Hi ***,My name is Samantha and I am reaching out to you as the current property manager at Stadium View ApartmentsI have read over your complaint, and I want to start by saying that I apologize for your frustrations, and I want to be clear that we want to work with you to come up with a payment
plan that works for you to pay off the monies owed on the lease contract that you signed with us on We are glad to work with you to ensure this does not cause any further strain on you, and I encourage you to contact our office by calling *** to work this out.Regarding your complaint that you were unaware that you signed a legally binding lease contract with us, I want to walk you through exactly what you signed when you moved forward with signing the leasing documents online via our websiteWe understand there is potential for confusion between filling out an application for an apartment online, and then signing an actual leaseWe take great care with our online leasing process to ensure that each individual document that you apply your electronic signature to (or ESA) clearly states that it is a legally binding documentWhen you logged in to our website, you were prompted to create an account and accept the terms and conditions of moving forward with signing your leaseYou started off by signing the rules and regulations, rental qualifying guidelines, housing application, tanning addendum, and lastly the housing contractIn order to apply your ESA to these documents you need to click a box that says 'Apply ESA Here' on each and every individual document - additionally, after clicking 'apply' it asks you to verify that you do want to do this before proceeding and applying the signatureYou then need to select 'Accept' before moving on to the next documentThese checks are in place so that it is clear you are signing legally binding paperwork.The lease contract itself, too, states in all capitalized, bolded letters at the top 'YOU ARE SIGNING A LEGALLY BINDING DOCUMENTYOU ARE URGED TO READ THROUGH THIS CONTRACT CAREFULLY.' Within the lease contract, as well, it clearly states that you have hours from the time of signing in which you must submit written notice to cancel the contract at no penalty, or you are bound to the legal and financial obligations thereinYou applied your ESA to the aforementioned documents via our online leasing portal on On you contacted our office via phone and spoke to one of our consultants, Max, about upgrading your lease contract from a shared apartment to a two bedroom, two bathroom apartmentAt no time during this conversation did you ask about cancelling your lease, and you requested that Max send you the updated documents to upgrade your apartment to a private two bedroom, two bathroom unitThe hours from the time of signing would have been on 8.19.14, but we did not receive written nor verbal notice that you wished to cancel the contract.Our office then proceeded to call and e-mail you on 8.24, 8.25, and about turning in this additional paperwork, and asked about when we would receive your guaranty of resident obligations form (or guarantor form) or when we could expect a deposit from you, as either of these were due within days of the time of signing your lease contractWe received no follow up from you either via phone or e-mail to these attempts to contact youOn our leasing agent, Sara, contacted you via phone to inform you that the days had passed, and while you had not yet turned in a deposit or guarantor form, you were legally and financially bound to the obligations of the lease contract you signedShe urged you to contact our office at your soonest availability to get these things in.Also on 8.27.14, you called our office and asked for the paperwork to the two bedroom apartment to be re-sent to youYou spoke with the leasing manager at the time, Amber, and stated you would be self-qualifying by means of paying a deposit equal to months rent because you yourself made an income equal to three times the monthly rent and could verify this with your three most recent pay stubsAmber asked that you turn in the deposit as quickly as possible, as you were past the deadline to do so.You then called back and spoke with myself, Sam, and stated that you wanted to cancel the contractYou relayed that you thought you signed an application, and that by ignoring our calls and e-mails to you from the 19th onwards that meant you were no longer interested in the apartment and did not want to fulfill the obligations of the lease contractI explained that we had contacted you multiple times and that you were bound to the lease contract you signedYou stated you would not be moving in, to which I relayed that you would need to then re-lease your apartment to another qualified individual before you were released from the contract you signed.On I e-mailed you the options available to you, as you had not yet moved in and missed our designated move in day during the last week of AugustI explained you could pay a deposit or find a guarantor form and then move in and fulfill the lease, or find a re-leaser, or you would be sent to collections for failure to make payment on the contract you signed You called our office back and spoke with me - during this conversation you asked for a hour extension until to pay the monies owed for your first rental installment due on so as to avoid your account being sent to collectionsThis extension was approved via the property manager at the time, Constance.On you spoke with Constance about the ramifications of still not paying rent and being delinquent for the monies owed on your first installmentShe walked you through the impact of collections, that rent would be accelerated and owed all at once, explained that your rental history and credit reports would be negatively impacted, and that your options were to find a qualified re-leaser or pay the monies owed plus a deposit and move inYou did not state you would move in or pay the monies owed, and Constance informed you the account would be sent to collections that weekYour account was sent to collections on 9.12.14, the full sum of which was owed on the contract accelerated to reflect it being owed immediatelyTo