I hired Splending Building and Roofer (SBR) in October 2017 to install a new roof and tend to interior repairs related to a roof leak. I had numerous issues with the quality of the interior work of which is still not addressed. SBR refused to address the issues. I filed an insurance claim for the roof leak in 2017 and paid SBR in full for his roof work which has an 8 year warranty.

In July of 2018 we had a big storm and my roof (brand new as of 11.17) began to leak. I contacted SBR and he refused to acknowledge the problem. I filed another insurance claim and argued with SBR about repairing the roof. I filed a complaint with the City of Santa Fe when I found out that SBR did not pull a permit to do the roof in 2017. Upon being contacted by City officials, SBR became more willing to repair the roof. The city required him to remove the roof that he placed on top of two roofs and 6" of pumice. They also required SBR to install a slope system.

SBR refused to do this work unless I paid him for the work. I had no choice but to pay SBR for a second roof, SBR also made me pay for the building permit. Once SBR removed the two roofs and the pumice, SBR informed me that I had to install new decking of which I only would pay the material and SBR would pay for the labor. I went to *** and purchased the needed material for less than $500.00. I called SBR and informed them the material was paid for and ready for pick up. SBR demanded that I pay $6,000.00 that day or SBR would remove their crew from the job. Keep in mind that my roof was completely torn up. Through blackmail negotiations, I was forced to pay SBR an additional $2,500.00 on top of the $5,000 + that I had to pay for roof #2. This is on top of the $10+ that I paid for Roof #1 back in 2017.

It took SBR from July 2018 to November 2018 to finally get the second roof installed.

The first snow we received on December 5th, my roof started leaking in the original location it leaked in July of 2018. SBR was beligerent and refused to acknowledge the problem. Then it snowed again the second week in December and I had to file a third claim with my insurance company.

I was moved out of my bedroom and all my belonging had to be moved into the living room. SBR came over to see the problem and insisted that it was a canale that SBR forgot to seal when they did Roof #1 and Roof #2. We argued as to whether or not SBR was going to remove the snow off the roof everytime it snowed.

I went on vacation from January 3 - 10 2019. I came home the night of the 10th to find that the roof had leaked into two additional rooms in my home and had ruined my clothes, my bed, and my parquet floor. I called the insurance company and increased the scope of claim #3. I called SBR and to this day have heard nothing back from them.

My entire house was packed out and is in storage since 01.14.19 and I have been in motels and rentals since that time. My insurance company is telling me that I will have to pay for the roof removal and repair myself. The ongoing leak in the master bedroom has caused the support beam to warp and bow and I have an engineer coming in to see what more issues are related to the work SBR completed.

I have paid SBR for Roof #1 and faulty interior work approximately $10k. Roof #2 $7,500.00 plus permit fees, and now I have to absorb the cost of removal of entire roof and replacing with new roof. It appears I won't be back in my house for at least another 2 months due to repair time etc.

