Stanley Martin Homes Reviews (%countItem)

Poorly built. We have defected cabinets in the kitchen, defected flooring, painting peeling from the doors, marks on the granite countertops that won't come off. We'll go through the warranty and see if they repair it. While building the house, the builders left trash everywhere outside and inside. The place was a dump. There was leftover food inside the house, chips crumbs inside the kitchen drawer. It was disgusting. However, my point is that when you move into a brand new home, everything should be in pristine condition. We pay for new not defected stuff.

I was in process of purchasing a home from Stanley Martin Homes (formally known as Essex Homes). On Wednesday, June 17th, 2020, I was at my final walkthrough, when the builder *** became very irate and disrespectful, after I asked him a question about the floor because it was not cleaned as he said it would be during the initial walkthrough. After telling me (as he did during the initial walkthrough) the cleaning company gets paid 60.00 and they don't usually do a good job, he proceeded to irately say (in the presence of my mother and step-father, as well as father via FaceTime) "if you are not satisfied with the house you don't have to purchase it, better yet, the deal is off, this is my house, get out". I have never ever been treated this way because I wanted to be sure that things were properly done prior to making a purchase, at any business. Because the situation was handled in such a manner and I was told that I could no longer purchase the house, I walked away as I was told to do. I felt threatened by him and I was emotionally distraught and I still am presently. I can't help but think because I am African American that I was treated unfairly. Stanley Martin has stated that they will not refund me my earnest money as requested by my realtor, her broker, and myself.

Desired Outcome

Refund Earnest Money 1000.00 Returned

Stanley Martin Homes Response • Jun 29, 2020

Stanley Martin Companies is committed to the letter and the spirit of equal housing opportunity.

We dispute the characterization of the conversations cited, and add that the employee referenced, who had no ability to modify a written real estate contract, no longer works for Stanley Martin. The homebuyer entered into a binding contract and chose to default of their own accord. They are liable for the damages and carrying costs of their failure to close per their executed sales contract.

(The consumer indicated he/she DID NOT accept the response from the business.)
At the time the builder *** called off the contract, he was representing *** there was no other representative present to dispute the matter. The builder stated that the agreement was off and I was not allowed to complete my walk through at the scheduled time. Therefore, *** breached the contract. The contract was verbally voided by the builder. I will move forward with seeking legal representation. Thank you.

BEWARE - ESSEX HOMES N/K/A STANLEY M HOMES DOES NOT WARRANTY THEIR HOMES. WE FOUND MOLD IN OUR HOME PRIOR TO CLOSING, WHICH THEY CLAIMED THEY TOOK CARE OF. NOW THAT WE'VE CLOSED AND HAVE LIVED IN THE HOME OVER A YEAR, WE'VE DISCOVERED MOLD THROUGHOUT THE CRAWL SPACE AND THEY REFUSE TO FIX/REMEDIATE THE PROBLEM BECAUSE THEY SAID WE'VE BEEN IN THE HOUSE MORE THAN A YEAR. YET, THIS ISSUE WAS WAS BROUGHT TO THEIR ATTENTION BEFORE CLOSING.

PLEASE THINK TWICE BEFORE BUILDING A HOME WITH THIS BUILDER. I WISH I HAD LISTENED TO THE OTHER CUSTOMERS REVIEWS BEFORE BUILDING WITH THEM. VERY DISAPPOINTED CUSTOMER.

NEVER AGAIN WILL I BUILD WITH THIS BUILDER. RUN WHILE YOU STILL CAN!

