placed the down payment, you also asked for the A/C to be recharged, the car to be re-inspected, and to fix the back passenger door so it would open from the insideThose three items you requested were completed to your satisfaction and you signed off on the "We Owe Form" (a copy of this form is included with this letter)In addition, you also read and signed the "Dealer Warranty Disclaimer" form stating there was no express or implied warranties of any kind on the vehicle you were purchasing (also a copy has been included with this letter for your review)
Your vehicle did fail the initial inspection for a contaminated accessory belt on 08/14/(as noted on your original copy of the inspection slipI corrected the issue and returned on 08/28/to the same location for a re-inspection and the vehicle passed at that point
It should also be noted that even though I was not required by law to help you with any mechanical issues related to your vehicle after the sale, I answered your multiple calls regarding the battery on your vehicle and suggested you should take it to *** and have the vehicles starting and charging system checkedYou thanked me for the advice and took my suggestion and found the battery was testing badYou told me *** was going to replace the battery free of charge under warranty and install it for you as well
Per our contractual agreement on the payment for this vehicle, I accepted $cash at time of delivery and against my better judgment took your word and accepted a post-dated check for the remaining $balanceThe check was payable to Emerson Auto Sales with a date of 09/14/I learned from my bank of 09/17/that a stop payment had been placed on the check and therefore the full purchase price of your vehicle remains unpaidThis is in violation of our purchase agreement as well as being unlawfulYou have purposefully deceived a business owner in order to gain control of property that has not been paid for and you will be held accountableAs soon as I receive my legal copy of the your check from my financial institution, I will be filing a report with the Stone County Prosecutor's Office bad check divisionThey will then contact you in order to receive the funds that are payable to my businessIf you choose not to fulfill your contractual obligations, I will pursue formal charges and ask that a warrant be issued for your arrest and you will be required to make an appearance before the judge regarding your bad check
As far as your intent to post comments on my business *** pageIf any comments are found to be inaccurate, inappropriate, or unlawful my attorney is prepared to file a civil lawsuit against you personally for slander/libel and defamation of characterDamages awarded to me can be extensive

Just because we drove the ca certainly does not make the car safeYou told us you have a mechanic the checks the cars outIt is very obvious that was not doneYou also told me you were a mechanic as wellYou know that brake pads don't wear out in or daysThe back brake pads were worse than metal on metalVery unsafeWe also replaced the air filter which was very dirty(Something very easy to check)We were hoping that would keep the car from dying in the middle of the roadWe have also run Sea Foam thru the tankUnfortunley that was not the problemIt is probably the fuel filter which also doesn't go bad in or daysPlain and simple you did not have the car checked out and it is very unsafeMy son has come very close to having accidents on several occasions because the car dies in the middle of the streetYou sold us a car with numerous problems that makes the car unsafeIn your letter you have failed to mention any of these safety issuesWe never asked yo to charge the AC, you told us you would fix the AC which is not fixedAgain this is not a new problemThese problems have nothing to do with an inspectionThey all have to do with you (being a mechanic) and your mechanic not checking the car out for safety issues and told us is was checked
I called you the very next day after I bought the car and at the time you suggested I take the car to ***The truth should be noted regarding the numerous phone calls I made to yo the day I went to *** and yo had no intention of answering my calls until I left a message that I was at *** and I just needed to ask you a question regarding the batteryThen and only then did you call me back
I would never post comments on *** that are not trueEverything I have said about the car is trueI don't believe you can sue for slander or defamation of charter when you are telling the truth
The fuel filter is the next step in trying to get the car running which is very expensiveBy the way the gas gauge does not work either
I have received a response from the Revdex.com and MoDepartment of RevenueI will send them a copy of your letter and my new letter to assist them in their investigationI have not yet heard form the MoHwy Patrol
