vehicle definitely had been altered to conceal the squeak. That is the opinion of reputable mechanics,
and is the only logical conclusionThe vehicle did not make the noises on the
test drive. The noises became obvious
the next day, and became progressively worse.
The mold smell was also covered up
The
salesman clearly made misrepresentations and offered unsolicited misleading and
information about the vehicle
There
are obvious contradictions between statements in Spitzer's response and documentation
we were given (including the contract) and assertions on the Spitzer website:

following in the Spitzer 'response'
The agreement clearly
states that no reconditioning or service maintenance was performedThe
dealership would NOT spend the time or energy to "grease" a rear axle
to eliminate or conceal a squealThe cars are given a wash and a vacuum
of the interiorNot front line detailed
While I'm not sure of the definition of
'front line detailed', he is asserting that the 'as is' vehicles are only
washed & vacuumed - no inspection.
The website, salesman
statements, displayed placards and documentation
Clearly
make assurances to the consumer that the
'as is' vehicles are 'safety checked'
The
contract states This vehicle has been
inspected
Any
safety check and/or inspection would highlight the mold smell and the
transversal issue to a competent automotive technician. I'm sure Spitzer will assert that it employs
competent automotive technicians
The implied warranties of fitness for a particular purpose
and fitness of merchantability have not been explicitly waived and still apply
As to Spitzer's offer -
Spitzer
indicated that it would purchase the vehicle from us at 'current market value'
Current Market Value when we purchased the vehicle on January 31,
was $3,($3,cash + $trade in) I'm assuming that Spitzer will
assert that they sold the vehicle at an appropriate price. The vehicle had 174,miles The
vehicle had a rear transversal issue (hidden by grease) and a sunroof leak/mold
issue (covered up and not occurring during the colder weather) The
vehicle had bald front tires, and a weak battery The vehicle now has
177,893 miles (3,more), the same issues: rear transversal and
sunroof leak/mold The vehicle now has new front tires (purchased from
Sears), and a new battery (approximately $in improvements)
Current market value is comparable to what we paid for the vehicle
If Spitzer presents a fair and reasonable offer, we will consider selling
the vehicle to Spitzer

The disclaimer on the sales agreement stating the vehicle is being sold and purchased "As-Is" is the total understanding for the dealership and the customer
The vehicles on the "As-Is" lot are "inspected" for major defectsIf any exist, those vehicles are not offered for sale and are sent to auction
The agreement clearly states that there may be undetectable defects at time of purchaseFYI...This vehicle had 174,miles on the odometerRepairs are to be expected

The customer is made aware of, and understands, the conditions of the sale and signs the disclaimer printed on the buyers agreement
Our company policy is that we do not permit customers to take our vehicles for a demo ride without the presence of a Spitzer employeeThis is the program for obvious reasons
Mr*** has had the vehicle in his possession for monthsFrom what I have discovered, at no time did Mr*** contact the dealership concerning any of his stated concerns, although at time of purchase he purchased a powertrain warranty that may cover the repair of the rear differential
if Mr*** would like to sell the car back to the dealership (at current market value) or trade for a different vehicle, an offer will be made to himHe may accept or decline the offer

Good mrning ***,In response to Ms***'s complaint, I have discovered the following.Spitzer Mitsubishi did do brake and sway bar repairs to Ms***s vehicle, with a cost totaling $The front and rear brake pads and rotors were replaced with the correct parts purchased from
*** ***The slides on the calipers were lubricated which is a function when replacing brakesI have never heard of a brake caliper "being broken".I am curious as to why, if the vehicle had issues with the brakes, Ms*** did not return to the dealership for assistance when the brakes had been replaced as part of the agreementIf there was an additional issue with the brakes, the dealership would have performed any necessary repairs needed at no charge to Ms***As stated, although the vehicle was purchased "AS-IS", brake repair was part of the sales agreement.I will be forwarding you copies of the repair order from Spitzer Mitsubishi and copies of the bills from *** *** for the brake parts purchases'Did Ms***, by chance, have the parts that were removed from her car by *** returned to herShe is entitled to them if requested. *** ***DirectorSpitzer Management

Customer also complained to Ohio AG. I have requested receipts for the alleged work. The AG is attempting to get them but I have yet to hear from them.

Revdex.com: We accept Spitzer Mitsubishi's offer of $2,500 (two thousand five hundred) for our 2004 Buick Rendezvous. This is contingent on Spitzer agreeing to tow the vehicle from our residence to their location.  Spitzer will need to tow the vehicle away from our residence - it does not start, and cannot be driven.  Please ask Spitzer to make arrangements with us to pick up the vehicle, and deliver our check.

This vehicle was purchased from our "as-is" lot in Sheffield, Ohio. Mr. [redacted] was made aware of the "as-is" purchase at that time. I will be forwarding signed documents by Mr. [redacted] clearly...

showing that he was made aware that the vehicle is being purchased "as-is". Mr. [redacted] states in his complaint that problems "have now surfaced". The car was purchased in January.
If Mr. [redacted] would care to have his vehicle repaired, at his expense, at [redacted] in North Canton, I can arrange to have the work performed at a discounted price.

I do have the parts for the car in the trunk. I didn't return the car to this location because I couldn't leave it there overnight. I purchased this car for my niece, and it's the only form of transportation for herself and her son. When I called they wanted me to drop off the car for two days. I was more upset that the parts were incorrect.
