contracted with them to negotiate payday debt - they were supposed to represent me. paid fees and they did not deliver
I contracted with them for payday loan debt - they were to look out for me. I found out months later that the loans I had were not even legit and got 3 companies to wipe out my debt - one for 1/2 of what they negotiated. This company should have done that for me and instead strung it along for longer than I was told it would be and without even finishing the job - being in the business they should have been able to get the same result I did

Desired Outcome

I want a portion of my fees refunded to me

Starting Point Financial Response

Hello ***,

We appreciate your feedback, however, we do not provide the debt relief services you are mentioning. We provide the financial planning and financial consulting aspects of your program. You were referred to and you signed up with Gilmore, Green & Associates, a third party, to negotiate your debts. After speaking with them it appears that they were able to resolve 3 out of 5 of your enrolled accounts for you before you cancelled your program. In regards to any refunds please contact GGA directly. However, they are performance based and only collect fees on each account as they are negotiated.

Starting Point Financial, LLC denied me a complete refund of incomplete services.
I was in need of Payday Loan for which I had 2, that I needed help to payoff when noticed a company on-line (Get Out of Payday Loan Debt), that was to consolidate payments into one payment payoff loans. I talked with *** who explained to me the program. I was told by *** that they would call loan companies, setup settlement agreements, then I was to pay according to the settlement agreement. (Starting Point Financial LLC),Manager ***, which is a division of (Get Out of Payday Debt, began debiting my checking account, $549.00 total before a settlement agreement was finalized. I was receiving calls throughout the day from the creditors for two and a half months before I received an email from (Starting Point Financial LLC),stating that I need to contact Global Client Solutions (GCS). This is what I thought that was included in the program. I pay the monies to you, you set and get results. I, then decided to cut ties with (Starting Point Financial LLC),and in a program with another company and we have doing great business. This company did not debit monies until settlements were finalized. Calls stopped, loans are deceasing, and they talked to (GCS) on my behalf and got the ball rolling. So now I am requesting that (Starting Point Financial LLC)and *** return my funds in completion $549.00 of which only $75.00 have been returned.

Desired Outcome

Complete Refund

Starting Point Financial Response

Mr.,

We have already had some lengthy conversations on this matter. As mentioned and as detailed on our websites and agreements, Starting Point Financial provides financial planning and financial consulting. Through some of our programs we do refer you over to a third party to execute different services that are recommended for you in your financial plan. In your case you were referred over to a debt settlement company of which you were made aware of and you elected to sign up to their program. They are the ones that work with your lenders and making settlements.

Starting Point Financial provided the services to you that were detailed in our contract. Fees for such services are detailed and provided to you before signing up when you selected your payment schedule. Then again when signing the agreement it requires that you initial next to the two sections that detail our fees. The agreement also states that we collect our fees after Our services are rendered and that we do not initiate any refunds. As a courtesy we have already waived fees that were past due prior to your cancellation in addition to refunding an additional $75. Additionally, we offered to make a exception for you and to provide you with a full refund if you would get on a call with us so we can dissect where your confusion stemmed from. I personally attempted to call you three times and sent you various emails however you never got back to me. At this point the option has expired and we can no longer offer this courtesy.

In regards to lenders calling and the need for you to contact GCS, that is stuff that is handled by the debt settlement company you signed up with, not us. From speaking with them it appears that you already had an account with GCS so they needed you to simply call or email GCS to notify them that you approve of them opening a second account for you. They called and emailed you about this a few times and it was months before you ever got back to them. The only reason they really couldn't help you out is because you never completed this. We do wish you the best of luck with your new service provider and glad that it appears that you have provided them with everything they need to do their job.

First, the last time Starting Point Financial, Mr. called me, I informed him thst the conversation is being recorded. Mr ***, said NO,I can't talk with you then. As far as Mr *** tried to contact after, it was by email. This tag-team email had been going for 3 months so I gave you until July 6, 2017 for a total refund. That time came and went. Secondly, I was not contacted by GCS by email or a phone call. I just noticed that my checking account was not debited in awhile for payments on the settlement, just the fees. This is why I called Starting Point Financial to find out as to what was going on. Thats when I found out that I, myself, was to call GCS. WHY? I submitted my Power of Attorney to Gilmore, Green & Associates , another 3rd party company which I am sure Starting Point Financial knew was representing me in this program, I was initially told when settlements were reached, this Program would debited my account.Again, no settlement were reached and all monies when to Starting Financial...a total of $549.00. Yes, you refunded back $75.00 and offered to refund $150.00 more if and only if I signed a release in which I my conscious would let me sign.As I read the release form, there were a number of stipulations in the agreement that I wouldn't sign...so I did not. Again, Starting Point Financial did NOTHING to get me out of debt besides take money that was not earned, I am still seeking a refund of what is owned to me, $474.00.

Starting Point Financial Response

Mr., As stated previously and in the agreement you signed up with us we do not provide any refunds. The consideration for a refund was done as a courtesy (which is what entailed some back and forth). We did indeed issue a partial refund and forgave the past due amount that was not collected prior to cancellation. In regards to the issue you had with GCS and the third party company you signed up with, again, those are different companies and not us. However, in speaking with them they notified us and provided proof that they tried calling you and sent you an email about the issue with your account and it was three month after that that you finally responded to them. I informed you as to why they could not "open a bank account for you" as that would be illegal. In regards to the recorded call, Florida law requires all parties to consent to such recordings. As such, it is in anyones right to deny the recording of a call. The conversation being cut short was a product of you insisting on continuing to illegally record a call without consent. Still, even after all that. I immediately send you an email asking to get on a call again to get feedback and with that we could potentially do a full refund. I also called you back 3 times with no answer. As such, we have decided to uphold our agreements no refund policy.

Well, it seems like we're not getting anywhere this back and forth as it was when were communicating through emails and the one partial phone conversation where you ended when I wanted to record the conversation. What were you afraid of? I, too, was being recorded. As for as the phones calls "you" said you made afterwards, I was probably busy, at work, etc. Anyway, after the first phone call in which you ran from, why would I talk you anyway? More Stalling! Mr., your business (Starting Point Financial)did not do anything, ABSOLUTELY ANYTHING to get me out of debt. Thats the job I hired you for. So, if your final word is "No Refund," if the Revdex.com can not settle this, I will pursue other avenues to get back my hard earned monies. Starting Point Financial is akin to a scam. Legitimate businesses who do not do the job as it was hired, gladly give refunds. But you and (Starting Point Financial) will not refund my monies because didn't answer a phone call when it was already discussed and you knew as to what I wanted through numerous emails. Again, what was there to talk about sir? Either you do the right thing and refund my $474.00, or you and (Starting Point Financial) will do just what a scam company does, keep monies for doing nothing. Stay focused sir, and stay tuned. Thank you Revdex.com for letting me expose this company as for what it is. I will soon be making other inquiries on media and social media on (Starting Point Financial) until this situation is resolved. I don't know about you'al, but $474.00 is alot of money to me...and I will get it back. Mr., I wish you well on your future business.
