Ms. [redacted], RE:  Revdex.com Complaint ID [redacted] The complainant did sign up to take a 7 week series of classes in March of 2014.  The schedule is published and all the students were aware that one of the sessions would be held on Easter weekend.  The first hour of the...

first class is devoted to a safety lecture, store guidelines, and what to expect in the class.  A copy is attached.  After the lecture is given, students are required to sign a waiver that states they agree with the safety and store guidelines.  If anyone has any reason that they cannot agree with this waiver, they are offered a full refund before class begins. The syllabus (attached) that is given with these notes show that the class is very linear.  If a class is missed, the class must be made up before the next class or the student will be too far behind to catch up.  This is very emphatically stated when the student signs up and again before the class begins  The complainant did sign a waiver but picked up the waiver for the 3 week class.  I crossed out the three and wrote in a seven to indicate which class she had taken.  A copy of this waiver is attached. The complainant states she dropped out because she was going to take a trip over the Easter Weekend.  But Easter in 2014 was on April 19 and 20th which would have been week 6 of the 7 week class and not week #4 (April 4) which would have been the next session.  Since March of 2014 is well over a year ago, I do not remember why she decided to drop the class after the 3rd session instead of going through to week 6.  However, when a student has problems keeping up with the homework or has to miss more than 1 class, I usually give them the option of postponing until the next class and she agreed.  I did tell her she needed to take the class before the end of the year even though I usually only allow students one opportunity to resume a class or forfeit the class fee.   She did not attempt to schedule another class in 2014.  The class schedule is on-line and is on printed brochures in our store and available to anyone who wishes to see the schedule. On the document called Class Guidelines, I wish to draw your attention to items # 11, 12, 27.  All students receive this document and are expected to read it before signing.Even though she had gone beyond the time limited that she agreed to, I was willing to let her take the class again this fall – well over a year after she dropped out.  She had already used her class allowance of $30 and had taken the first three sessions.  Because the first three sessions are the most intense, requires additional staff, and a great deal of overtime for the teachers, I usually charge $75 to retake #1 and #3 plus $40 to retake #2  But since she was so upset, I took the cost down to $60.  She agreed and signed up for the class that begins on Sept 12.  I only allow 6 students per class so that every student gets the full attention of the teachers.  The fall sessions are usually filled by this time and that is true for the Sept 12 session.  Now I find that she had no intention of taking the class and had in fact kept a paying student from the spot.  I find this vindictive and fraudulent especially since I was willing to let her take the class even after the time deadline. Since she has already taken the first three classes which add up to $195 and used up her $30 glass allowance bringing her total to $225, I do not believe that her suggested settlement is realistic.  I am also rescinding the offer to let her take the class again.   I am distressed that she is unhappy with the situation.  However, as an adult, she is in charge of her own decisions and must accept the consequences especially when she was very clearly told in advance of the results of the decisions. Thank you for the opportunity to address this situation.  Please let me know if I can offer any additional information to help clarify the matter. Sincerely,[redacted]

I am rejecting this response because:
I tried to schedule time to make up the class.  The owner was the one that suggested I take the next class because her schedule was too busy to make up time with me.  The next class was only offered on Tuesday rather than on Saturday and I had too work.  I left messages about the oher classes but my calls were never returned.  I have attached a copy of the online Calendar for that next class that shows it was not offered on Saturday. My money has basically been stolen with no return for services.  Once again, I agreed to go to the next class on HER suggestion and they cancelled the Saturday class.  I was NEVER told I would have to pay extra fees or that I had to take the class before the end of the year.I am trying to be very professional regarding this issues and it is sad that the owner is resulting to insults regarding my adulthood and behaviour.  She offered me one solution and then didn't fulfill that obligation and is now offering me that same solution at a higher cost.  I'm not even sure this "bait and switch" tactic is legal and will pursue action under the Consumer Protection Agency if she still refuses to provide a refund since she has refused to fulfill her obligations for services.
