Mr [redacted] is complaining about two issues, which I will address herein: Irrigation/grass: On July 5th, I sent the attached letter to Mr [redacted] and his neighbors explaining that the irrigation system servicing their yards needed a new dedicated water source that necessitated digging up the street and installing a new water lineThe contractor was unable to get it installed in the spring prior to the beginning of watering season, so the grass was very stressed by the time the system was up and operating [redacted] thought that most of the grass would come back if it was "overwatered" for the first couple of weeksThey would reassess the condition of the grass at the end of the season and replace areas that failed to respond to the wateringSubsequently, I met personally with Mr [redacted] in his yard and explained again that any grass that did not respond to the watering would be replaced at no cost to him at the end of the seasonOn July 25th, he wrote us a letter complaining that the sprinklers were going off too often and he thought it was "overkill" and was making his yard mushy Now he is complaining because his yard isn't fixed, but it is still August and not the appropriate time to replace sodTo clarify Mr [redacted] accusation in his complaint, there was never a situation where we attempted to install a substandard irrigation system that the City would not allowA representative from our office and the landscaper will meet Mr [redacted] in October to evaluate the condition of all areas of his lawnDriveway Issues: There are indeed some driveway issues with Mr [redacted] driveway, as well as some of the others in the neighborhood We have been working with the cement contractor and have sought the professional advice of [redacted] ** [redacted] , who is an engineer for [redacted] *** Mr [redacted] ’ specialty is concreteHe is evaluating the situationWe expect to address all of the driveway issues yet this yearIn any case, Mr [redacted] driveway is under warranty, so any repairs or replacement will be done at no cost to him unless he elects to have additional or optional work doneNeither the grass nor driveway issues are preventing Mr [redacted] from living in or enjoying his new homeI drove by last week and from the car, his lawn looks lush and beautiful and his driveway is certainly serviceableI will keep you advised of the resolution of each of his complaintsThank youWASHINGTON STREET INVESTORS, LLC

I am rejecting this response because: To whom it may concern,The entire reason for our complaint was the complete lack of response, information and action byWashington Street InvestorsFor months we’ve gone without real information or response, and neverthe kind of information provided in the response to the Revdex.comIt took this complaint to finally get any realinformation from Mr [redacted] If one looks at other complaints they’ll see I’m not the only one to havethe issue of lack of response and actionFor the record, we are still seeing more promises and no actionyet on the driveway but we’re slightly more hopeful.Below is what some of our grass looked like when we filed the complaint:Anyone who has purchased a new home costing over $250,wouldn’t put up with this for very long.Mr [redacted] states that the contractor wasn’t able to put in irrigation because it needed a new dedicatednew water source and then essentially calls me a liar denying that the city wouldn’t allow him to “installa substandard irrigation system”.On July 6th the City of Elk River’s Water Superintendent stated in an email to me the following:“He mentions that late in the year he was informed by me that he could not follow through with hisplanI believe he waited until the very last moment to concoct a plan that fell through because it gotcoldHe had originally wanted to utilize some of the one inch services that were scheduled to be abandoned to irrigate the propertyThose one inch services were inadequate to irrigate the propertyeffectivelyThe association would have had to have many services and water meters to irrigate thepropertyI had many conversations with *** about installing two ½” services to irrigate the entirenew associationThose two services were installed last month; one service was ½” and one was 2”.”I am not a liar.On August 26th, 2017, two days before we moved into our home, Mr [redacted] issued a letter to thehomeowners of our development stating:“(Contractor name) is ready to proceed immediately when they get the go-ahead to hook up to thewater sourceWe expect all of this to take place next week”.Plans change, I get that, but all of this didn’t happen because of the city it happened because the builderwas attempting to do something the city wouldn’t approveThis left me and others in our developmentwith sod being laid that had no water source for many monthsAs one who paid for a new home I andthe others have and had every right to complain when your grass looks as pictured above.Today much of the grass is back but there are still large areas where it’s still dead and weeds aregrowing in its placeMr [redacted] states that he drove by and it looks “plush and beautiful”He’s right, itdoes – from the streetThe areas that are still dead aren’t visible from the street, they’re on the southside of the house and very visible to us every time we look out our living room and dining roomwindows.Regarding the driveway Mr [redacted] response is sadly more of the sameWhen we have heard fromthem, which was rare, we’ve been told all of the same but with no actionGoing back as far asApril/May the contractor pouring the concrete next door to us told me he’d take care of itIt’s August23rd and still no action

I am rejecting this response because:  It is full of "lies".     I will explain in this response.    The one truth there is that we have voiced many complaints in the last 3 years.    ...