date, this balance remains owed at $6,588.00.We took care to attempt to contact you regarding the lease contract that you signed, and clearly documented our efforts to let you know that you were responsible and liable for the obligations outlined in the contractBecause of these clear attempts to contact you, the multiple safe-guards in our online lease process to outline that you are signing a lease contract, not an application, etcyou will remain obligated to pay the amount listed aboveAs I stated, we want to work with you to resolve this, and are happy to put forth a payment plan that works best with your schedule and finances to do soPlease reach out to us at *** at your earliest availability so that we can work towards resolving this together. Applicants have the option to apply for and sign their lease online by going to our website, www.stadiumviewapts.info and selecting the 'Sign A Lease' button at the top of the home pageOnce selecting this, the online application walks you through first creating an account to proceed with and complete the online leasing processOnce your personal information is entered, the individual would be brought to a screen where they are required to acknowledge the terms and conditions of setting up an account to then sign a lease On August 7th, you began the online leasing process and you accepted the terms and conditions and were then brought to the next web page where you can view your personal profile, look for potential roommates, or apply for your leaseYou selected 'Apply Now' and were subsequently brought to the Agreements page where it prompts you to have your drivers license, Guarantor information, and credit card information ready to proceed with signing your leasing documentsBelow this is the following, verbatim, in bold, red lettering: "Please note, successful completion of the Internet based or paper contract process will result in a LEGALLY BINDING agreement between the resident and the community."
Below this is a window with a series of tabs outlining each document in the lease packet, including the housing contractYou then selected what kind of floor plan you wanted to lease, entered some other personal information required for our screening, and you were screened using a standard rental verification, background check, and credit checkIf an applicant is approved, which you were, you are allowed to proceed to the next step in the online leasing process which allows you to view the leasing documents themselvesFor Stadium View, these documents include the Rental Qualifying Guidelines, Housing Contract, Rules and Regulations, and the Tanning AddendumYou then viewed each of the four aforementioned documents in kindViewing these documents does not equate to an ESA, or electronic signatureTo apply your ESA you are required to manually check the box located in the upper right hand corner of each document that says "I have read and agree to this document", and then to proceed with agreeing you are required to enter your passwordYou read through and applied your ESA to the Rental Qualifying Guidelines, Housing Application, Rules and Regulations, and Tanning AddendumAt the top of the housing contract it reads, verbatim, "YOU ARE URGED TO READ THIS CONTRACT CAREFULLY! I do not accept this responseI never completed the lease and never saw what you have described in your responseI received an email after starting the lease stating that I have started a lease but have not completed oneThe email then told me that I could return to a web address to start, stop, or resume my leasing experience at anytimeI never proceeded with resuming and finishing my leasing experienceI was then contacted a couple of weeks after this thanking me for choosing stadium view apartments, I had never resumed any leasing process or done anything with stadium view apartmentsStadium view claimed that they needed additional paperwork for me to finish my lease and move into the apartmentI never finished any kind of lease, nor did I continue to fill out a leaseStadium view apartments has scammed me, taken advantage of me, and destroyed my credit score all for $I can no longer continue college because I can not receive any loans with my credit score, I can't buy a car, I can't even get a low amount credit card to attempt to build my credit score back up thanks to stadium view apartmentsIf this was removed from my credit score, I could move forward in life, it would make such a huge change in my life, and I could pick up school from where I left offMy life has been drastically changed and damaged because of thisCan you please be genuine people and remove this from my credit score so I can attempt to better myself and my life

The emails that stadium view apartments sent to me, prior to the alleged september move in date, stated that I had to complete the following: Guaranty of Resident Obligations: Everyone is required to have a guarantor - which is our verbiage for a "co-signer." They will serve as somebody we can go to in the event that rent is unpaidPlease have a parent or close family friend with substantial credit complete this formIf you are an international student and cannot find a guarantor, this form will not apply to you In lieu of it you will be required to pay a deposit equal to two month's rent
important things:
-Make sure the guarantor initials on the bottom right hand corner of each page
-Make sure the guarantor fills out the form in its entirety
-Make sure the guarantor has this form notarized if they decide to sign it outside of our office
Roommate Profile: We only match you with roommates based on this formMake sure to include your roommates' names (if you have any in mind)
-Fill the form out in its entirety, and sign at the bottom of the page
Opt-In/Opt Out Forms: As stated earlier, you can either choose to accept or decline our renter's insurance packageOnly sign one of these forms, and return back to us
Concession Addendum: For the of the forms please sign under resident twiceThe forms you will need to sign twice are the waived application and administration forms and the $off of September rentPlease sign the $gift card form only once under resident!