--
We contracted with Essex Homes in 2017 to build our home in Grantham Subdivision, which is located in Harrisburg, NC. We closed on the home on May 15, 2018. Before we closed, we hired an inspector to inspect the property. After the inspection, our inspector notified us he found a growth in our crawl space, which he stated was either mold or could turn into mold. Upon identifying this issue, it was brought to the attention of the Grantham Building Superintendent and his Supervisor. In order to get us to close we were told remediation work was/would be performed. A company of the builder's choice (Killingworth) was contracted to do the remediation work. The work was performed on May 16, 2018, which is the day after we closed. At the time of our final one year inspection, we didn't think to have the crawlspace re-inspected because we assumed the work would still be under warranty, as well as the fact that the builder assured us the mold/remediation was taken care of. After giving it some thought, we decided to have the crawlspace re-inspected just so we could have peace of mind. We called the first company whom our realtor had hired to do the initial inspection and they found mold. We then contacted several other companies including Killingworth and they have all confirmed mold is present and is in the crawlspace. In fact, upon re-inspection by Killingworth, we were advised that the previous work was a temporary fix and now the mold has returned in most of the crawlspace. We were told by these companies that the mold remediation would cost between $6k and $14k to remediate the mold and take care of the issue. In fact the company whom the builder initially hired, Killingworth stated: "Signs of previous (staining) and current growth consistently seen throughout crawlspace. Barrier is disheveled and poorly installed. Standing water underneath front/right section of front." We have contacted Essex's Warranty Department and they claim it is our responsibility to fix the problem since we've been living in the house longer than a year. Per Essex, "Any deficiency in workmanship would be covered in the first year of your warranty" and they further state "They are contract documents concerning mold which were presented to you. You will find in these documents that mold can reoccur if conditions are favorable. The crawlspace is an unconditioned air space and Essex has no control over environmental conditions. Fungal growth is not covered under the QBW warranty. We must respectfully decline your request for warranty coverage. This is certainly not fair to us as it was discussed and brought to the builder's attention prior to us closing. A Mold issue should be the last thing we should be concerned with in a newly constructed house. On May 19, 2020, I left a voicemail for the Warranty Manager (Randy S), who has yet to personally return my call. Essex Warranty Dep't did send out an area service manager and after four days of no response, I recontacted Essex and was told: "We wanted to be sure wall penetrations were properly sealed. Tommy found that the pipe penetrations were sealed and not leaking" and as such denied our claim. There was no mention of the presence of mold or any type of mold inspection being performed. Again, per multiple inspections there is a safety and health hazard with the mold present which can cause the spores to enter our home from the crawlspace. We love our home and consider it an investment and are looking for help to resolve this matter in an amicable manner.

We have had many warranty problems and Essex's solution is to ignore me and my complaints. I got an email today--attached and was told that my 90 day
The reason you do not have a signature is because Warren never asked for it--he knew how unhappy I was with the warranty efforts made by Essex. Your designer recommended a wood floor that cannot handle any w***r on it for our kitchen area---the floor is frankly just the wrong product for that room--she should have known this--further some of our wood floor is buckled because of a plumbing leak from the kitchen sink but no one from Essex has stood up and done the right thing. Many homeowners out there are unhappy with Essex--hopefully you are aware of that.

The whole idea of sending me an incomplete warranty repair list and then closing out our file is ridiculous. Apparently the attitude is we got your money at closing and that's when the concern for your client ended. Warren is a very nice fellow but completely inefficient and unable to get things complete. Not sure what any of the notes mean on my original list but it really doesn't matter because Essex is not standing behind their product.

I only wish I had a way to contact someone with some integrity at Essex. For 46 years I have worked in construction and never have I ever tre***d a customer of ours like this. So many little things are wrong at my house but somehow just don't make it to the "warranty" level. I wish I had the funds to force you in court to actually service your warranty; instead I will get the items fixed myself rather than deal with Essex. We plan on ripping up the entire wood floor this spring and putting down something that is appropri***; the tile in the master bath will come up next and again this time the workmanship will be correct before I pay them a dime. The back porch that doesn't drain at all will also be repaired this summer. The cracked concrete on the front walk will be repaired this summer also. Minor things like the saw cuts in the driveway not be properly cut will be fixed this summer also. The big sign in the front yard will let everyone who drives by know exactly why there is a dumpster along the street and more construction activity at a finished house.

Am I angry --perhaps but disappointed that your company does not understand their responsibiliites.

