** *** has made one thing very clear from the beginning, agreed terms and conditions were not to apply to herUnfortunately for her, they do. Our individual registration process is very simplePeople are required to provide choices (when available) for placementWe state this in the
league overview as follows, "Signing up as an individual? Great! Indie teams are formed based on supply and demand, and therefore requiring flexibility for placementGive us choices of when/where you can play and there is a 95% successful placement rateIf we cannot place you within those three choices, a refund will be givenNOTE: YOU MUST list 2nd and 3rd options (if available) in case this first choice does not work out You will be asked for options when you click to registerYou can even list an alternate sport if you like - the goal is to get you playing! - but listing an alternate sport or skill level is not a requirementIf you can only play in this program, we recommend that you put a full team togetherIf you do not list alternate choices, we will place you in the next available same sport/format/skill level and there are no refundsAll individual registration fees include referee costs."We ask a specific placement question during registration for 2nd/3rd option** ***'s response: "I think we have to play the Sunday league or is a no go:( "Anyone can write what they want in the registration question section but that does not change the fact of requirements** *** expected that instructions did not apply to her as in her e-mail of the 18th, "You're correct, I paid no attention to the registration requirements when I signed up." So she ignored the detailed outline, the registration process question and agreed terms and conditions which outlines our placement policy.** *** is correct that our intern dropped the ball in keeping her informed of the status of program and that she was looking at Monday placement, which was the next available league starting upI apologized to her directly for this gaffe and reprimanded our internDuring my conversation with her of the 11th, I confirmed other league options on Sunday which were rebuffedWhen asked if she could register as a team so she was guaranteed same day placement or refund if it did not run, she declinedI also brought up various other kickball league options and they were rebuffedAnd I brought up option to defer participationThat was rebuffedAnd this was if the program was canceled - at that time, we were hopeful for it to start the 17thSo we were at square one with her unless it ran or she wanted to sell her spotOtherwise, she would be placed onto a Monday team which was starting the following weekThat is what was done. Our obligation goes no further than placing her in the next available programHowever we went above and beyond and offered multiple options (as previously outlined above) in writingHere is her response from the 15th: "Please stop sending me other dates we can playIt's inconsiderate as I've stated several times my work schedule does not allow for it. I made this clear on the application. Do you not read the notes on the application? Perhaps my payment should not have been accepted since I did not list any alternate dates."During conversation and e-mails, ** *** employed the standard tactics for someone who wants undeserved special exception: inflexibility, denial, accusation and threatThis Revdex.com complaint is just a continuation of her line of communication.Bottom line: ** *** is not eligible for a refundShe was successfully placed onto a Monday night kickball league that began last nightIt is her choice not to play in that program, decline to play in any other program, decline to defer participation or sell her spot directlyWe have fulfilled our obligation to ** ***.If there are any questions, please let me know.Regards,Bart F*

Mr***'s complaint is an interesting one because he outlines his understanding of the league programming advertised on meetup.com and run through Sports MonsterAs we outline in our meetup.com promos, "All registrations made through this Meetup event agree to the terms and conditions found
on sportsmonster.net."He has also been a member of Sports Monster since March, So what we do and how we do it should be understood or at least familiar to him A cursory review of our offered programming on our columbus.sportsmonster.net site and/or linked terms and conditions would have answered most questions he might have hadIf he had additional questions, he could send them to us via the contact info providedI checked the default e-mail address and there were no e-mails from ***@hotmail.comContrary to his outlandish statement, there were no liesThere was no misleading advertisingMr*** chose to perceive something that suited himself but was not factualThe program Mr*** registered to play clearly showed the times to play both in the meetup promo and our website. For whatever reason, Mr*** had a change of heart and then decided it was our fault that what was offered did not suit him and expected us to make an exception for himHe was not eligible for a refund and will not be considered for one now

I reviewed the response made by the business in reference to complaint ID ***, and find the resolution is satisfactory to me