Stadium views previous response says that they have attached screen shots of the online leasing process that I had began and completedMy name is not on any of the paperwork that they attached and I never completed that leasing process that they have attachedI did not enter a credit/debit card number or info, never completed guarantor info, or any other agreements asked for on page Again I want this removed from my credit reportThis company has completely taken advantage of me, destroyed my credit, made it not possible for me to receive student loans this year, credit cards, auto loan, and has given me many other hardships

I have attached, again, screen shots of the online leasing process that you began and completed on August 7th, 2014, and our office has sent over copies of your signed housing contract to you and your additional contact on fileThese screen shots are what you would have seen as you went through and applied your information, read through the documents, selected that you wish to sign them, and then entered your password on to apply your ESAOur prior response to your initial dispute outlines the multiple safeguards of online leasing so that applicants have multiple stopping points at which they are reminded that they are signing a legally binding contract, but as stated above, an applicant who wishes to sign online is reminded at the start of the process of the following: "Please note, successful completion of the Internet based or paper contract process will result in a LEGALLY BINDING agreement between the resident and community." After this, you were required to read through each document, agree that you had read it, and apply your password and check that you wished to apply your online signature in order for you to actually sign the documentsAt the top of the housing contract, specifically, is the following statement, verbatim: "YOU ARE URGED TO READ THIS CONTRACT CAREFULLY! This is a LEGALLY binding document that holds you responsible for paying rent on a specific Unit Type within a price range, listed below." These two statements make adamantly clear that applicants are signing a legally binding document
You note that you did not complete your lease agreement when you completed your online lease on August 7th, On the 7th, you completed the rental qualifying guidelines, housing contract, rules and regulations, and the tanning addendumThe housing contract is the legally binding documentIn addition to these four documents are the roommate profile card, concession addendum, and Peak Protection Insurance addendumThese three documents are specific to each individual lease holder depending on the time at which they sign, so we do not offer applicants the chance to complete these documents online Instead, we send these through e-mail correspondence immediately after receiving an online leaseYou were sent these documents via e-mail on August 8th, The roommate profile card is simply a survey of questions about your living habits and styles, the concession addendum would have verified any special leasing incentives you received for choosing to live at Stadium View, and the Peak Protection Insurance addendum give you the chance to accept or decline our on-site property insurance policyThese documents are not legally binding, but instead are addendum to the housing contract, which again, you signed and completed on August 7th,
Our office sent follow up correspondence regarding your lease via phone calls and e-mails on August 8th, August 10th, August 18th, August 23rd, and August 27thOur office received no answer to any of these attempts, and you first notified our office of your dispute regarding your questions with the legality of your online lease on September 2nd, Throughout the entirety of the aforementioned correspondence, we would have been glad to have answered questions about what you signed, what each document entailed, etcWe also would have been glad to have gotten you on our re-lease list in an attempt to find someone to take over your contract prior to our scheduled move in day, however, we received no notification of any disputes with your lease agreement until September 2ndOn September 4th, we placed your account into collections as a skip and accelerated your rent to the total owed under your signed housing contract of $8,We were able to re-lease your apartment starting October 1st, and under the terms of your housing contract, we reduced the amount owed on your account to $680, which is the first installment of rent that should have been paid September 1st
Our office has upheld our responsibilities under the terms of your lease in only attempting to collect on the first $rent installment, and we remain committed to getting this paid off with you in a manner that works with your current financial situationWe understand that this can entail paying it off in installments, and we are happy to negotiate a timeline that works for you to do thisWe encourage you to read carefully through the copy of your housing contract that we sent you, and should you have further questions, always feel free to contact our office at *** and we will work closely with you to resolve this issue as fast as your timeline allowsThank you

I am rejecting this response because:  Hello Sir, In responding to Management of Stadium View Apartment, I do remember the conversation that took place on those dates; however, I also remember commenting to management, that I was in a state of distress, if there was a statement in BOLD print stating: “If you sign here, you will be legally binding and agreeing to the least.” I would not have signed or typed in my name, it’s obvious I over looked that, why would I sign something holding me to pay an entire bill of an apartment not knowing if I was going to move in the place or not, it doesn’t make sense, who would do that?Also, I’m sure other individuals have done the same thing, and for the same reasons, I’m sure others did not see it. In filling out application online for an apartment, one would not be looking for something like that. If I had the “Presence of Mind” to had even been aware of something like a “Binding Contract” for an apartment, that would have been practiced mentally, I would have been aware of something like that happening. Knowledge of an issue such as that I would have had the presence of mind to be aware of an instance such as this and not sign it, if I knew that, I wouldn’t have even taken the time to fill out the application, why would myself or anyone for that matter sign a contract not know if one was even going to move in? That’s giving away free money, it does not make sense.I did not see anything like that; I’m not saying it was not there, I’m saying I did not see it. This is something simple, yet I’m being held to it. This company knows this happens, I’m all but sure they know I made a mistake in not seeing it, they lost no monies, yet they’re trying to get something for nothing, is this not the form of a gimmick?

