Stanley Caplan Wholesale Furniture

Review: On 9/24/13 we place an order with Stanly Caplan an agent of [redacted] Furniture, our purchase order [redacted]. Our Purchase had a specific time/delivery requirement which was reflected on our purchase order. **. Caplan & [redacted] accepted our order which was paid for in advance on 9/25/13 check # [redacted] in the amount of $3510.00 the check was made out to [redacted] c/o Stanley Caplan.The goods failed to on time arrive as promised and our client refused delivery. [redacted] picked up the goods on RMA [redacted] on or about 11/16/13. We were advised by [redacted] that a 25% restocking fee would apply. To date we have not received a refund from [redacted] or **. Caplan. We have another order with [redacted] that was placed thru **. Caplan our purchase order [redacted]. This order has never been delivered. This order was also paid for in advance check # [redacted] dated 10/10/13, in the amount of $1053.00.Desired Settlement: Refund of $4563.00

This is a response to your letter of 3/13/2014 and your follow-up letter on 3/23/2014. Here are the facts:

[redacted] placed their order for eight barstools from [redacted] Furniture on September 24, 2013. [redacted] shipped the order on October 14, 2013 to their location at [redacted], NJ [redacted]. [redacted] received the barstools in pristine condition. However, their customer cancelled the order with them and did not accept delivery. [redacted] wanted to return the stools, but we do not take cancellations or returns once an order is shipped. On their own, they shipped the stools freight collect back to [redacted] in California.

Subsequently, they ordered a table and three chairs on October 7, 2013. The table was not in stock so the complete order could not be shipped.

[redacted] from [redacted] started calling me several times a day, early in the morning and late at night. Initially, I took his calls until I received a certified letter from [redacted] date February 6, 2014. I gave the letter to my lawyer, [redacted], and from that point on, I did not respond to [redacted]'s calls nor emails which became increasingly belligerent and threatening as the weeks went by. My attorney called [redacted] several times but never received a return call.

My resolution is the following:

**. [redacted] owns the eight stools whether they are in his location or in [redacted]'s warehouse. If **. [redacted] sends me a notice of cancellation on the second order (PO #[redacted]), I will refund the money in the amount of $1,053.00. Conditionally, I will do this if all the nasty and negative comments he posted on the internet are removed.

It is unfortunate that **. [redacted]'s customer cancelled their order for whatever reason. But, it is not my problem and have no other message to convey.

Lastly, I have been in business since 1970 and never had a formal complain against my name (that I know of).
