Her complain is totally false, she told us she was looking for a new car cause her last car was wreck and she is planing to use the insurance check to get a new one. She was here in my lot 3 times, when she saw the vehicle, when she test drive...

it and last when she took it with her mechanic, she came back to us and told us the car was fine and she want it, but she wouldn't be able to buy it that day cause she didn't get her insurance check yet and she was expecting for that in the fallowing days. Ok I explaining her well this, I post all my car in different web site also Craigslist so I getting a lot feed-backs and appointments to look my cars, and that same day I have another appointment at 3pm with a lady to look at the same vehicle (2012 FORD fOCUS)and another people interested for the next day so,not warranty to have it here when she said she going to get that check. She said she can put [redacted] to hold it and not sell it, its going to be a matter of days to get her check.. We are adults and we know if you put money to hold any merchandise, its a promise to buy it or your lose your money. Especially because I told her I have somebody else interested in that vehicle that same day, and the appointment I had to cancel because I told her the car was "SOLD".. 2 days later (February Second, Thursday)I receive a call from her husband or boyfriend.,every Thursday its my auction day in Kalamazoo Michigan so I close almost all day I always back to Fort Wayne and to my place around 4pm to 5pm, we just open a couple hours every Thursday.. so yeah I got that call but barely could understand what he said ( cause that place its loud, you know its a car auction too much noise ) so I told him I call him back when I get back to my lot, honestly I totally forget to do it, to me its one of the busy days..He call me back around 6pm, we wait for them, when they were here, her husband/boyfriend. he told us they have bad news cause they won't be able to buy the car because the check from the insurance company its not for the sum they were told or promises and actually their were planning to sue the insurance company.
(THOSE WERE HIS WORDS NOT MINE, AS YOU SEE NOT LOAN BACK WAS INVOLVE SINCE THE BEGINNING LIKE SHE CLAIM ON HER COMPLAIN) Another lie from her its when she said I ask her to put money to hold it, why, because I'm a seller and as a seller I prefer to sell my car to the firths person with the money on hand specially for the exposure of my vehicles I have on the web, you never know, I don't like to put my cars on hold. With some exception, She was the one who said I put [redacted] and you can hold it for me, I ask my partner about he was agree to hold it, she told us not later than Friday she will get the money. We shouldn't give her back nothing because for her I didn't sold the car and I lost potential buyers. Like I said before we are all adult and they know what they were doing. THAT MONEY ITS NOT REFUNDABLE. even that I gave her back [redacted]
NON ONES GOING TO REFUND ANY MONEY WHEN ITS PUT IT TO HOLD A VEHICLE..
I DON'T UNDERSTAND THE REASON OF THIS COMPLAIN BUT, THAT'S THE RISK WE TAKE ALL BUSINESS SOME PEOPLE ALWAYS TRY TO TAKE ADVANTAGE OF ANY SITUATION ON THEIR BEHALF. THEIR AREN'T VICTIMS THEY DID A BAD DECISION BECAUSE THEY TRY TO BUY A CAR WITH OUT KNOW HOW MUCH MONEY EXACTLY THEY GOING TO GET FROM THE INSURANCE COMPANY

When I gave him the money I explained to him that I was waiting on a check from the insurance and that the bank was financing the rest. So I needed to check in order to get the loan from the bank. He said that that was fine that he just needed some money to show I was serious about wanting to purchase the car. He did not say that this locked me into any kind of contract. As for the discussion with his partner all of that was in Spanish. They had an entire discussion without any translation. So if the two of them discuss that my deposit would not be refundable it was not in English. And for their more at no point in time did he ever take the vehicle off of Craigslist. It was still listed and also still available for show on the lot. As far as him claiming that he did not know I was going to the bank that is a lie. As he printed out documentation for me to take to the bank. I signed a no promissory note nor any type of written contract or agreement. As he continues to say as an adult you would know that someone would keep your money without the transfer of goods I'm not sure how that works. But not all of us are out scamming on car sales.