Stanley Martin Homes Response • Jan 21, 2020

Essex Homes appreciates our customer's feedback and the opportunity to respond.
The Charlotte Production Manager spoke with the customer over the phone today, on 1/21, to review the customer's outstanding concerns. After discussion, Essex Homes will be scheduling a meeting with the customer on-site to as and review 4 of the items in question. All 4 items will be reviewed, assessed and responded to accordingly, at minimum to the warranty standards as stated in the contract and supporting documents. Essex Homes often goes above and beyond for our customers and we hope that we can bring this to a resolution through our award winning, nationally recognized Charlotte Warranty Department.

Essex Homes agreed to build a home on my lot and has now refused to stand by our agreement
In mid-May, I was contacted by Essex Homes, Patrick Bukszar, via my real estate agent (Meybohm Realty) and was offered a proposal to build an Essex Home on my 1 acre lot in Mount Vintage Plantation, SC. I accepted their offer to build my retirement home. For the next 2+ months, I communicated with Patrick at Essex Homes through my realtor, and chose the house plan Katherine (my 2nd choice first choice was Clifton). discussed all changes and upgrades, agreed upon the price quoted by Patrick with additional amount to be determined once I visited the Design Center to customize and upgrade, and finally made an appointment to meet Patrick and my realtor on the site on Tuesday, July 16. We were to determine house placement, finalize the formal contract, and write a check for earnest money. On Sunday evening, July 14, at 9:11pm, I received an email from Patrick that said "I regret....." Essex will not build your house . He also said.." I am going to PASS on this offer....." How can you pass *** something that YOU offered????
Less than 48 hours prior to beginning, Patrick advised he would not honor our his word. Patrick also said later that Essex does not build custom homes this is not a custom home it is one of their home plans offered in the same community just down the street! The only changes or customization would be the ones offered to anyone building the home by going to the design center.
Patrick insinuated that Essex was to cease building homes in Mount Vintage. He said that they had to sell their spec homes already in place before moving forward. I spoke with the construction superintendent, Eddie, on Saturday July 20 and he knew nothing of stopping construction. He stated he had about 80 more homes to build and he planned to be very busy in the next few years. He even thought Essex was to purchase more lots in the neighborhood.
I contacted the CEO and owner of Essex Homes, Karl H, who was less than empathetic. He said he would not build our home or honor the verbal agreement that we had with Patrick Bukszar.
1. We believed we had an honest commitment from Essex Homes
2. Essex already has a commitment in place for purchasing the spec homes.
3. The Essex literature and videos all profess truth, reputation, quality and integrity to name a few of the qualities they claim to exhibit. I have only seen dishonesty and a "catch and release" program. This was to be our retirement home - the last one to build and move in to. We had already begun preparations for moving, and decorating. etc. It is baffling why a company would risk their stellar reputation and decline a sale for an unknown reasons..

Desired Outcome

I would like Essex Homes to honor their commitment to us -- to build our home on our lot in *** Plantation, SC in a timely manner. To begin construction as soon as possible within 4-6 weeks. and complete as all of their homes are finished and not delayed. I would prefer to have our 1st choice of their plans - the house plan named ***. I would settle for 2nd choice the ***, if absolutely necessary. We had planned to move in to our new home the first of March, 2020 or earlier.

Stanley Martin Homes Response • Jul 26, 2019

Essex Homes was approached by the complainant in mid-May 2019 regarding the possibility of building them a home on a lot they already own in the *** community in ***. Please note that it is outside the normal Essex Homes building process to build on an individually owned lot. Essex Homes normally builds on lots they either own and/or they purchase through a developer. Currently Essex has 81 total lots under contract with the developer in ***.
Patrick B, the General Manager for the *** market, participated in several email conversations with the complainant through their *** Realtor ***. These conversations were to determine if Essex Homes would make an exception to this policy. Throughout this discovery process, the complainant requested a floor plan no longer offered, as well as several custom options and personalized requirements that Essex does not typically do, such as a four car garage and a particular septic system. To this date, Essex and the complainant have not finalized any site conditions, plan options, or custom option pricing. We also do not have a house layout on the lot or quotes from any site contractors.
After much deliberation, it became evident that Essex Homes would not be able to accommodate their needs within the price range desired. Unfortunately, as a true production builder, Essex Homes made the decision to not pursue building a home on an individually owned lot in ***. Therefore, Essex Homes did not enter into a contractual agreement with the complainant.

