Revdex.com: I have reviewed the offer and/or response made by the business in reference to complaint ID [redacted] , and have determined that this proposed action would not resolve my complaint For your reference, details of the offer I reviewed appear below There was no offer Instead I received a detailed explanation of why Spring Green felt they were not liable for the damage to my pavers In response to Mr [redacted] 's email: I requested a one-time lime application in This was not a part of my regular maintenance program and I did not request a lime application in In fact the error was acknowledged when I contacted the office Yes, the charge should have been taken off when I had not requested the service and given the resulting issuesI have [redacted] a photo taken today, almost two months after the spill, showing the residual stain The residue was NOT successfully cleaned from ALL surfaces!!! The fact that it is taking this long for the entire stain to fade given the amount of rain that we have had AND the fact that I have a sprinkler system running water over the pavers, is an indication that the color of my pavers is not due to JUST a natural hazing I don't know how Mr [redacted] is saying that he did not see any residue on the affected areas when he came out There was residue then and there are remnants now!!!! Mr [redacted] also takes issue with the cost to clean and seal the pavers I received no response to my option of him sending someone out to clean the pavers I did not stipulate that my landscaper had to clean them I also reiterated that I wanted him to cover the cost of sealant because the color of the pavers were affected by the length of time the lime had been on them and asked what would be done if cleaning did not work No responseI don't know why there is such a problem with getting this issue resolved There is no denying that Spring Green applied an unauthorized treatment resulting in a lime spill Subsequent attempts to clean the pavers simply spread the lime creating the haze Yes, these pavers may have a tendency to haze but not WEEKS after installation!!! I also contend that the lime spill accelarated the time frame for hazing to occurWhat are my options going forward???? I have reviewed the offer and/or response made by the business in reference to complaint ID ***, and have determined that this proposed action would not resolve my complaint. For your reference, details of the offer I reviewed appear below. The *** pictures clearly show that the hill in my backyard slopes toward the house and the pavers I do not understand Mr***'s assertion that the spill could not run uphill The nozzle came loose at the base of the hill and the spray ran DOWN over the pavers He also states that I am no longer a customer of his Why would I continue giving him money after the customer service I have received over this incident An incident which never should have happened.I also question why he would be willing to compensate me IF I concede that he was not responsible for the hazing???? I have provided pictures of the pavers with the spill and one taken a week ago still showing the outline of the spill I am really tired and frustrated by this If he is not willing to clean the pavers then I need to move forward with small claims court I take pride in keeping my yard nice and to have this happen weeks after I paid all that money to have those pavers installed is totally unacceptable.Regards,*** ***-***

I was willing to clean the pavers as a customer service. However, the client has cancelled her service and is no longer a customer of ours. The facts clearly indicate that the complaint she has regarding the hazing of the concrete pavers is not a result of the nozzle of our equipment coming loose. It is not possible for a spill to the right of a drain to travel to the left and uphill past the surface drain. It is also not possible for the spill to travel feet away from the pavers at the left side of the house and travel uphill and cause the hazing at the pavers to the rear of the house. If the client is willing to concede that we are not responsible for the hazing of any of the concrete pavers then I am willing to compensate her for the inconvenience that she has been caused as a result of this accident.*** ***Spring Green

[redacted]Our records reflect that [redacted] added lime treatment
to her routine lawn care service in 2014. We call ahead to advise customer of
service visit but we do not specifically state what services are being
provided. When [redacted] objected to the application fee for...

lime
treatment, we as a customer service credited her account. The nozzle did come loose at the time of the lawn
application and did leave a residue on the pavers to the right of the storm drain,
the walk to the left of the driveway and part of the driveway. We were able to successfully clean the residue from all
surfaces. However, [redacted] indicated that there was a haze present on
her pavers.Since out service manager who had visited the property and
cleaned the pavers did not know what else to do, I arranged to visit the property
myself. My inspection revealed no residue present on any of the
areas that had been affected and subsequently cleaned. [redacted] felt
that the incident has caused a haze on all pavers in include pavers on the
opposite side and uphill from the storm drain and pavers behind the house
approximately 30 feet away from where the nozzle came loose. So, in order for the
incident to have affected the pavers she indicated were affected, the liquid
product would have to ravel past a storm drain and uphill to affect the pavers
to the left of the storm drain and uphill and 30 feet to the right to affect
the pavers behind the house. ( [redacted]).  At which point she indicated that the pavers
behind the house must have been affected by the lime application made to the
yard. However, no explanation for the pavers to the left of the storm drain and
no lawn above those pavers that an application would have been made to.At this point, it was clear to me that our application did
not cause the hazing that she was referring to. However, it was also clear to
me that nothing short of cleaning the pavers would satisfy her. So, as a
customer service I offered to have her landscape company send me an estimate to
provide the muriatic acid cleaning that they had recommended and apologized to
her and her husband for the accident that had occurred on their property. What I received was an estimate of $600.00 to clean and seal
the pavers. The pavers weren’t sealed previously and we have not discussed an estimate
for sealing the pavers to be included. When I inquired if she thought her
request and the landscape’s recommendation was satisfactory and reasonable she
responded by stating that it the cleaning and sealing didn’t work to her
satisfaction was I wiling to replace the pavers. In an effort to make her understand the cause of any hazing she
was seeing was a common problem for concrete pavers and would dissipate on its
own, I researched and sent her links confirming that the concrete hazing was a
common problem ([redacted]). I also reviewed the facts that the pavers she
felt were affected were away from the nozzle leak and no other lime
applications had caused a problem on our clients pavers.

