Review: I ordered a cheesecake 8/*/2013 from S&S Chessecake [redacted]. I received a second email stating the the cheesecake was shipping via Fed-Ex 8/*/2013. It did not give a delivery date. I sent an email 8/*/2013 asking for a delivery date so that the recepient would be aware of the package delivery. I received no response to that request. A notice was left at the delivery address that a package was there to pick-up. There was no indication on the slip that the shipment was perishable that I am aware of. The package arrived tuesday 8/*/2013 for a first delivery attempt. The package was picked up thursday 8/*/2013. When the package was open 8/*/2013 the cheesecake was spoiled. I contacted S&S by phone to let them know about my experience. I was told that I should have tracked the package to find out when it had arrived at its destination. When I explained that I had requested delivery information and did not receive a response, I was hung up on. This cheesecake was $65.00 and was a birthday gift to my son.Desired Settlement: I would like my money refunded. I do not want another cake shipped as I am concerned the second cake would suffer the same fate.

This letter is in response to complaint ID [redacted].

On Thursday, August *, 2013 S & S Cheesecake received an order for a small strawberry cheesecake. On Friday, August [redacted] an email was sent to the customer informing her that her order was received and would be processed to ship on Monday, August [redacted] via Fed Ex. A tracking number was provided in order for the customer to track the shipment and therefore, she would know when the cake would be delivered. A copy of the email accompanies this letter. The customer claims to have sent an email requesting a delivery date. I searched our old emails and could not find her email. In any event, the tracking number was provided for the purpose ,of the customer to be able to track the package to determine delivery information.

We shipped the cheesecake standard overnight and Fed Ex did attempt to deliver the next day; however, no one was there to accept the shipment. It is the customer's responsibility to inform the recipient to expect a Fed Ex delivery. If the recipient would have picked up the cheesecake the same day or even the next day the cheesecake would have been fine. The recipient picked up the cheesecake days later. Cheesecakes are a perishable item and if left unrefrigerated for three days the cake could spoil.

With regards to our phone conversation, I told [redacted] that it was her responsibility to track the package and in form the recipient when the cake would arrive. There was silence on the phone and I assumed the conversation was finished.

Our company did everything we are suppose to do. We processed the order in a timely manner and sent tracking information. It is the customer's responsibility to track the shipment and inform the recipient to expect a shipment. Therefore, we do not believe that a refund is due this customer.