Customer Response • Jul 31, 2019

Essex Homes certainly has a talent for redirecting the truth!
1. In March 2019 I inquired if Essex homes built on private lots and was advised that they do not. Ok, fine, I began negotiations with custom builders in the area
2. In mid May Essex called ME! With my realtor involved, Patrick B made the proposal to build one of their models on my lot. He even suggested the Katherine model with which we agreed. :(as my 1st choice was not available)
3. To clarify what we could and could not do on the Katherine we shared several emails regarding the options. Patrick advised if each item was a yes or a noLine by line.
4. The next email, Patrick quoted a price with all current, applicable items and advised the remaining items such as cabinetry and flooring would be determined by a visit to the design center.
I fully understood that a 4th garage bay was not availablethat was one of the line items.

To blatantly lie and say that I contacted Essex in May to build off-site is wrong ! As far as the options, I was inquiring about options that ANY BUYER would ask and perhaps be approved. To insinuate I was demanding and unreasonable is again a false claim. I have the emails and a witness to prove the circumstances as originally presented.
Why can't Essex Homes admit they made a gross error in judgement and apologize for the complete lack of regard and also that they made a huge mistake in offering to build my home? That perhaps they were searching for. "Any Sale" in MVP to keep the project viable?
It was at my expense of time, effort and money that Essex Homes has committed this egregious action. I definitely do expect something more from them than a completely false presentation of "their side". Where is the integrity of which Karl h*** professes? I am deeply offended and feel my own integrity has been sullied. I expect nothing less than the truth and demonstration of decency from Essex Homes.

I was having a recurring issue with my air conditioning unit and I was not satisfied with the response I was getting from the contractor that installed the system. I felt they were doing their best to skirt the issue. I contacted Essex Homes Warranty department and even though the one year warranty period had been exceeded, Tony in that department went to bat for me with the contractor and in the end they took care of the issue. Well done Tony and Essex Homes!

Essex refuse to issue refund and/or sign a mutual release
My house hunting began a year ago..I was introduced to Essex homes and when asked about the type of home I would like I emphasize on a basement home..I was told by the sales man that Essex homes didn't have basement homes..I was shown a model home of the Springfield . The salesman (Paul) promised lots of incentives to get the home built .I signed my first contract with Essex homes a year ago . 27 day within that contract I requested a full refund of my $3500 deposit.
I was told by Essex homes that I cannot get a refund and I would lose any/all money paid .the salesman asked why do I want to cancel my contract I said because I was mislead about Essex not having ANY basement homes ..I didn't understand why I couldn't get a refund when I was well within the 30days (per contract) to receive a FULL REFUND.
Paul then showed me a spec home via pictures & emails in the same community and I told him I would go over the pictures and specifications with my wife and give him a answer .a day or so later I told Paul we would go with the spec home but because I NEVER SEEN THE HOME IN PERSON I wanted the 30 day refund grace period to start from the date of the NEW contract...
my wife and I drove from Florida to South Carolina within 48hrs to look at the spec home and it was not a fit for our family.
I called Paul to notify him that we didn't want the spec home and would like a refund of the deposit paul stated VIA EMAIL "sorry but we cannot issue you a refund please re-read the new contract you signed"
I went over the 2nd contracts and noticed a small change in verbiage. The 2nd contract wasn't identical to the original contract. once again I felt deceived and completely displeased.
In June 2018 (over 30 days since I first signed my contract) I was told Essex conveniently have Basement homes and lots .. I agreed to drive back to South Carolina for a 4th time and check it out. I spoke to a sales lady(Mary M ). I explained to Mary about the past issue I had with Essex. low and behold she had a spec Springfield with a basement being built... before I could finalize the contract
I was sent a revised plan to put a pond directly in the backyard of the Springfield spec home..I refused to sign the revised plan because I didn't want a pond so close to the property being I have 3 small children..
Mary then referred me to Cameron who had a few basement lots available. I chose lot 177 and signed my contract in July 2018. After numerous trips to the design center I asked Cameron (out of frustration ) to just copy and paste the specs from the basement home I seen previously with Mary. I was told theres no way That can be done and had to make an addition trip back to South Carolina ..
Although all of my contracts with Cameron were signed in a timely manner I got hit with the increase in prices that occurred in August 2018. for whatever reason my contract wasn't processed or signed by Essex before the increase ...I had to go back and fourth with Essex as to why I shouldn't have to pay a $3000 increase for 30years when I signed all the proper contracts in time.
I tried to contact Cameron and Ashely for over a week to take care of the issue and didn't get a response ..after several attempt I had to take more time off work and travel from Florida to speak with someone about my issues .....Essex agreed to ONLY PAY $1500 of the $3500 and I was told that I had to basically eat the rest of the cost which I think is completely unfair.
Since I signed the current contract getting in touch with ANYONE at Essex to answer a question was extremely difficult..email after email no one responds and I had to spent lots of time and money traveling back and fourth to South Carolina from Florida. I've sent Cameron several text and emails at times with NO response ...
At this time essex is ignoring all emails and refuse to sign a release.

