Per the notification of a complaint received by our office On February 22, 2015, please allow this letter to serve as an answer to the above mentioned complaint. On February 4, Mr*** came in to our facility with a complaint that he could not pass the E-check amongst other things
because his Check engine light indicator was missing or not on in his-vehicle and requested that we fix his vehicle (Toyota Corolla Vin # ***)After completing a free computer diagnostics, we advised Mr*** that we would replace the light bulb and that there was an additional code that showed upIt was Engine code PAir/Fuel Mixture System Lean Bank After completing a free and a thorough visual inspection (checking all vacuum hoses, possible intake problems and leaks) we recommended to complete regular maintenance (replacing the plugs and air filter) along with a Osensor (an electronic part) We also advised him that according to *** ** *** (a computer system for Mechanics guide that is used by virtually All auto repair facilities and auto dealerships) there are several possibilities as to the cause and there are step by step repairs that must be completed in orderWe had advised Mr*** of this and also told him that we will start with the least expensive and most common known cause and address it first, however if that did not work we would have to go ahead to the next recommended electronic part and go on like this through all steps until the problem was resolvedPlease be advised that according to the Industry practices Electronic parts CANNOT be refunded after InstallationPer the authorization from the customer and Multiple explanations that we cannot guarantee that this particular replacement will solve the problem, we replaced the Censor, Plugs, Air Filter and the Check Engine Bulb on the vehicle and advised the customer to drive for a couple of days to see if the Check engine light would come back on and if it did than he had to come back and we would start on the next stepMr. *** agreed to the repairs and cost and this was performed as agreedUnfortunately, this repair did not solve the issue because Mr*** returned to our office a few days later and advised that he did not pass the e-check and that the Light came back onIn order to accommodate the customer we attempted the next step in the process and ordered a Mass Air Flow Sensor (at our expense), replaced it and took the vehicle to an E-Check station for him and passed the E-checkAfter we explained to him that there was additional cost for the replacement of this part and that according to the industry practices Electronic parts CANNOT be returned after installationhe started arguing with us that we were cheating him out of money and that we were overcharging him and were attempting to take advantage of him, we replaced the part back, put his old Mass Air Flow Sensor on and advised him that the Check engine light would come back on because it was the Mass air flow sensor that was not workingAt this point Mr*** demanded that we take out the Light bulb so the check engine light would not be operationalWe refused this request as this action is illegal and if we complied with this request there could be legal implications for our business like a fine, closure of our facilities or imprisonment as described in ORC statuesHe continued to demand that we perform the action and we advised him that we were unable to assist him any further and asked him to leave the facility. Please understand that we have attempted to accommodate this customer as much as possible and tried (Unsuccessfully) to explain to him that problems with his vehicle were not easily solved and that it was not our prerogative but the recommended steps and parts replacement by the vehicle manufactures and repairs guide systemsWe also on numerous occasions have attempted to explain to him that for his benefit we started with the least expensive items to replace and that if this step did not work we would need to go to the next step and that would be additional cost to himAlso, please advise the customer that we are unable to replace parts for him at our expense as this is not practical for us as a business and we are definitely NOT going to perform illegal acts like removing light bulbs from the check engine indicator just because the customer requested itPlease remind the customer that all repairs that were completed were completed per his authorization and explanation by us that the repairs might not solve the issue. For your convenience l am enclosing a copy of the receipt of services performed, along with a detailed printout from Engine codes (Google search code PToyota Corolla 2001) and a printout of recommended steps form *** ** ***.Your understanding and prompt attention in this matter is greatly appreciatedShould you have any questions or require additional information in regards to this matter, please feel free to contact me at your convenience.Sincerely,*** ***Owner

Revdex.com: [redacted] wrote that Electric Parts CANNOT be returned after installation, [redacted] took off the non working sensor, put in the new one, passed in the E-Check, then put the old sensor back in, than returned the car to me. Is that legal? I'll start from the beginning of why I am unhappy. 2 years ago, February 2013 I did not pass the E-Check (Same exact problem as my problem now) I went for help to Spirit to fix my problem. [redacted] said he fixed everything and that I can pass the test. I payed him $300 cash. I still didn't pass the test and took my car back to Spirit. [redacted] still didn't find the problem. He wrote a bill for $700, went to the E-Check and got an Inspection Report without showing them my car. That was the first illegal action. The Check Engine light did not work, I was not aware that my problem was unresolved, and kept using my car for the next 2 years without an unresolved problem. February of 2015 I went to take the E-Check and did not pass again because the problem was not solved from 2 years before. I went back to Spirit and asked them to fix it again. Google search code P0171 Toyota Corolla 2001 said that I need to check up on a few parts and find the part(s) that needed to be fixed. He changed the O2 Sensor Bank 1 Sensor 1, Labor, Plugs, Air Filter, and the Check Engine Light Bulb. All of these parts were unnecessary for him to fix. I payed him $300 and he said that I can pass the test. But I did not end up passing the test, and still had the same problem as before. I returned him my car and told him that he had to fix my Air/ Fuel Mixture Sensor. I told him I would not pay for the next work that was needed for the sensor. He took off the non working sensor, put in a working one, went to go pass the test, and put the old sensor back in, and only then, he returned my car with an unfixed problem. That was the 2nd illegal action. [redacted] said that with the code P0171, they have to change all 9 pieces and I would have to pay for all of them, which is not correct. With this code they should CHECK the 9 parts and only fix the part that is not working. They should only charge me for that one piece that I needed to be fixed, not all of the other parts that did not need to be fixed. This is a lie. If this goes to Court I will tell a few more lies. I think that [redacted] should get his license on fixing cars taken away. The company should be fined a few thousand dollars for the lies to his customers. They should return my money because my problem was not fixed. [redacted] (Owner) should figure out how to make sure that all work is professionally and FAIRLY done.  [redacted] lied to me twice, took $300 from me each time and never did what he was supposed to do, what I paid him to do, so I will have to fix my car somewhere else.
I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this does not resolve my complaint.  For your reference, details of the offer I reviewed appear below.
