concern: December 14, This is in reference to the complaint filed by *** *** on 12/13/ I have attached her referenced *** conversation as well her usage and contract with our facility *** joined our facility at *** *** StLouis, MO on July 1st, for $per month, to be auto-debited on the 15th of each month. I have attached a copy of that agreement, her release and waiver of liability, and what is required to cancel her membership and her option to waive her join fee. The join fee remains waived if the member stays with the gym for months or longer. If the member cancels prior to that, they are required to pay that fee. All of which she initialed and signed onthe attached document I’ve also attached a copy of our conversation with *** over *** We never admitted any unsafe equipment. We have two rowers, and both worked throughout this time. One of them had a marginal slip in it and we replaced the cable and that fixed it It was still completely safe to use. We would have removed it from the floor if it wasn’t. We own a second gym in StCharles and hired a full time equipment maintenance and repairman back in April of this year. We did a large re-arrange including new pieces of equipment in November, and have stayed on top of equipment needs wherever necessary. I am not shy about investing into equipment and receive consistent compliments from long term members for having great equipment that we are consistent with. We have multiple sets of each cardio pieceThey get used up and we have to replace parts and maintain them over time. When we are aware of something that needs to be repaired, we order the parts the next business day and then repair/replace that item when the parts come in. The maximum amount of time anything would be down is 2-weeks depending on shipping time and how complicated the repair isAt no point is any of our equipment unsafe. As for the temperature. It is a very large building, overnight on weekend nights when we are not staffed (it’s the only time we are not staffed as a facility) we lock the doors to the classroom and bike room. When we unlock those rooms they tend to be fairly warm as the temperature will regulate again with the doors open. And this is only when the temperature outside requires the furnaces to run. It’s an incredibly brief period of time and regulates itself with basic air flow. It is a large space to regulate. Often times, *** would attend the facility whenever we were opening up, such as an early Sunday morning. It’s usually regulated within an hour of that timeAdditionally, she maintained that there was never anyone there for her to communicate withShe attended our facility a total of timesA typical member works out between 1-hoursof those times she would have been there when there wasn’t an employee working the front desk or cleaning the facility. out of times we were either staffed overnight, or she arrived when an employee was opening or had already opened *** is not being charged a $cancellation fee. She has to pay the $join fee that she waived by not following through on her signed commitment with us. Plus, she is attempting to cancel over *** (you need to do this in person as it requires your signature) and is doing it too close to her bill date for us to cancel the December billing. We submit this through a 3rd party days prior to the bill date, and in order to cancel it, we need 10+ days for that cancellation, as it states on the contract, which she took the yellow copy of with her when she signed upAll of this is stated in her signed commitment with us, that she has a copy of As a service business, nobody ever agreed with her complaints, however, we are empathetic to frustrations and will do whatever we can to appease the member and validate them, no matter how inaccurate their complaints may be *** *** - Owner since April 1, 2015***.***@gmail.com***
