performed wellIt is also common practice to perform routine maintenance on these types of roofs since they are considered flatThe penetrations and flashings must be watched in our area of the country since we experience heat into the 100s and cold down to Expansion and contraction can cause even the slightest openings in any of these penetrationsMs*** did not give us the opportunity to correct anything that may have been wrong with her roofShe simply took it upon herself to hire someone else to install a protective coating known as KM coating onto the existing roofHer roof was still under our warranty and we would have addressed anything that was wrong with itHowever, this roof is no longer covered by our warranty since they have received work from a third parI would like to stress again that there have been no roof leaks at these properties. To whom it may concern:Our response to Spirit View Homes are listed below:Response:1. If they had read the complaint filed with the Construction Industry Division (CID) It is not "a Faucet" that emits hot water when the cold valve is initiatedIt is the entire home, and it hot enough to burn your hand, every faucet in the house! even the faucets outside. My two year old granddaughter scalded her hand while brushing her teeth. I was told the original plumber was "MIA" per email sent by the secretary, and they were going after his insurance. But the plumber they sent only did a minimal amount of work. He removed a valve from under the Jacuzzi and placed a valve above the water heater, which now left my pluming with code violationsHe checked every faucet even the outside faucets and there was no cold water. I asked what else they could do and he said he could do nothing without the permission of the builder. I was never asked for permission to do anythingI finally filed my own case with CID and with numerous calls they were able to get hold of the original plumberBut that was with my a lot of hard work and time from my part. I also called the City Inspector, who verified the problem. We have a recircline that was not insulated which makes my water heater run continuously, I have no cold water to wash colored clothes....my energy efficient home is not energy efficient! 2. There is several correspondence between the company and me because it takes several attempts to get anything doneThe secretary usually cannot get hold of the subcontractors and tells you to call them yourself. If it only took one phone call we would not be here!I am a nurse and work to 3. I have asked off from work several times according to their schedule just ask my employer, believe me....they keep track. What actually happens is no one shows up for the appt or calls to cx. It is very difficult has a nurse to get coverage when you work in specialty areaIt is very frustrating when you are waiting and no one comes. I was actually told by one contractor that he got hungry and went to eat instead. I was also told that they forgot they had practice and that's why they did not come! Phone call would have been appreciated. I have waited on Saturdays for the landscaper who never showed up and the plumber who never showed up. How many days of work does one have to miss. As stated the warranty process by Spirit View Homes is a very unorganized one and it takes weeks to get an issue resolvedI still have issues that still have no response.I finally got someone to come fix the landscape issue before the ponds flooding could become a serious issue. They would flood just with watering the grassThe timer was down to minper the original landscaper and my new plants and grass were dying. As I have stated I care for my year old granddaughter and I could not even relax when she was outside because of fear she would fall inAll I ask is to come home after a hard days work and not worry about the children playing outside or not having cold water!Spirit View Homes takes a warranty complaint has slander, and takes it very personal even though I have followed every process they have requestedI have not spoken with the builder since the day we closed on the house! To this day he has not spoken with usMy sister and I told Oscar about the problems with the subsHe stated he could not help it if they didn't care, even though he did. But that did not fix the problems! The only way to fix the plumbing issue is to tear up the foundation! After waiting months to move my home I am distressed to find I will have to dig up the foundation to repair the plumbing No one immediately came to my home when I reported the flooding, in fact the emails I have from the secretary states she also had not heard back from the builder, and this was on August 6th 2015. I do not appreciate the fact that they did not call me or my neighbor to get permission to enter our homes or yardsThe only way he could have even looked at the wall in question was over the fence and snapped a picture. I don't call that customer serviceIts almost has if they have no consideration or time to spend with their clientHe refers to several documents, I am aware of those. He did not backfill the side of the zero lot line correctly, I had not even a small grade away from my home nor did he attach the barrier correctly. I have spoken with the engineer for Planton Barrier and there should absolutly be no gaps in the top membraneWater and dirt can enter, and the barrier works in conjunction with a properly working drainIts all in the specifications, it even has suggestions for "clay" foundationsPer the repthey have products you can use to help with our kind of soil.I had to have a meeting with Spirit View Homes and take witnesses with me and beg for a drain, especially since the neighbors across the street warned of flooding in our subdivisionMy wall has a drain, which was never inspectedAnd the barrier he tore down and replaced because of issues with tears and holes was never reinspected We understand that the neighbor has to finish his landscape, but we at least expected the same amount of dirt that was removed to be replaced and there was a significant decrease. At least make it even to the way it was before. 4. MrP*** has taken the warranty issues on a personal level and regards them as personal attacks. His concern in the final response his is "financial responsibility" and does not want to be held responsible for any further remedyMy warranty does not expire till next year, its in the contract. *** ***

I am rejecting this response because:Re: Response Revdex.com Complaint ID ***Dear Oscar,Yes, I have repeated my initial complaint; the delays and procrastination of completing ANY work, from finishing a house by the agreed date to finishing any other work that was left undone or not done well, the lack of concern for customer satisfaction and resolving any issue even those that obviously need some kind of corrective action; i.e., the non-working dishwasher, and the arguing with every little issue that comes up and denying any responsibility to fix it. As I have stated earlier, either these methods of operating your business are due to just being totally unorganized or perhaps it is deceptive and intentional on your part Continuing to use a sub-contractor that numerous homeowners and buyers have complained about is a prime example of this behavior.Oscar, I was a huge fan of yours You are young and personable and have a lot of life left to create a really good business if you want it Any slander or negative image of you and Spirit View was long established before I came into the picture My hope was you would stand up and take responsibility for the two roofs that were just so terrible but it seems you just aren’t willing to even give some token settlement Had you done this then I could stand up and say, you know Oscar is a really good guy, he makes it right when someone screws up.Now I understand why several clients have resorted to contacting attorneys.

