[To assist us in bringing this matter to a close, you must give us a reason why you are rejecting the responseIf no reason is received your complaint will be closed as Answered] Complaint: [redacted] I am rejecting this response because: Although, I received a call formally apologizing for their mistake, the response is written as if I still owe them $84,because of a bank errorNo formal apology for their behavior was givenAdditionally, I would like to point out the following facts: I paid $for August week membership or administration feeThey stated, “ The promotion at that time was for one free month” I was billed in September and October after my membership was cancelled in early SeptemberCancellation was done formally through email as they requestedI also followed up several times via telephoneThey stated that, “ [redacted] was billed for September and October before his membership was cancelled.” I do not believe I disputed charges twiceI only had one confirmation from my back of a dispute resolution for OctoberThe October charge was reversed by Sport & Health on Oct 18th after I submitted the dispute My bank shows one charge for $and three credits and three debits of $The $paid to me by the bank after the dispute settlement in January was reversed by the bank on January 9th They stated, “ when doing this he essentially was refunded for October twice.” My bank confirmed the mistake must have been made by Sport&Health’s bank or accounting systemAlthough I emailed my bank details to Sort&Health they did not show me their ledger or supposed error If Sport&Health has proof that my bank gave me “two refunds’ for October, then I will have my bank fix error immediatelyAlluding to the fact that I received payment from the bank twice and knowingly kept extra payment is wrongIn addition, billing for $after knowing the bank ruled in my favor and then reversing charges, as Sport&Health did to me, is dishonestI’d like for Sport&Health to prove to me that this wasn’t the case or at least admit to this being a bank error Regards, [redacted]

When doing this he essentially was refunded twice for October. Once from us and the other from the bank when they gave him the money back (via the dispute). When he disputed the September and October payments that created a balance on his account with us. We later learned that [redacted] was promised when joining, two free months of dues so actually should not have been charged in September. We cleared the September charge from his balance. We have made several attempts to explain that [redacted] essentially received two refunds for October and that he needed to return one of them, but we have yet to receive that back. I am rejecting this response because: Although, I received a call formally apologizing for their mistake, the response is written as if I still owe them $84,.99 because of a bank error. No formal apology for their behavior was given. Additionally, I would like to point out the following facts:
1. I paid $20 for August 2 week membership or administration fee. They stated, “…The promotion at that time was for one free month”.
2. I was billed in September and October 2006 after my membership was cancelled in early September. Cancellation was done formally through email as they requested. I also followed up several times via telephone. They stated that, “… [redacted] was billed for September and October before his membership was cancelled.”
3. I do not believe I disputed charges twice. I only had one confirmation from my back of a dispute resolution for October. The October charge was reversed by Sport & Health on Oct 18th after I submitted the dispute.

Alluding to the fact that I received payment from the bank twice and knowingly kept extra payment is wrong. In addition, billing for $84.99 after knowing the bank ruled in my favor and then reversing charges, as Sport&Health did to me, is dishonest. I’d like for Sport&Health to prove to me that this wasn’t the case or at least admit to this being a bank error.

Review: RE: Membership #[redacted]

In August 2012, I moved back to the [redacted] area from [redacted] because I accepted a different position with my employer, the [redacted] and to help my siblings in the care of my mother. At that point, I been a member of Sport and Health for over a year. The management said I could not be released from my contract unless I could produce a letter from one of my mother's doctors that I was her primary caretaker. My part of assisting my mother does not include doctor appointments because I have a full time job.

During a telephone conversation with the Sport and Health Accounting Office in [redacted] (I blieve that's where it is) in August I was offered a "buy out" of my contract which was approximately $350.00. I was unable to pay that amount at that time due to the $4000. plus I was having to pay for my move from [redacted] to [redacted] at the end of August. Since then, Sport and Health continues to deduct the $85.00 per month from my account even though I can not use my membership. On January 21, 2013, I asked for the same offer that was made to me previously in August to "buy out" my contract as by then I had paid $425.00. The reply I received stated my request could not be processed at this time and my current contract would end in August.Desired Settlement: I would lilke to be able to pay the "buy out" amount that was offered to me in August, 2012 and end the contract.

Review: First, the company uses misleading advertising tactics. They advertise a 7-14 day free trial offer of their health facility. However, once you are in the door you will find that free trial comes with signing on for a year membership and requires a host of conditions that must be met to cancel within that 14 day period. At the time , I attempted to cancel the membership due to to the extensive monthly membership fees at this facility but was told I was one visit short of the number of required visits within those first two weeks to cancel and that I would be held to the one year membership.

Next, I had to relocate from the area to another part of the country due to job relocation. Once again I was told I would be held to the remainder of the contract. Therefore, this company had taken funds from my account for months to fullfill the remainder of the contract. That contract should have ended in January of 2013, however, for the months of February and now March, the company continues to take funds from my account. After repeated call to the facililty where the receptionists answeering the phone repeatedly would not allow me to speak to a manager, or would take my name and phone number with empty promises of a return phone call. Finally I was able to speak to someone who sent me an e-mail to which zI could respond with a written request to Cancel by the 25th of the month, which I did by the 25th of February, yet they have taken funds from my account yet again. Once again, I can't get a manager to speak to me by phone.Desired Settlement: At the very least the immediate stoppage of removal of funds from my account and a refund of all funds taken since January.
