As I stated in our first response, we do not have an independent recollection of the conversation with Ms***. Therefore, we cannot confirm 100% what was told to her when she contacted our offices concerning the status of her car or her wishes to not pick up the vehicle. What we can offer is it is not company policy to simply tell a customer that it is okay for him or her to not pick up a vehicle without explaining the consequences of such non-action. We would also like to direct your attention to the attached documentation. The first is the Vehicle Report issued by the Modesto Police Department that confirms her vehicle was impounded by the law enforcement agency and requested to be towed by our company. The second document is the Notice of Lien Sale outlining the total charges she would incur if her vehicle was not picked up by the date indicated on the Notice. Please note the Vehicle Report and Notice of Lien Sale indicate the same address. Therefore, Ms*** was fully aware of the charges pending against her vehicle Third is a copy of our Towing Fees and Access Notice, which is posted in our front lobby as required by Vehicle Code. As it emphasizes, the owner is responsible for any outstanding balance due after sale of a vehicle pursuant to California Civil Code Sections to inclusiveIf the outstanding balance is not paid in full or a settlement negotiated, the file is transferred to a collection agency for further action. Ms*** is welcome to contact our offices to discuss a possible settlement so this matter may be resolved in its entirety. Sincerely,*** ***

I am rejecting this response because: the police did place a hold but all I needed to do was go pay them so I can take it outMy main concern is the fact that when I called the tow they did not tell me about any feesLike I said In my first letterI thought this was already taken care of because whoever I spoke to last year when I called they made it seem like everything was fine and that I didn't have to worry about anything because I told them to keep the car$2,is not something to forget to mention or to even give the correct information about if that's their job

We were requested by the Modesto Police Department to tow the customer's Audi AS because it was found parked on the street without license plates. When towed, the police department placed a day hold on the vehicle, which means we cannot release the vehicle to the registered
owner of record until after days from date of impoundment. After hours from our taking possession of the vehicle, we are required by law to place a lien on the vehicle. Both the police department's vehicle report and Department of Motor Vehicles' lien documents indicated the customer as the registered owner of record of this vehicle. (Apparently, she had purchased it from another party one year prior to this incident.) Under California law, the registered owner listed with DMV is responsible for all towing and storage charges unless the vehicle has been sold and a release of liability has been filed prior to the date the vehicle is impounded. We do not have a specific recollection of the customer contacting our offices but if she had, she would have been advised of her responsibility in paying the initial $towing charge, $per day storage charges and $lien fee less the amount received when her vehicle was sold after lien

We are denying any damage done to Ms. [redacted]'s 2008 [redacted] Focus as a result of our towing the vehicle on March 26, 2018.The 2008 [redacted] Focus is a front-wheel drive vehicle as indicated on [redacted]'s Towing & Service Manual attached hereto for reference.  As noted on the attached photos,...

the vehicle was improperly parked front-end in, meaning our tow operator needed to pick up the vehicle from the rear.  Therefore, as the truck dispatched to this call was a wrecker and not a flatbed, the vehicle required dollies placed under the front wheels to properly transport it as indicated also on the attached page from [redacted]'s towing manual.  Because we had no access to the interior of the vehicle to place it in neutral, if our driver had not used dollies and we had towed it from the rear without placing dollies under the front wheels, the [redacted] Focus would have been dragged the 6.5 miles to our yard resulting in severe transmission and tire damage in addition to the complained front end scraping.  We cannot explain nor substantiate the registered owner's claim of an alleged oil leak as our operator did nothing to the undercarriage to cause such. The only area on which we can agree with in the registered owner's complaint is the fact that Ms. [redacted] did in in fact park her 2008 [redacted] Focus in a clearly marked no parking zone, thereby interfering with the entering to and exiting from of residents and visitors from the apartment complex.  Therefore, the blame that "If he hasn't come back to get my car this would of not happen" is clearly misplaced. As always, we thank the Revdex.com for assisting in maintaining the integrity and honesty of businesses providing services to the public.  If you should have any questions or require further information, please do not hesitate to contact us.Sincerely,[redacted]
STANISLAUS TOWING SERVICES

Review: The first vehicle I ever purchased was from a Man out in Sanjose, I never got to smog it or do anything because it broke down. It was sitting at my sisters house where it got towed from and I immediately contacted the tow company to let them know that I will not be taking it out and that they can keep it. They said that was fine, didn't ask for the keys or anything. Now I'm receiving a bill of $2,360 from the collections office stating that I need to pay. I called Stanislaus tow to speak to the owner because they lied to me and didn't tell me I had to 'release' my car to them or sign anything. It's my first vehicle ever purchased and I was completely unaware that there is a procedure I must follow in order to release ownership. If they had let me know I would have done it, instead they said I was fine when I called. Soon after I received a different bill from another tow they made, but by that time it'd been months since I released it. I'm assuming they sold the vehicle and towed it once again. I contacted them telling them that I hadn't had the car for almost a year and they said I wouldn't have to worry about it because I'm only an 'Interested Party' and that the original owner I bought it from would be responsible because I never smogged it or anything. I'm confused about everything they've been telling me and I got lied to and they expect me to pay for something I thought was already taken care of.Desired Settlement: I would have paid to just tow my car out if I knew this was the case and price. I just didn't tow it out because it was my second tow and I didn't want to deal with that car anymore because I had bought another one. I shouldn't have to pay for the entire tow because what they made me believe is that I had released it the next day it got towed. They misinformed me and want to Bill me for $2,360 that is injustice for lying to me.

Response:

We were requested by the Modesto Police Department to tow the customer's 2001 Audi AS because it was found parked on the street without license plates. When towed, the police department placed a 30 day hold on the vehicle, which means we cannot release the vehicle to the registered owner of record until after 30 days from date of impoundment. After 72 hours from our taking possession of the vehicle, we are required by law to place a lien on the vehicle. We do not have a specific recollection of the customer contacting our offices but if she had, she would have been advised of her responsibility in paying the initial $210.00 towing charge, $38.00 per day storage charges and $70.00 lien fee less the amount received when her vehicle was sold after lien.
