Complaint: [redacted] I am rejecting this response because: There is no set schedule for the job? Tim St [redacted] stated there is a change of schedule, that is a lie? Please provide written evidence for that if SPS disagrees? I can send it the contract to show there is no set schedule? The painters came did some work then left on their own will to do a different job for others? I had to continue the work for the house including tiles and carpentry? There are some dust due to those? But that can be cleaned up and I can't just keep waiting for the painters without doing other work? SPS took the deposit and did some work with poor quality? The job is a fixed priced contract not time and material type? If SPS does not want to finish the job, I want to have some of the deposit back? Sincerely, [redacted] ***

Our response to this matter is not one made lightly We have not had this situation with any other clients and are deeply troubled by the allegations It is our belief that [redacted] is trying to exploit the Revdex.com and the [redacted] to obtain an unfair result We believe that this is a civil matter and one to which [redacted] does not have a case As such we ask that this matter be closed and handled as a legal matter

While we regret the situation with [redacted] it became apparent that we had no choice but to terminate the contract.? It proved impossible to complete the original scope of work due to inadequate safety procedures and the simple fact that you cannot properly paint a house when it is completely full of wood and drywall dust.? Simply put you cannot drywall, trim, and paint at the same time and provide the level of craftsmanship that we require [redacted] acting as his own General Contractor had a variety of family members doing work on the home and keeping up with our high standards impossibleWe advised him of this but he insisted we continue work and left messes and obstacles that frustrated the purpose of the contract.Our original quote was based on information available at the time and ordinary and reasonable working conditions.? It became clear to us that such conditions would not be present and we were forced with two optionsRaise our price or terminate our contract.? Based on the contentious relationship with the customer the only option was termination.? Upon terminating this contract due to unforeseen working conditions and unreasonable expectations we surrendered any right to profit on this job.? [redacted] provided a $5,advance towards completion of the projectSaid funds were used in the following manner$2,for paint which was used on his project.? $3,to a painting subcontractor.? $to hire a taper to fix the taping done by the dry-waller who [redacted] had previously employed (I had him come back twice).? Finally miscellaneous shop costs, internal labor? and? fuel make up the last roughly $? $5,? was the monies outlaid on this job under theory's of Quantum Meruit we believe that $5,is well below the reasonable value of services providedWe will take a loss on this project.By us terminating the job we believe we have provided [redacted] well in excess value of the monies he spentThe reality that he cannot find another contractor to complete the job at the pre-agreed budget is a testament to the changed circumstances for which we are terminating this contractWe did attempt to resolve this matter with [redacted] directly but he was not willing to discuss it furtherWe are happy still, to discuss this in person and work out an amicable resolutionUltimately, we are happy to take our loss and just walk awayBut should [redacted] pursue this further we are happy to raise our very real legal actions as to our lost profits as our lawyers have recommended.Tim St***?

I am rejecting this response because: SPS defrauded me of significant portion of the 5800$ deposit and did insufficient amount of work with poor quality Their strategy is to take a big deposit, do small amount of poor work, terminate the contract, claim they suffered a loss and would not give me my money back I have to hire a different contractor and lose 3800$ to get the job complete The scope is not changed. There is clearly defined scope of work by the contract SPS accused me of inconsistency in my story Yet it provides no specifics The head of SPS Tim St*** told numerous lies as I pointed in my previous communication SPS and Tim St*** are true fraud

I am rejecting this response because: There is no safety issues ever mentioned before SPS stopped working my job and we had a fixed price contract so raising price is out of question without change of work scope All the expectations were clearly spelled out in the contract and no additional requirements were added beyond the original contract The fact that I was the General Contractor and myself and my family members were doing some work on my house are not excluded in my contract with SPS There is dust but it was created during the period SPS went to do someone else's work I had other people working on the house while they were away and plan to clean it up when SPS come back to do painting. SPS also lied about they hired the dry-waller they claimed I hired before I never hired the dry-waller SPS hired to work on my house SPS also lied about they contacted me to resolve this matter They stopped working on 1/28/ Tim S*** promised me to call on 1/30/ He never did I followed up with texts on 1/31/and 2/9/and phone callsHe never contacted me since 1/28/17.The simple fact is that SPS ripped my off with my deposit money and did insufficient amount of work and the work quality is poor I have since got new quote to pick up what SPS left off and finish the job Because SPS did insufficient amount of work and the quality is low and there were lots of paint droops that need to be fixed and lots of rough surfaces need to be sanded, the quote is at 13000$ to finish the job My contract value with SPS is 15000$ SPS has taken 5800$ from me The balance is 15000-5800=9200$ Now I have to pay for 13000$ to finish the job to the same scope I had in the contract with SPS The extra cost is 13000-9200=3800$ I request SPS to compensate me for the 3800$

We regret that *** *** feels the way he does and is not satisfied with our proposed resolution. There are numerous factual inconsistencies in his story that do not match with our viewAt this point we do not believe this can be resolved amicably. We wish *** *** the best of luck at completing his project and we are content having taking a loss working for him. We do not intend to pursue our recourses against him further and hope that he can have more success with future contractors. Our legal counsel has advised us to end communication with him at this point. We thank *** *** for the opportunity and are disappointed that the scope of work shifted making it impossible to complete the job as originally agreedWe believe we acted in such a manner to properly resolve his compliant but are not going to take a further loss on the project considering all the facts previously provided. We/SPS are terminating the agreement with [redacted] for the following reasons.-Job site conditions exCarpenters and tile guys creating safety/dust issues on a daily basis,[redacted] not allowing us to perform our work safely and efficiently, also changing schedule.? Deposit revived to SPS was