The complaint the customer has lodged is contradicted by their own admission to understanding how we operate our placement of individuals from past experienceThat he does not like our terms and conditions is his opinionThat he agreed to them previously and then again with obvious knowledge this
season is what is germane We have followed our placement practices correctlyHe is incorrect to claim otherwiseHad specific placement been of such importance, the customer should have made the effort to register a full team insteadAs individual placement is based on supply/demand, we require flexibility for individuals.Although not part of our terms and conditions, we also reach out to individual customers with additional placement options in different sports if that is preferredTo date, this customer has not responded to that inquiry and has only posted this complaint.There will be no refund offered or processed as we met our obligation to this customer as he agreedShould he wish to accept the additional placement offers we have made available, he is still welcome to do so

We processed refunds for Mr*** and his friendsI had been told by Mr*** that this complaint would be dropped, hence the delay in follow-upThis matter should be closed to customer's satisfactionIf not, I will provide copies of refund credits paid in full

Ms. [redacted] must be a very nasty individual for her to be hung up on once, let alone twice! The only time we ever hang up on someone is when they start using foul language or become verbally abusive. Nobody should have to put up with such nonsense from abusive people and I instruct my employees to hang...

I do not recall the conversation she quoted as I would have had to have been the 2nd party allegedly laughing at her but I can guarantee the only way I hung up that phone in advance of the end of a conversation is she was nasty. Outside of her communications shortcomings, there are also the matters of her inability to understand that the instructions she referenced applies to her.Please note that Ms. [redacted] has properly accounted for our placement policy requiring flexible placement for individual registrants. She has also confirmed that she did not properly adhere to our registration requirements. Yet, she expected us to make an exception for her and apparently was rude and abusive in the process.As noted in our meetup.com payment/refund policy, we process a full refund should placement not occur. We also stipulate that individual players must do the following, "1st & 2nd program choices are required. Failure to provide a valid 2nd choice shall result in placement to the next available program and there will be no refunds. If we cannot place player in either valid option, a full refund is given." Ms. [redacted] provided only one option as she admits in her complaint. Since we were able to place her in a Thursday night program, she was not eligible for refund.Her reference to our website for contact info is correct. What she does not reference is that our terms listed on our website are in place for all programming unless otherwise noted. Our standard placement requirement is actually for 3 selections from individuals but our meetup.com promotion required only two: https://pittsburghmonster.leaguelab.com/page/Terms-and-ConditionsShe further notes that she had no desire to defer her fees to the upcoming Summer season for any program which cancels any special consideration she could have received as our goal is always for people to be able to participate in programming and have a good time.Had Ms. [redacted] had a full team to register, we do not require any options for placement and had that league not run, the team/players would have received a full refund. She did not register as a full team. She was able to be placed.In summation, Ms. [redacted]'s experiences are all caused by herself. She ignored registration requirements, was frustrated when exceptions would not be made for her and was apparently so nasty during her interchanges with us that she was hung up on twice. She was successfully placed in the sport she registered to play and is not eligible for a refund.

Sports Monster welcomes individuals to sign up for league programming. Our main requirement is that they are flexible on when and where they can play as individual teams are formed based on supply and demand. As we outline in our terms and conditions:...

Independent registrants providing three league choices, when available, who cannot be placed will be entitled to a full refund. Individual registrants who provide only one or two options and cannot be placed in that league will be placed into the next available open same sport/skill level/format league - no refunds will be provided. If an individual is limited to only one option for placement, the recommended course of action is for them to form a full team to guarantee that placement. Otherwise, three options are required. When customers register, they are prompted to provide a 2nd and 3rd choice. You can see below that this customer did not provide a 2nd and 3rd choice. Since her first option was not available, we placed the customer as agreed into the next available league. She told our manager, Ryan R[redacted], that she could not attend that day - as she reported here - and he offered her the option to defer participation to the fall. She would also be able to move her registration to another sport/day if interested and would have had this option known if she had not rudely hung up the phone.The customer is not eligible for a refund as she agreed at time of registration. If she would like to put some friends together to form a team, we will certainly credit her current fee towards the team fee. If she wishes to play another sport/day, she can inquire for options. She can also wait until fall or she can play Sundays this season.
