This is in response to Statewide Mechanical, LLC's (hereinafter referred to as SWM) response letter dated 2/15/in regards to the complaint I filed with the Revdex.com on 2/3/In SWM's response letter, they claimed that "Statewide Mechanical, LLC provided and installed heating systems as proposed by Statewide Mechanical, LLCThe systems were installed in accordance with our proposal and equipment schedule, installed within the proposed timeline, installed in a workmanship like manner, the units conform to all local codes and further they were inspected and approved by the local jurisdiction." This statement by SWM is trueHowever, the problem with the rental units not being adequately heated has nothing to do with the installation of the combi water heaters (boilers)Rather, the problem is with the combi water heaters themselves that SWM recommended and installedThe combi water heaters are not compatible with the baseboards of my heating systemsThe old boilers that SWM replaced output heating water at a temperature of 180• F or greaterThe combi water heaters are not rated to output heating water any greater than 140 F (this fact has been confirmed by the manufacturer of the combi water heaters, Bradford W***)The previous property manager of the property before we bought it, managed the property for the previous five years and said that there was not a single heating issue while the old boilers were installedSWM has continually tried to blame the problem on the lack of baseboard length in my heating systemsAccording to the previous property manager (as well as the tenants), the length of baseboard in the rental units was sufficient to adequately heat them with the old boilers installedTo fix the problem of my rental units not being adequately heated, SWM has proposed two different optionsOne option SWM proposed was a bid to install additional length of baseboard at my cost which would have amounted to several thousand dollarsThe second and last option that SWM proposed was that they would install a reconfiguration design to increase the temperature of the heating water to an average of 110•FSWM said that the reconfiguration design was approved by the manufacturerHowever, SWM did not guarantee this would work and they required us to sign a full release of liability prior to installation of the reconfiguration designUpon my HVAC expert contacting the manufacturer, Bradford W***, I learned that they did NOT approve of SWM's reconfiguration designIn light of this fact, I countered this proposal with a proposal that SWM could install the reconfiguration design, but they would have to provide a 5-year warrantySWM turned down this proposal by way of ignoring my proposal and not respondingAs I indicated in my first letter of the complaint, SWM created the problem of my units not being adequately heatedI am requesting that SWM honor its warranty by either (I) making alterations in an attempt to increase the heating performance of the combi water heaters with a 5-year warranty or (2) replace the combi water heaters with heating systems that will adequately heat my units the same way the old boilers SWM replaced did AT NO COST TO MESincerely, *** ***

Despite repeated requests, Statewide Mechanical (SWM) did not honor their warranty after installing heating systems that did not provide adequate heat.  We had to sue SWM in small claims court in order to get the money out of them in order to fix the problem they created.  Please read more below for a more detailed synopsis.   My wife purchased a 4-plex in the summer.  SWM installed three new heating systems in three of the four units that fall.  The original heating systems provided more than adequate heat to the units.  There had been no heating issues during the previous 5 years that the previous owner owned the 4-plex and the original heating systems had been in place for 31 years.  However, the new heating systems installed by SMW failed to provide adequate heat after installation.    After SWM installed the three new heating systems, all of the tenants that lived in these three units started to call us saying their units were cold (the tenant in the fourth unit that did not get a new heating system had adequate heat).  So we contacted SWM to investigate why the units were not being heated adequately.  SWM sent a technician and determined that more baseboard was needed in each unit and provided us with a bid to pay more money to SWM to install more baseboard in all three units instead of honoring their warranty on the new heating systems and fixing the problem.  Basically, SWM was saying it was not their fault that there was a heating problem, even though the same baseboard was enough for the previous heating systems.  We sent letters back and forth between SWM for months to try and get them to honor their warranty and fix the issue they created.  In the meantime, we had no choice but to buy space heaters for our tenants and reduce their rents in order to not lose them.    After 9 months of getting nowhere with SWM, we sued them in small claims court for breach of the warranty.  We won our case against SWM and were awarded money to cover some of our damages, including court costs and attorney’s fees.   I am sharing our unfortunate experience with SWM, so that you hopefully will not have a similar experience.     Thanks,