Splendid Builders and Roofing Response • Mar 19, 2019

To whom this may concern:
We are responding to a complaint filed by Ms. *** located at ***. In regards to work performed at her property performed by Splendid Builders & Roofing.
Initially we were contacted by Ms. (which is also our neighbor) concerning a roof leak over her den area of her home. Which Ms. filed a roof claim with her insurance company for a roof replacement which was accepted by them. At this time, Ms. no longer wanted a roof replacement rather insisted on saving part of her settlement to do interior work which had nothing to do with original roof leak (floor installation, recessed lighting, painting of several walls including a laundry room which is a distance from original roof leak) putting her roof second to this. Ms. requested that we do a roof repair only on the weekend because she didn’t want to pull permits. Roof repair at this point was so drastic that it became a necessity to cover entire roof anyhow. When several months had passed, she contacted Splendid Builders and complained that there was a streak across her ceiling that she was not satisfied with. Splendid Builders offered to pay her $1,500 to hire someone of her choice to repaint that ceiling so that she could be content which she refused. On July 23, 2018 Santa Fe received a record-breaking rain fall which consisted of over 4” and we were contacted once again by Ms. on July 25,2018 at 8:44 pm that she had 2 different construction companies at her home inspecting the roof but had never contacted us prior to that date to inform us that she had a leak. Splendid Builders responded via text message on July 26, 2018 at 2:00 am Splendid Builders asked if we could come over to take a look at this leak and repair any issues, Ms. never replied to our request and we did not hear from her after that. On September 14, 2018 Splendid Builders once again tried to contact her with no response since July 25, 2018. At which time Splendid Builders asked if we could hire a home inspection company that Splendid Builders would pay for which she also refused. Splendid builders continually asked Ms. for photos or any kind of evidence that her roof leaked which she would not provide or respond to. Splendid Builders also asked if water may have been coming in from ground level at back door which sits lower than ground and is in the same vicinity of the reported leak area. (As we had evidence due to high waters at several locations throughout the city that this was a common occurrence with this rainfall) Ms. at this point agreed with us to pay 50%for a new roof including removal and city code taper system as Splendid Builders would pay for 50%, in our contract agreement it indicates deck replacement was not part of original price but would be an additional fee per square foot as is every proposal that Splendid Builders & Roofing proposes, as do all roofing companies (as deck replacement is not evident until roof is removed, it is unseen). New roof was installed as was the new decking (Ms.’s business partner indicated that deck replacement was necessary as he was on project before, during and after new roof installation) after she initially refused to pay for the decking which her business partner encouraged and agreed to do so at a reduced fee from original cost as the roof was vulnerable to the elements at that point. The city inspector was over on November 19, 2018 and approved all work performed by Splendid Builders on this roof structure. On December 1, 2018 Ms. complained again about the interior work that had previously been done by Splendid Builders & Roofing not any roof related issues. On December 7, 2018 after several more snow falls Ms. contacted Splendid Builders and complained that there was another roof leak which Splendid Builders came out to meet her business partner at her home and installed caulking on the outside stucco area of canale which had nothing to do with the roof Splendid Builders installed. On December 13, 2018, Ms. complained again about a skylight that was not sitting properly, but nothing about her actual roof. On December 28, 2018 she complained that there was a roof leak once again. Which I asked if Splendid Builders crew could go and take a look as they arrived at her home, she refused to let them on her roof and badgered them and belittled them and ran them off. Ms. said “I can’t have you blaming your crew, I want you to do the work” which has happened more than once as my crew can attest to. At this point, Splendid Builders was driving by her home and noticed some gentlemen on her roof so we stopped to see what was going on. At this time *** from *** (a local restoration company) and another roofing contractor (***, from ***) was already present. At this time, we noticed that there were several holes in Ms.’s roof where somebody had taken core samples of roof and that roofing contractor was about to take one as well (per our warranty contract, any such roof alterations is a void of our warranty, especially as she did not contact us prior to doing so and did not allow us to perform any warranty work of our own). *** from *** also did inform Splendid Builders at this time that the issue that was inside with tile, sheetrock, insulation, paint, wood, etc. is due to asbestos and has Ms. living away from her home and not anything having to do with roof damage or leakage.

Ms. is a neighbor, she is also a business owner and we have tried more than once to obtain a good civil relationship with her and she constantly and continually disrespects us and attempts to degrade us and our family, friends and employees, which makes it impossible to communicate with her. She will drive by our home while we are outside and flips us off and speeds off. We attempted to correct the issues when they were present but as mentioned above, she did not allow Splendid Builders to even hire an inspection company or provide us with proof of leaking of roof which indicated to us that there were not sufficient grounds to her claims.

Splendid Builders & Roofing is a reputable company and performs work interior and exterior throughout the entire state of New Mexico we hold an A+ rating with Revdex.com and continue to work with honesty, integrity and joy. Thank you for your time and consideration in this matter.

Sincerely Yours,

Splendid Builders & Roofing, LLC

ATTACHED IS A COPY OF OUR ORIGINAL CONTRACT WITH WARRANTY INFORMATION THAT IS NOW VOIDED DUE TO THE FACT THAT SHE HAS HAD OTHER ROOFING COMPANIES PRESENT AND MADE HOLES ON HER ROOF

Customer Response • Mar 26, 2019

Complaint: ***

I am rejecting this response because:I have paid Splendid Builders and Roofing for two roofs at this time and my roof is still leaking. Regardless of what Mr. M says about me or my personality the fact remains that he has a warranty of 8 years on my roof and fails to honor it. I have numerous text messages and email messages from Mr. M that illustrate his unwillingness to accept the fact that two roofs later my house is in worse shape than when he began. As for driving by his house and speeding off, I never feel the need to speed off from my own street. Mr. M is a bully and is trying to make it sound that an aggravated woman is to blame for his poor work. Anyone would be aggravated after paying what I have for a roof that is failing.I have had a 3rd party engineer inspect the roof and once his report is submitted I will forward. Bottom line is the roof was done poorly which is why it keeps leaking. I expect Mr. M to honor his warranty and repair the roof according to the engineers report.

Regards,