Hello [redacted],I have attached two documents to this response - the first are screen grabs from the online leasing process which shows how we have checks in place to avoid confusion for applications in terms of signing their lease contract as opposed to simply filling out an application, and the second is a copy of the lease contract that you signed.On the first attachment, the online leasing screen grabs, you can clearly see that the documents are titled Rental Qualifying Guidelines, Rules and Regulations, Tanning Addendum, and Housing Contract. It asks you to apply your ESA to both and then enter a password to accept the documents. Above this it says 'Sign Documents'. The second attachment shows that indeed there is a statement in bold at the top of the housing contract reading 'YOU ARE URGED TO READ THIS CONTRACT CAREFULLY! This is a LEGALLY binding document that holds you responsible for paying rent on a specific Unit Type within a price range, as listed below." These clear checks in the online leasing system, along with the bolded clarification that you are signing legally binding documents shows that Peak Campus makes every effort to be clear that the documents are legally binding.You state that you simply overlooked this and that you did not see this, however in applying your ESA to these documents it indicates to our office that you have read through and agreed to the terms and conditions, and further legal and financial obligations outlined therein. As with any legal documents, by applying your signature it means that you agree and accept the responsibilities and terms therein - these documents in any nature of business are not considered legal after a business or individual asks you "Are you sure?" or "Did you see this?". While we are genuinely sorry for your frustrations, it is not a businesses place to determine if you are, as you stated, "in the presence of mind" to make decisions like signing a legally binding document. Given the above, the amount owed on your account will remain. Our prior response to your initial dispute outlines the multiple safeguards of online leasing so that applicants have multiple stopping points at which they are reminded that they are signing a legally binding contract, but as stated above, an applicant who wishes to sign online is reminded at the start of the process of the following: "Please note, successful completion of the Internet based or paper contract process will result in a LEGALLY BINDING agreement between the resident and community." After this, you were required to read through each document, agree that you had read it, and apply your password and check that you wished to apply your online signature in order for you to actually sign the documents. At the top of the housing contract, specifically, is the following statement, verbatim: "YOU ARE URGED TO READ THIS CONTRACT CAREFULLY! This is a LEGALLY binding document that holds you responsible for paying rent on a specific Unit Type within a price range, listed below." These two statements make adamantly clear that applicants are signing a legally binding document.
You note that you did not complete your lease agreement when you completed your online lease on August 7th, 2014. On the 7th, you completed the rental qualifying guidelines, housing contract, rules and regulations, and the tanning addendum. The housing contract is the legally binding document. In addition to these four documents are the roommate profile card, concession addendum, and Peak Protection Insurance addendum. These three documents are specific to each individual lease holder depending on the time at which they sign, so we do not offer applicants the chance to complete these documents online. Instead, we send these through e-mail correspondence immediately after receiving an online lease. You were sent these documents via e-mail on August 8th, 2014. The roommate profile card is simply a survey of questions about your living habits and styles, the concession addendum would have verified any special leasing incentives you received for choosing to live at Stadium View, and the Peak Protection Insurance addendum give you the chance to accept or decline our on-site property insurance policy. These documents are not legally binding, but instead are addendum to the housing contract, which again, you signed and completed on August 7th, 2014.
Our office sent follow up correspondence regarding your lease via phone calls and e-mails on August 8th, August 10th, August 18th, August 23rd, and August 27th. Our office received no answer to any of these attempts, and you first notified our office of your dispute regarding your questions with the legality of your online lease on September 2nd, 2014. Throughout the entirety of the aforementioned correspondence, we would have been glad to have answered questions about what you signed, what each document entailed, etc. We also would have been glad to have gotten you on our re-lease list in an attempt to find someone to take over your contract prior to our scheduled move in day, however, we received no notification of any disputes with your lease agreement until September 2nd. On September 4th, we placed your account into collections as a skip and accelerated your rent to the total owed under your signed housing contract of $8,160.00. We were able to re-lease your apartment starting October 1st, 2014 and under the terms of your housing contract, we reduced the amount owed on your account to $680, which is the first installment of rent that should have been paid September 1st.
Our office has upheld our responsibilities under the terms of your lease in only attempting to collect on the first $680 rent installment, and we remain committed to getting this paid off with you in a manner that works with your current financial situation. We understand that this can entail paying it off in installments, and we are happy to negotiate a timeline that works for you to do this.