Desired Outcome

I am seeking a refund and/or to be release from contract.

Stanley Martin Homes Response • May 10, 2019

The purchaser signed a release of contract on 5/1/2019. As Sales Manager I received the release of contract from the purchaser's agent on 5/8/2019. I signed through Docusign on 5/8/19 to release the purchaser from his contract as requested. Essex Homes regrets we were unable to accommodate all of purchaser's request. We have strived to deliver the purchaser a quality home and were a few weeks prior to closing when asked to release the purchaser from his contract. The release has been delivered to the purchaser's agent via docusign.

Very poor service after 4 years in our home we found a leak from our roof causing damage in our attic and ceiling in our bedroom .. got a lot of run around and ver rude customer service that they could not help ... definitely will not buy another Essex home ...poorly built and no help with problems after you buy their homes .. beware they do not care about their customers!

I have on three occasions requested corrective action with water pooling on my side yard from either sprinklers or rain.
When we get rain or when the side yard sprinklers, mine or the neighbors are on we get pooling in the side yard which is excessive. We have complained multiple time via text and email. Text to Adam Ryall on Aug 3rd, 2018. Email to Alice C on Nov 15th and Dec 3rd, 2018 All with Photos. I keep getting the standard reply that it is not an issue if the water is gone in 48 hours, in the last email I received, I was reminded of the warranty documents I signed that state the following. "Your specific property has been graded to allow drainage away from your home and to channel it off of the property". The yard was not graded properly as to channel the water anywhere. It stands until either absorbed into the ground or evaporates. Water will not run from the side yard to the front like all the other homes built around me.

Desired Outcome

We want the builder to correct the grading issue so the water abates to the street as it should.

Stanley Martin Homes Response • Dec 05, 2018

Essex Homes received an email from this homeowner on Monday, December 3, 2018 at 7:18 AM, with the complaint of standing water on the left side of the property in the drainage swale following the area weekend rains. Essex Homes was on site that Monday morning at 9:30 AM to evaluate and found no standing water in the swale. Please note that this was less that 48 hours from the rain over the weekend.

The South Carolina Residential Construction Standards states, "standing or ponding water shall not remain for periods in excess of 48 hours in the immediate area after a rain event, except that in swales which drain other areas, a longer period can be anticipated".

Essex Homes found no ponding of water less than 48 hours after the rain event this past weekend. No corrective action is required.

The drainage document provided by Essex for Drainage clearly states the following in the 1st paragraph. "The drainage pattern for your community has been engineered for the entire community, of which your lot is part. Your specific property HAS been graded to allow drainage away from your home and to CHANNEL IT OFF THE PROPERTY" It is clear from the photo the water is not channeled anywhere. After I had placed the complaint I spoke with the warranty supervisor Tony F and he specifically told my they were going to fix this issue, but then they received the complaint from the Revdex.com. I have also been informed of another homeowner in the community that had a similar problem and they resolved it. the only way Tony could have made that comment to me about fixing the issue is to acknowledge that there is a problem.