owner claims that she has a plumbing problem in which a faucet emits hot water from when the cold valve is initiated This has been confirmed because we have inspected it several times and have taken it upon ourselves to try to remedy the problem many times The problem was brought to our attention shortly after the owner moved into her home We reached out to the plumbing contractor, *** Plumbing, but have receive no response from them We hired another plumber to trouble shoot the problem with as much permission as the owner would give us without causing damage to floors, walls, etc In the meantime we have also initiated an investigation with the Construction Industries Division (CID) regarding this matter and the above mentioned plumbing contractor It took CID department nearly two months just to contact us regarding the matter It has come to my attention that CID has found *** Plumbing in violation of the code and since made them remedy the plumbing issue We have been working with Ms*** to restore her house to the state it was before any secondary plumbers tried to troubleshoot the initial problemThe owner claims that we are unresponsive to her warranty requests This statement is simply untrue, we have countless correspondence between her and our company over the last months The fact of the matter is that she is usually only available after business hours and will not accommodate our vendors or subcontractors hours very easily Although the owner continues to slander my company’s name any chance she gets, we have made a strong effort to accommodate her requests and remedy any issues that arise during our warranty periodIn response to her claim that we have caused flooding to her house:aOnce we learned that Ms*** was having issues with water seeping into her house in the vicinity of the zero lot line we immediately went to the location to see if we could find evidence of it There had been a substantial amount of rainfall that day or the day before Based on my professional judgement, it can easily be determined that the adjacent property is not graded correctly The grading in place allows for standing water against Ms***’s house directly at the location in which water was coming inside the house I have included a picture taken the day we made the inspection In the picture you can see that water is standing against the house You can also cross reference the picture with the floorplan that will show that this area corresponds directly to the spot of water infiltration below As you may or may not know, the grading in question is one hundred percent on the property of the neighbor at *** *** *** The governing document for homeowners in this subdivision entitled “Declaration of Protective Covenants, Conditions, and Restrictions of the Pueblos at *** *** *** *** ***.” In article V section 22, the following can be found: bProtection of the Zero-Lot-Line Elevation Of particular importance in the PUD is the protection of the zero-lot-line elevation against damage from activities on the Lot adjoining the zero-lot-line elevation The Owner of the adjoining Lot shall not install irrigation lines closer than four feet to the zero-lot-line elevation, shall not install a sprinkler system that wets the zero-lot-line elevation, shall not install a ponding area within ten feet of the zero-lot-line elevation, shall not cause a nuisance by bouncing balls against the zero-lot-line elevation or engaging in similar activities, shall not attach anything to the zero-lot-line elevation, and shall be obligated to show in the landscaping plan for his Lot how the Lot shall be graded so that runoff is directed away from the zero-lot-line elevation.cThe last sentence makes it clear that the responsibility of proper drainage lies with the owner of *** *** *** dNevertheless, we constructed a zero lot line wall with proper moisture barrier using a product named Platon by *** Attached are the specifications associated with this product We have used this product several times in the same subdivision with no failure and no occurrence of water entering the homeIn each of those cases the neighboring grading has been sufficient to direct storm water runoff away from the zero lot line wall After all, it is the responsibility of each individual lot owner to have sufficient ponding along with the appropriate grading that will hold all accumulated storm water runoff for a year rain storm event eWe are not simply washing our hands of this problemWe wish to have Ms*** satisfied with her house Despite Ms***’s constant public attacks against our reputation as a company and especially her personal derogatory comments against me as an individual, I am still willing to help this situation However, I do not want to be held financially responsible for any further remedy I think it would be an easy fix to have access to the neighbor’s yard and help grade the property properly I make that comment not knowing all of the intricate drainage patterns of his individual property The bare minimum would be to provide positive drainage away from Ms***’s zero lot line wall This could be accomplished by a I am rejecting this response because:There are two houses, one finished about one and one half years ago, house no.