Revdex.com: I have reviewed the response made by the business in reference to complaint ID [redacted] , and have determined that this does not resolve my complaint For your reference, details of the offer I reviewed appear below As I mentioned in my first letter to the Revdex.com, there was never a landscape plan developed for our property [redacted] lied to my wife and I on several occasions when he said that he would present us with a landscape planWe have owned several homes in the past and have had landscape plans done for us This plan is detailed drawing showing a layout of the property and the proposed design of mulch beds, including plant and tree locations This plan should show the type and quantity of plants and trees to install based on whether they will do well in full sun or part shade This plan is the first step of a design and is suppose to be given to a homeowner so they know the proper plant selection when they go to a nursery When we went to the nursery to select the plants and trees, we had no idea on how many plants or what types to purchase because we did not have a plan to follow We only knew what type of plants to purchase based on our past experience on landscaping our previous homes [redacted] mentioned in his response that we did not purchase any trees and plants from him, another lie I have attached a page from my landscape bills from Splendid and it clearly shows that we purchased many of the trees and plants from three different nursery's through his company ( [redacted] , [redacted] , and [redacted] ) In fact, the tree that [redacted] 's crew killed by running it over with their dump truck, as mentioned in my first letter, was purchased at [redacted] Nursery for $through his company [redacted] told my wife and I on several occasions that he would come back and replace it but he did not keep his word and the tree never was replaced We did purchase some trees on our own and had Splendid install them and I understood that those trees were not covered under his warranty [redacted] claims that our property was awkward? We have some shale in certain areas on our property like any other property in Western Pa We had Splendid plant pine trees at the rear of our property where there good fill dirt and very little rock They also planted more pine trees along the property line where there is some shale Any professional landscaper should know NOT to plant trees in an area if you hit rock after digging down several inches We questioned him about this situation but he told us that he would raise the trees up and add enough topsoil under and around the trees that they would be fine [redacted] proceeded to install the trees and never told us that "All the trees might not survive" Why would we have incurred the expense of buying them and having them plant them if we thought that they would die? We could have just returned the trees to the Nursery and got our money back Many of these trees died because they were sitting directly on rock and were not raised up and mounded using topsoil [redacted] was told before he did any planting of trees that we live on top of a hill in a very windy area but he did not want to take the time to stake them Almost all of the trees that were planted by Splendid eventually died, most were blown over from the wind [redacted] mentioned that he offers insurance to customers for new lawns for "spots that do not come in?" There was never any mention of any type of insurance He told my wife and I that he would return in the fall and fill in areas that did not come in at no cost to us He never returned to do this [redacted] mentioned in his letter that he's has come back repeated times and moved trees, another lie [redacted] has never returned to do anything on our property since the install He also mentioned that I continue to call him and harass him, another lie I called him several months ago to ask him to replace the tree that his crew damaged with the dump truck This call was not to harass but to ask him to do what he promised, replace the tree If anything, [redacted] harassed me on the phone as mentioned in my previous complaint Other customers have had similar problems with Splendid Landscaping as I mentioned in my first letter As a professional, [redacted] should have kept his word and returned to straighten the trees that blew over and staked them He also should have returned and fixed up the areas of grass in the yard that were poorly planted He also should have replaced any trees which died that were not installed properlyInstead, he was in too big of a hurry to get to his next job We don't feel that he "made every effort to make his customer happy and to meet their needs" or "to make this transaction go smoothly" as his letter states Splendid Landscaping has made no effort to resolve this complaint There was no mention in his letter of any type of reimbursement As mentioned in the previous complaint, we are seeking reimbursement of the labor charges of $that Splendid charged us for installing the trees in the back yard (see attachment) We are not seeking reimbursement for the cost of the trees, only his labor chargesWe also would like reimbursement of $for the tree damaged from the dump truck We lost a lot of money and time using Splendid Landscaping on this poor landscaping job We had to purchase all new trees and several large bags of grass seed to repair the bad sections of yard We also have many hours of our labor digging out all the dead trees and replanting large sections of the yard As a business professional, if you say that you are going to do something then you should do it I hope that [redacted] can change his business practices and learn to keep his word when he makes promises and I am sure that he will eventually have a successful businessWe have no interest at all in trying to ruin his business Regards, [redacted]