Stanley Martin Homes Response • Dec 11, 2018

Essex Homes met with the owner, along with the landscaping company, this morning, Tuesday December 11, 2018, to further evaluate his concerns with the left side of the property. We found no standing water in the swale from the weekend rains again. The landscape company shot the swale using a transit and found an area that could be improved. They will re-grade this area to help with the drainage. This work is projected to be completed within two weeks. The owner was satisfied with the outcome of this meeting.

(The consumer indicated he/she ACCEPTED the response from the business.)

There is freestanding water in my yard. No matter how hot it is outside, the yard is swampy. Essex will not address the issue. I am getting excuses.
I purchased a home from Essex Builders on May 30,2018. After moving into the home and cutting the grass, I noticed there were puddles of water in the side yard. The yard feels swamp-like under my feet. I contacted an Essex representative on several occasions and have been told many different scenarios, but no one is addressing the issue. The landscapers came to look at it and said they would change the sprinkler meter box because it is constantly filled to the brim with water. They never fixed it. Brian from Essex warranty contacted me about 2.5 weeks ago and said he would come look at the yard and call back. I am not sure if he ever came. On the phone, he offered the explanation that because this is new construction, the grass has to take time to take root. Until that happens the yard will be muddy. I was also told that the sprinklers are running too frequently, so I stopped watering the grass for a week and the yard still feels like a marsh. I think the yard has a drainage problem that no one seems to be addressing; or it could possibly be a leak which could result in foundation failure. I feel like Essex is dropping the ball. This is a huge investment, and I can not afford to have foundation issues. I have examined other yards on my street (this is all new construction) and they too have issues similar to mine. I spoke to a my neighbor two houses down and he has a section of his backyard fenced off because he said it is so wet no one can walk on it. I feel like there is more going on then Essex is willing to admit. I have spoken to so many different people at this point; and they all propose to do something different that never gets done. I even resorted to contacting the HOA and I was told they have nothing to do with it and cannot get involved. Gnats and mosquitoes are constantly gathering in the area; and even the geese come into the yard to drink from it, from time to time.

Desired Outcome

I would like my yard dug up to see if there is any type of underground leak or drainage problem. If there is a leak, I would like for it to be fixed. If there is a drainage problem, I would like the proper drainage system installed.

Stanley Martin Homes Response • Sep 11, 2018

An on-site inspection took place yesterday, 9/10/18 at 4:40PM with Essex Homes, Saluda Hill Landscaping and the homeowner. An hour before the appointment a heavy thunder storm took place. During the inspection of the yard no standing water or ponding of water was observed after this rain event. The yard looked good and the grass was healthy. There was an area on the right side of the property and in front of the electronic irrigation valves where the ground was very soggy. It was agreed that Essex Homes would have Saluda Hill Landscaping install a French drain starting at the valve box and down the right side to help alleviate the ground water from this area. Saluda Hill agreed to have this work completed in two weeks from yesterday, 9/10/18. The owner was very happy with the outcome.

We got our home built in 2015. Like any new home they had to come fix some things after we moved in. And for the most part they came out and fixed what was wrong. We were happy with most of the repairs. The thing we cannot forgive is when we noticed the garbage disposal started leaking about a year after we moved. When we called a plumber to come look at it, turned out they didn't install it right and forgot to put the rubber gasket in so it was slow leaking for a year and rotted the bottom of our cabinets. I emailed them several times and explained that they installed the garbage disposal incorrectly, and they just kept telling me it was out of warranty and refused to come out and do anything about it. I don't think I would use them again. Bad customer service!

Building a home in Blythewood sc, accent for backspalsh I selected had clear in it, the clear turned green when installed.

