After reviewing the tenant ledger, this is what I have discovered: The tenant moved out on 5/6/2012. At the time of move-out, no rent was paid for the six days in May. Here is a summary of charges/credits: Previous months’ balance: $50Rent for May 2012:...

$7821.       Total due before move-out credits/charges:  $832 Security deposit credit:  ($500)Rent Credit, 25 days:  ($630.65)2.       Total credits:  ($1,130.65) Move out chargesCarpet cleaning:  $70General cleaning:  $185Painting:  $192.233.       $447.23 When you add up the charges/credits you get the following balance due:$832 + $447.23 = $1,279.23 – ($1,130.65) = $148.58. I am assuming the reason the claim has reached $192 is interest accruing from the collection agency.

Review: I moved out of the Churchill Downs Apts in 2012 and I am filing a complaint regarding an account that has been reported to my credit in the past due amount of $192.00. I would like to start by saying that this is not the first time that I have received a request for additional money over the $500.00 deposit that was provided upon move in. The first time was when I moved out of the [redacted] in 2009 when I was charged to paint and patch a hole that had been cut by one of your maintenance workers while checking for additional mold in the apartment that my newborn son and I were exposed to as there was mold growing on the wall in our bedroom. After this experience, I later moved into an apartment at Churchill Downs and soon found out that the roof on our unit was leaking. It just so happened that this leaked into my son's room which deemed this room uninhabitable. For months my 2 year old son was not able to use the room as the carpet had been pulled back, the drywall was damaged, and the room I'm almost positive was toxic consisting of pigeon waste from the water that had leaked off the roof and mold. After months of not being repaired due to the lack of response from your management and several attempts to get the management to fix this without success, I stopped paying the full balance of my rent and reduced the amount equal to that of a 1 bedroom unit. I then started receiving several threatening notices along with management actually knocking on my door to tell me that I would be evicted if the balance was not paid in full. This was the final straw in which I finally contacted your regional manager and was able to get a response. An agreement was made at that time that the complex would accept the reduced amount in rent due to negligence involving the managements response. When it came time to move out, it was then reported in bad faith that I had been previously delinquent on my rent due to this which in turn caused the company to turn me downDesired Settlement: The balance remaining on this account is due to additional rent owed as the result of this since I was not able to move on the original move out date. Which meant I was then forced to find another rental through a new property management, pay another application fee, and eat the first fee. I was also charged for damage due to the leak in the roof which was leaking again when I moved. Please close this account in good faith and remove it from my credit. Thank you