There was no offer.  Instead I received a detailed explanation of why Spring Green felt they were not liable for the damage to my pavers.
In response to Mr. [redacted]'s email:
I requested a one-time lime application in 2014.  This was not a part of my regular maintenance program and I did not request a lime application in 2015.  In fact the error was acknowledged when I contacted the office.  Yes, the charge should have been taken off when I had not requested the service and given the resulting issues.
I have [redacted] a photo taken today, almost two months after the spill, showing the residual stain.  The residue was NOT successfully cleaned from ALL surfaces!!!  The fact that it is taking this long for the entire stain to fade given the amount of rain that we have had AND the fact that I have a sprinkler system running water over the pavers, is an indication that the color of my pavers is not due to JUST a natural hazing.  I don't know how Mr. [redacted] is saying that he did not see any residue on the affected areas when he came out.  There was residue then and there are remnants now!!!!
Mr. [redacted] also takes issue with the cost to clean and seal the pavers.  I received no response to my option of him sending someone out to clean the pavers .  I did not stipulate that my landscaper had to clean them.  I also reiterated that I wanted him to cover the cost of sealant because the color of the pavers were affected by the length of time the lime had been on them and asked what would be done if cleaning did not work.  No response.
I don't know why there is such a problem with getting this issue resolved.  There is no denying that Spring Green applied an unauthorized treatment resulting in a lime spill.  Subsequent attempts to clean the pavers simply spread the lime creating the haze.  Yes, these pavers may have a tendency to haze but not 3 WEEKS after installation!!!  I also contend that the lime spill accelarated the time frame for hazing to occur.
What are my options going forward????  I have invested far more time than the situation warrants and I have been patient for almost two months.
Please let me know if you do not receive the [redacted] picture and I will send it in a separate email.

Review: Outline of Events Leading to this ComplaintJune 9, 2015 Spring Green applied fertilizer and 3-way weed control, which was a part of the scheduled lawn maintenance plan. I later found out they also applied a lime treatment that was not authorized. I arrived home and found my driveway, stamped concrete sidewalk and newly installed pavers stained with a white substance. See [redacted] pictures.June 10, 2015 When the stains didnt disappear after my husband and I tried to wash them away, I left a message for Spring Green asking them to call to let me know what they had put on my yard.June 12, 2015 After NOT receiving a return call, I contacted the office again and spoke with [redacted]. She stated that the hose on the sprayer disconnected while the technician was applying a lime treatment causing the discoloration. However, it should wash away. I told her that my husband and I both had tried to wash it away and it didnt work. The rain also had not washed it away. She said the technician would return to clean it the following Monday. Please note that at no time prior to my contacting the company did Spring Green notify me the spill had occurred or try to clean it up.June 15th Technician came back out to scrub the areas where the spill occurred but the stains still remained.June 19, 2015 After reviewing my maintenance program, I realized that lime was not a part of the scheduled maintenance. I spoke with [redacted] who told me that [redacted] was out but she would have her call me on Tuesday June 23rd regarding the lime application and the fact that the stain was still visible. No call.July 1st 2015 My husband spoke with [redacted] about the lime showing on the pavers and questioning the charge for the lime service. She explained that the lime service was requested the previous year and had mistakenly carried over to the current year. She would delete the charge and have a technician come out on July 7th to re-clean the pavers.July 7th A different technician came out to clean the stains again.July 8th Contacted [redacted] at Spring Green to let her know the stain was removed from the driveway and sidewalk but the pavers were still stained. She said that [redacted] would not be back until Monday, July 13th but she would try and correct the problem.July 9th Spoke with [redacted] who said the [redacted], the owner, would be by the same afternoon or Monday. He actually came by on Saturday, July 11th.July 11th When Mr. [redacted] came by to look at the pavers, I informed him the pavers had been installed only 3 weeks prior to the spill. Our plan was to seal the pavers but it had not been done before the spill. I had spoken with the landscaper prior to Mr. [redacted] coming over and was told the difficulty with cleaning the pavers was the stone was porous and the lime had not been washed away immediately. It had soaked into the stone. He stated that a possible option was to use muriatic acid but he did not know if that would affect the color of the stone. He said that he would check with the Stone Center where the stone was purchased to find out if there were other options. When I mentioned this to Mr. [redacted], he said that he would not be responsible for using acid because of possible damage to my plants and grass. He did however ask me to obtain and estimate and forward it to him.I have [redacted] a Word document of these events and the email traffic following the July 11th meeting.Desired Settlement: I would like Spring Green to pay to have someone experienced with working with this type of stone clean and seal my pavers. I am asking for sealant because I believe that will be required to restore the color giving the length of time the lime has been on the pavers.