*** and the other finished April 15, 2016, house no*** Both houses had no hail damage to the roof from the two hail storms we have hadThis was the report from the man who replaced some damaged sky lights at ***The other house was not under roof at the time of the first hail storm, Oct, The second hail storm occurred after the *** roof was inspected around the first of May, and all the problems with incorrect materials and poor workmanship, exposed osb, excessive soft spots all over the roof and no filler material at the right angle of the roof and the parapet walls was documented in pictures. Both houses had leaks around the pipes where there was the flashing had pulled away from the pipes or was non existant, to keep the water out.Oscar, your roofer who did these roofs came to my house, ***, and told me there were no issues with the roof, that the flashing was the correct flashing when two supply cos plus the roofer I hired assured me they were not the correct boots to put on a flat roof He also said he was not responsible for the exposed roof by the air conditioner I was not willing to argue with him and with you to get you to accept responsibility for redoing a defective roof, I felt like time was of the essence.I know almost every house you have built on this street has some serious roof issues, one has been waiting over two years for you to take care of it Another house that was finished just before mine needs a new roof as well Even her insurance coIs supporting that She has no hail damage just a poorly done roof.I have been waiting for other warranty issues, the dishwasher, the speakesy, fix the bath sink, painting, the irrigation at both houses had to be redone and we did that ourselves rather than waiting because all the plants would die againThis is now two months and counting There was an agreement you would pay for replacing some plants and that has not happened.Because of my severe asthma I do not have the luxury of waiting for you to get around to fixing the roof at your leisure I need to know the roof is secure and water tightAnother of your houses had leaks inside the walls and had to have mold remediation and a new roof, that house was one and one half years old I cannot risk that, therefore, I moved forward with a reputable roofer to replace the roof.Your Forman said you wanted to take care of all the people who had these roof issues, that you wanted to do the right thing, and I would appreciate a settlement toward the cost of replacing these two defective roofs

Re: Response to Revdex.com complaint ID [redacted] To Whom It May Concern:Once again I must stress the fact that Ms. [redacted] has taken it upon herself to complete items that were under warranty on her own accord. This completely voids any warranty and therefore eliminates the possibility for any compensation. If indeed her roof was poorly constructed it would be our right to complete any repair or warranty. Instead, she was convinced that the entire roof was poor and needed to be replaced essentially. Although there was never a leak from the original roof, she had the roof coated with an elastomeric coating designed to make existing roofs perform better. So if our roof was indeed defective she should have actually removed and reinstalled one accordingly. A good analogy would be to purchase a new car and have it painted then demand that the dealership pay for it. We will not contribute any funds toward this roof coating system that was performed.You say that you know almost every house on your street has some serious roof issues, but this is simply not true. We have built many houses in that subdivision and I can honestly say that only one had a roofing problem. The house that you are referring to was a roof product of a subcontractor that was doing bad work for us at the time. We owned up to it and repaired everything that was damaged, and we did it correctly. We proceeded to stop using that roofer and began taking control of our own roofing situation. Since then, we haven't had any problems close those previous problems that I am aware of.Now you are unhappy with your dishwasher because of its performance, yet you never gave our vendor the opportunity to service it. Instead you purchased a new one, of different model brand or model I'm sure, and demand that we issue you a credit for the old dishwasher. Things just don't work that way. There is a process involved when it comes to warranty or repair. I'm afraid that I gave you the notion that it is acceptable business practice to let the homeowner satisfy their own requests and then demand the builder to pay for them. I say this because I originally agreed to reimburse you for some plants that we had planted in your backyard that you replaced with the same plant only larger. Reluctant as I am, I will honor my word on that and send you the cost of said plants.Your irrigation systems were working fine when we completed those tasks and every time that we checked on them for you. We will complete the repair of the pop up drain in the sink. My plumber has been to your house 3 times but has yet to have anyone there to let him in. He showed up during the time allotted. I'm terribly sorry that you seem to be so disgruntled about your new home. It is a beautiful house. I know you feel the same way because until recently you were very positive toward it and with your overall experience with my company.