I am building a home in Blythewood sc. I selected an accent to go with the backsplash at the design center. The accent had Clear bars. When they installed the clear turned green. I dont like it. I was told it was the gout that turned the clear green and it had happened in the past, clear turning to a color. I was not informed that was a possibility or I would have selects something else. I was first told I would have to pay to have the accent removed and something else installed. I felt should not have to pay for rework and the tile selection is free so why should I pay. Now they are saying I won't have to pay for to have the accent removed but they will not reimburse me the $330.00 for the accent. I don't want to pay for something I am not getting. I ageeed tile only with no accent and as I mentioned that tile is free. All this is holding up the closing date which is also holding up my moving to sc. this has been
very stressful. It is hard enough living so far while trying to build. I went to check on the home on 12/29 and I had on a green swearber so I thought it was a reflection from the sweater. I went the next day with a different color sweater and it was the same - green. They installed the wrong surround for the fire place and are replacing that but since they installed
what I selected for the accent, although does not look like what I selected once installed, they will not refund 330.00. Again, I don't want to pay for a product I am not getting.
The address of the property is *** Blythewood sc, lot

Desired Outcome

It is very simple. I want to be refunded 330 for a product that changed once installed and does not look anything like what I selected at the design center I have pictures of whet I ordered and what i sected and what it like installed but can't add.

Stanley Martin Homes Response • Jan 31, 2018

Mrs. went to the design center and made her selection of a tile accent. Once the tile accent was installed Mrs. decided she wasn't pleased with her selection. Verification that the right tile selection made by Mrs. was confirmed. She was informed by her Agent and the Essex on-site agent that Essex would be happy to remove the tile and let her make another selection, however she would have to pay for the cost to remove the tile and re-install. Mrs. felt she should not have to pay for removal or re-installation so Essex in order to keep the client pleased decided not to charge Mrs.. After the removal of the tile and installation of Mrs. new selection Mrs. still wanted a reimbursement of $330.00 for the Tile accent that was removed. At this point Essex said no to the reimbursement due to the cost incurred for removal and the reinstall. Mrs. agent Nancy J then came forward to say she understood the decision but would like to pay for the reimbursement on behalf of her client. Before Mrs. filed this complaint Essex had planned to go ahead with the reimbursement to Mrs. in the amount of $330.00 in order for her agent not to incur this cost. Mrs. will be reimbursed at closing.

The information provided in the response Is not correct. I am satisfied with the final results but the information provided by essex is not correct. I filed a complaint after being told I would not be reimbursed. I was aware the tile would be removed and replaced at no cost to me but I was still paying for an accent that was being removed. I did not decide I wanted to be reimbursed after the tile was removed and replaced. The tile, which is my original selections and was no cost to me anyway was just ordered Last Friday, 2/26 so the removal/ replacement process had not begun st the time of my complaint. My selection is the same selection I made at the design center minus the accent. I still like the accent and would have gladly kept it except once installed the clear was changed to green. If I wanted a green accent I would have selected it. At the time of my complaint the tile had not been removed and reinstalled. I even asked if a white accent be installed so not to remove all of it and not incurr such a cost. I even asked for two quotes for a different all white tile when I was first informed I may have to pay if I wanted it removed and replaced. I never received the quotes but I am assuming that was because my agent was trying to help me. I don't understand why such false statements were made by essex in their response. I told my agent and the Essex on site agent that I would not accept money from my agent nor did I want her commission reduced and I have all the emails indicating that. I fell all, my agent, Essex on site agent and the superintendent did what they could to satisfy my concerns but it was up to me to fight for what I felt Would satisfy me especiallly since this was not the first incident with the design center throughout this process. I received great guidance from the Essex on site agent from the beginning that helped me get started. I am pleased with the outcome and the 330 will be deductde at closing but the facts seemed to have gotten lost in the midst.
Again, I am pleased with the outcome but disappointed that the facts were not provided. I hope essex will ensure anyone else that select this accent is informed of the possibility it can change color once installed because it is a nice selection .

I accept the response that essex will reduce the amount at closing but do not accept their response as to what occurred .
