I submitted a claim with the insurance back on October for damaged to our house roof due to extreme weatherI did not receive a call from the insurance after I submitted the claim I needed to call them back and ask status for the claim.They fowarded me to the adjuster to make an appoinment for them to go and inspect my houseThe adjuster went almost weeks later to my house from the original date back on October.After adjuster went to my house I did not receive a call from insurance again, I called them back after two weeks without any information, at that time they informed that the claim was closed and they will foward me a check to cover the damagesThey submitted a check for $and the estimates were got were beyond that amountI called insurance back several times no answer at all, also I faxed the cheapest estimate for $and also no response from insuranceI can not believe I have not receive any response at all at this timeAt this point I am very discourage with the service I been received from my insurance companyWe pay our bill every month on time

Thank you for your letter and interest in trying to resolve this matter regarding damages to [redacted]'s manufactured home. [redacted] has a mobilowner policy with us. On December 15t 2015, [redacted] notified this office of claim for water damages to their dwelling Insureds were in their...

daughter's room and noticed the carpet floor was saturated. They discovered that the vinyl flooring in the hall and guest bathroom is damaged as well. Insured believes there is a leak behind the shower wall but not too sure. The walls appear to be caved in per insured. We advised her to contact a plumber to determine where water is coming from and repair if busted/leaking pipe. We told [redacted] that the claim would be assigned to an adjuster to inspect the home. On December 2nd 2015, adjuster [redacted] conducted his inspection surrounding this matter. He found that the leak was caused by a faucet to the bathtub that leaked when the faucet was turned on. It was discovered that there was damage to the drywall and flooring in the bedroom adjacent to the bathroom. Additional damages were found to the bathroom flooring around the bathtub area_ The inspection of the underside of the dwelling showed water damage and mold The insured indicated that they reported the claim to us as soon as possible after discovering the damages. :an. 8. 2016 0:53AV                                     ... 7491:: ·            Page 2 The adjuster's inspection of the drywall, flooring and carpet to the interior and exterior of the dwelling indicates that the damages were not caused directly, suddenly and accidentally by any peril. The inspection revealed the damages were not caused suddenly. The mobilowners policy states the following. 1)             Part I, Physical Damage, Section a 1 .b, Broad Form Comprehensive Coverage, as amended in the TX 005 endorsement, states the Company will pay for loss of or damage to the property described in subparagraphAl, Mobile Home, and A.2., Adjacent Structures and Equipment, occurring during the policy period when such loss or damage is caused directly, suddenly and accidentally by any peril except collision. For purposes of this coverage, no peril described in paragraphs (5) through (9) of the coverage B.1.a. shall be considered as collision; but damage resulting only from humidity or condensation, leakage of rain, sleet or snow shall not be deemed direct and accidental and is not intended to be covered under this paragraph. The inspection observed that the damages were not caused directly, suddenly and accidentally by any peril. The policy does not have any provision that considers damages as direct, sudden and accidental if reported to us by the insured upon discovery of the damages. The damages themselves must be caused directly, suddenly and accidentally by any peril for coverage to apply. 2)             Part El, Exclusions, Section A.5 states: This policy does not apply under any coverage for damage which is due and confined to defective manufacture, freezing, wear and tear or mechanical or electrical breakdown or failure, unless such damage is the result of other loss covered by this policy. Repairs or any replacement to correct the cause of the water damage are not covered. Repairs to the appliance, faucet or water line that leaked are not covered under the mobilowners policy. 3)             Part III, Exclusions, section A.3.d. (TX 005 Endorsement) states: This policy does not apply under any coverage for loss caused by, resulting from, contributing to or aggravated by any of the following: smog, deterioration, rust, corrosion, decay Part, rot, wet rot, dry rot, bacterium, or fungus, including but not limited to mold or mildew, or a protist, including but not limited to algae or slime mold, or a chemical, matter, or a compound produced or released by wet rot, dry rot, a bacterium, a fungus, or a protist, including but not limited to toxins, spores fragments, or metabolites such as microbial volatile organic compounds. Mold, mildew, rot, decay, deterioration, etc. or damage due to any of the items listed in this policy exclusion is not covered. The mold observed by the adjuster is not covered under the mobilowners policy. Therefor; regretfully, we must inform you that we affirm our decision in our letter to the insured dated December 21, 2015 that we must decline payment for the damages to the bedroom, bathroom and underside of the insured's home caused by the faucet leak in the bathroom.

that our system had mistakenly change the Territory rating for their home. Which resulted in increasing your policy premium. As a result, we notified the customer on September 27, 2016 of the error and that a refund amount for $331 would be returned. Unfortunately, we were not able to speak with them, but did leave a voice message on their answering machine of the adjustment and to please return our call. In addition, we re-quoted their policy and were able to reduce the annual premium to $638.00. This also will be communicated with our policyholders.

We received your letter regarding a complaint filed by our insured with your offices. The customer states that he filed a claim with us on Sep. 29, 2014 and was contacted by our claims representative on Sep.30, 2014. An appointment was scheduled for Thursday, October 2, 2014 for the adjuster to meet the insured and inspect the damages.
Our goal is to inspect all homes with damage as soon as possible. The original inspection time of October 2, 2014 was agreed upon by the insured and the claims representative on the first contact. We apologize for any inconvenience to the insured. The insured did contact a water restoration service and their bill as well as a check for the damages was sent to the insured. As part of our service, the insured had a question regarding our payment and the adjuster is taking steps to resolve the issue.
We believe that we acted to inspect the home and pay the insured for their damages in a reasonable time frame and manner.
If there are any further questions, please contact us. I will be forwarding the insured a copy of this letter.