There are always two sides to every storyHere is the viewpoint from my side, the owner of Splendid Landscaping Incorporated
Last season, my company took the time to evaluate the customer’s (name here) job at (location)After initial evaluation, I went to various local nurseries to develop a landscape plan for the customerPlants were pulled from each nurseryThe customer decided that they did not want to purchase the plants through my company, but rather on their ownI was sure to tell the customer at that time that it was their decision to do so, but that I would not guarantee/warranty the plants if I did not purchase themThe customer stated that he understood thisIt is Splendid Landscaping’s policy to warranty items that were purchase by us though our local suppliers, not by the customer
This particular customer’s lawn was rather awkward because the entire property sits on a rock bedMy company dug two inches down and hit solid rockThe customer was informed of this issue once it was discovered and was told that all plants might not survive due to the conditions below
So we proceeded to install the lawn and plants, which again the customer purchasedThe plants were moved to various areas of the yard per the customer’s instructions, numerous timesIn regards to the lawn, it is very clear to see from the pictures that after a few short weeks they had a full yard of grassAny lawn care professional knows there will be some weeds present in a newly seeded lawnThis again was mentioned to the customerWe have a disclaimer given to all lawn customers that states that it is possible that a newly seeded lawn will come in with some weedsSplendid Landscaping also offers insurance to customers for any new lawn, for spots that do not come inThis customer denied the insurance
We have made every effort to make this customer happy and meet their needsWe have gone back repeated, moved trees, etc, to make this transaction go over smoothlyThis customer has continued to call and harass me and defame my name and my business

Splendid Landscaping has made no effort to resolve this complaint.  There was no mention in his letter of any type of reimbursement.  As mentioned in the previous complaint, we are seeking reimbursement of the labor charges of $3000 that Splendid charged us for installing the trees in the back yard (see attachment).  We are not seeking reimbursement for the cost of the trees, only his labor charges. We also would like reimbursement of $150 for the tree damaged from the dump truck.  We lost a lot of money and time using Splendid Landscaping on this poor landscaping job.  We had to purchase all new trees and several large bags of grass seed to repair the bad sections of yard.  We also have many hours of our labor digging out all the dead trees and replanting large sections of the yard.
 
As a business professional, if you say that you are going to do something then you should do it.  I hope that [redacted] can change his business practices and learn to keep his word when he makes promises and I am sure that he will eventually have a successful business. We have no interest at all in trying to ruin his business.

Review: We hired [redacted]n May 2013 to install a new yard which included planting new grass, shrubs, and trees. We spent $16,000 in material and labor. Our experience with Splendid Landscaping was unsatisfactory. [redacted] made many promises, but he didnt fulfill many of them. He promised to develop a landscape plan so that we could know what trees and shrubs to purchase and where to place them. We never received a plan. The yard was a disaster. The mushroom manure was up to 10 inches thick in some places and too thin in other places. The grass didn't grow in these areas and the weeds and crabgrass quickly took over large areas of the yard. We consulted with other lawn care companies to determine how to fix the weed problem. Most of trees were not planted correctly. One tree in the front yard is planted crooked and needs straightened. Another was planted too deep and died. Before any trees were planted, we told [redacted] that we live in a windy area and he told us that staking the trees was not necessary. Nine trees in the back yard were blown over because they were not staked. We asked him to come back to straighten the trees and he promised to do so. He never came back. He and his crew quickly left to take another job at a neighbors. I called several times about this and he said he would have his crew stop over and straighten the trees. This never happened. We tried straightening them ourselves, which was very difficult due to their large size. All nine of these trees later died. His crew also ran over one of our trees with a dump truck. He at first agreed to replace it but later became belligerent on the phone with me by accusing me of "trashing" his business and posting negative reviews online which I did not do until now with this filed complaint. He also called me an xxxxxxxx on the phone and told me that I was his worst customer. After a quick search online, I found out that there were several other of his customers with similar complaints as mine on www.[redacted].Desired Settlement: I believe that I should be reimbursed for $3,000 which includes Splendid's labor charges for installing trees in the back yard which were improperly installed and my labor charges to cut down the dead trees, dig out the stumps by hand and dispose of the dead trees.
