On Saturday afternoon 3/7/20 me and my wife purchased a 2009 Mercedes E350 4matic from this car dealer. During the course of the negotiation I asked Nick S (the dealer) if this vehicle had a salvage title “or” had it been involved in an accident. He assured me the car had never been in a accident and the car had a clean title. It is my understanding that it is illegal for any dealer not to disclose this information. Our decision to purchase the vehicle was based on this information. Later that evening I pulled out the owners manual which contained a document left by the previous owner. The document was from Auto Art Body & Paint. On 12/15/2016 with 69238 miles this vehicle was involved in an accident. The cost to repair was $9872.80. I called Nick S on Sunday 3/8/20 and informed him of this discovery. My statement to him was that I wanted to return the vehicle and for him to return my cashiers check. Second option, I would keep the car But would a refund of $1000 for diminished value. He immediately said no that he would not make any money. He repeatedly stated I signed the papers, the car is mine. He denied being aware of the damage and said I was at fault for not gettin a Carfax report. He blamed the dealers auction for not disclosing and was going to contact them and call me on Monday. This never happened and I never expected a call. This was an 8 minute conversation by my cell phone. He mostly spoke very loudly, talked over me or refused to have a conversation. Tuesday 3/10 I drove the car to DMV to transfer the title, the check engine light came on. Only 40 miles in my possession. Scheduled for my mechanic on Thursday.

*** came to buy the Mercedes Benz from me on 3/6/2020, himand his wife both were looking at the car for about one hour and came back on 3/7/2020 at around10:30 am and looked at the car again for about 45 minutes. They took it for a test drive for about 40more minutes and looked around the car for another 20 minutes. Finally, they both decided to buythe car. The next day, *** called that he got a carfax that night and it showed that the car was asalvage. I told him that it is not salvaged and he had the title in his hand. After all that inspection, Idid not know where they got the idea of the car being a salvage title. I have received a complaintabout the deal that I had with ***. The vehicle is a clean title, not a salvage titleand I have the CARFAX and the title to prove it.

I am rejecting this response because: Some of these statements are inaccurate. We looked at the car for only a few minutes on Saturday 3/6. It started raining so hard my wife got into our car, we left shortly after that.
We returned on Sunday 3/7 as this was a dry day. His statement is mostly accurate. Before deciding to purchase the car, I inquired if the car has ever been in an accident or had a salvage title. This is two different things. He assured me it had never been in an accident. He showed the title, but this alone does not prove the vehicle was not in an accident. He stated he had the dealers auction inspect the vehicle, and the car was in perfect condition. I have taken the car to Prestige Auto Repair for inspection and the fact the check engine light came on. I have a copy of their inspection report. At this time I have done the immediate repairs, this has cost me $5600.
On Sunday 3/8 I called him and stated I had found a repair bill in the owners manual for $9800 in damage repair for front end damage to this vehicle. I never mentioned a car fax, he was the one that mentioned it was my fault for buying the car without obtaining a car fax. I requested to return the vehicle, and for him to return my certified check. He refused stating he would loose money.