We bought this townhome NEW, before it was even finished (no flooring, was not painted, no cabinets, etc.).    The builder's realtor told us MANY things during the course of the finishing, that were lies.    The builder even had to pay us back money because she lied to us about the water softener.     When we would voice a concern or complaint to the realtor, she would act like we were complainers, like the builder is also stating.    She at one point, told us we were NOT ALLOWED to come to look at our townhome while it was being finished (she also told a new buyer the same thing a couple months ago as the new buyer was not happy with some things).    We had, in our NEW townhome, over 30 issues that the builder had to fix.   i.e. all appliance had to be repaired in the first 6 months, we had a "flood" in our kitchen and bathroom, when the NEW valves broke, circuits break to this day and the electric company has been there 4-5 times to TRY fix it.   We had over 200 NAIL pops that the owners son had to come and fix (and the son said he has NEVER seen that many), air conditioner broke down 2 weeks after it was installed.    The sheetrocker taped the corners rounded, instead of squared.    We were told by the realtor that our cabinets were BLACK, which we wanted, they were not...they were brown and cheap.   Our driveway chipped and cracked and it took over a year for the builder to finally fix it.   (yes the builder has fixed all these things, but 30 plus issues is very excessive for a NEW townhome).    I could go on and on, like I said over 30 issues with our NEW townhome.     BUT, back to the wall issue.    Roger (the builder) and his associate DID come to do their test.     I did go to the neighbors and TRIED to get them to make noise.   The ASSOCIATE just sat in a chair and hardly said a word.   The neighbor did not cooperate either, (his wife was not home and she was NOT very happy with her husband for not cooperating).   AND, "Mr. Perkins" did NOT jump up on the couch and put his ear to the wall and say "I can hear them".    Our complaint is about hearing the neighbors from the middle of the room not against the wall, and "Mr. Perkins" had surgery on his knees and can't "jump up on the couch".     The builder did have the insulation guy come and put insulation around the plug ins.   IT DID NOTHING.    WE paid over $800 to put insulation in the entire wall - front to back, and it did nothing (oh, and by the way, the insulation guy was up in the attic and said the wall in the living room area is NOT made right).        It's funny....in the builder's letter to the Revdex.com, he states "each unit has its own separate wall with a one-inch air space".     HIS REALTOR kept telling us it was a 4 (FOUR) inch air space, and I believe the builder has told us that also.   So which one is the truth??????    Industry standards should include the rule that a neighbor should not be able to hear their neighbor go to the bathroom through the bathroom wall, which we can.     We have to have a fan on continuously to drown out the noise from next door.     The builder stated he offered to buy the townhome back, unfortunately, we really do like the layout of the townhome and we LOVE our view, and no we would not "dream of moving" since it was suppose to be our last and final move.    I doubt this builder would pay us the "going price" on our townhome, which is about $60,000 more than we paid for it, pack all our stuff and pay for movers.   Plus, we are NOT going to move.    This townhome was NOT built with the best design.   It was built with a cheapest design.   We have lived in townhomes where the common walls were cement and we NEVER heard our neighbors.     We have had MANY friends and workers in our home who have heard the neighbors, and cannot believe we can hear  that noise.    So if the industry standards are what this builder says, then Minnesota's industry standards need to change so that builders HAVE to build soundproof walls.     We have talked to our neighbor about this also.   We are hoping he will send a letter to the Revdex.com also.    I know he is unhappy with many things in the townhome he bought from the first buyers.     Lastly, I know this will NEVER be resolved because all the builder wants to do is call us complainers.   We have had to fight him to fix anything.     BUT, I really do not believe that this builder, Washington Street Investors, should have an A+ rating with the Revdex.com.    They are NOT even a B.

Hello, [redacted].  Marshall [redacted], our Vice President for Operations, met with [redacted] last Thursday, March 30th, and reviewed her issues with her.  In addition, the Alside Building Supply representative, our window distributor, was there to discuss the remedy for the air that seemed to be...

leaking around the windows.  It was discovered that the window installation and the insulation around the windows were all done properly.  There was a very small gap in some of the windows where the upper and lower sash meet, which was the cause of the draft felt by Ms. [redacted].  The Alside rep has ordered a special kit to remedy the problem.  It will be installed by their representative within the next two weeks.    Marshall [redacted] has contacted the driveway subcontractor, Majestic Masonry, regarding the pits and scaling on the surface.  These are cement driveways and should not have that problem.  We will make arrangements with the contractor to repair and/or replace the driveway sections that are substandard.  Mr. [redacted] tells me that Ms. [redacted] is happy with her new home, with the exception of these issues that are being addressed.  I expect the window situation to be corrected during the next two weeks and we will have a plan for resolution of the driveway issue at that time also and will notify Ms. [redacted] of the timetable when the work will actually be done on her driveway.   I will send you an update at that time.  Thank you for bringing this matter to my attention.    Roger [redacted]
