The client entered into a contract with our office onJanuary 8, 2013. At the time, the clientcontracted for a kilowatt solar energy system. The system was installed and was commissionedby the utility company. In response toinquiries made by the client, we have
sent our field personnel to the client’shome on several different occasions. During these site visits, the solar energy system was inspected anddetermined to be working properly. Stealth Solar does not establish arbitrary production standards for thesystems we install. Rather, we rely onboth the manufacturers guaranteed energy production levels as well as thestandards established by the U.Sdepartment of Energy through its internetcased performance calculator “PV Watts.” This site calculates the standard production level to be expected from asolar energy system, adjusted for the size of the system, the geographiclocation of the system and the alignment of the system relative to thesun. This program then calculates theproduction rate that should be achieved by that system by month. Our inspections of the system concluded thatthe system is operating at a level that produces more power than estimate byeither the manufacturer’s guarantee or the U.SDepartment of Energy’sproduction calculations. Clearly, thesystem is operating properly. The client has complained that the system is notproducing enough savings. In reviewingthe file, the client does not have any savings guarantee. It appears that the client is basing theirposition on a working paper that is used by our company to estimate theappropriate size of a solar system. Thisworking paper is not a part of the contract. In point of fact, our contract with this client includes the statementthat “This contract constitutes the entire understanding and agreement of theparties and they acknowledge that there is no other understanding or agreementoral or otherwise, and the only inducement to the purchaser to enter into thisagreement with Stealth Solar, LLC is herein contained.” In an effort to address all of the concerns of thisclient, we approached the utility company that provides service to the clientand obtained a standardized energy profile of a home in the same area as theclient’s residence, of the same size and same number of occupants and comparedthat to the actual utility bills being received by the client. After reviewing actual utility statements forfive consecutive months, we concluded that the client’s home is operating at anenergy consumption arte that is 24.79% below the level considered to be“standard” by the client’s utility company. We believe strongly that our services and productshave provide the customer with outstanding results, producing more power thananticipated and providing a savings in the form of a 24.79% reduction from theenergy utilization levels predicted by the client’s utility company. Our company stands behind our products, our services and our contracts. We do not want our clients to have any reservations about our company in any way. Therefore, we are offering to provide this client with an additional two solar panels at no charge. We will also cover all of the costs of materials and installation of these panels These additional panels will provide even more energy for the client and will result in additional savings in annual energy consumption when compared to the utility company’s standardized model for similar homes in the same development. We do not work to merely meet the terms and conditions of our contracts with our clientsWe strive to consistently exceed the norm by providing excellent products and services to our clients

Stealth Solar always tries to satisfy our customers whenever we can.  Even when the contract is very specific in what we are to provide and that there is no other verbal agreements.  We understand that there is always two sides to every story.  We have specifically tried to understand [redacted]'s complaint.  We have offered to give the client an additional 4 solar panels at over $3,500 our expense to assist them in there quest for significant energy savings.  I cannot and will not reverse the transaction in its entirety.  This is not acceptable as the company has completely lived up to the contract signed by [redacted].  I will try one more time to reach out to [redacted] and increase the offer to 6 solar panels equaling 1.5 kilowatts.  This is a $5000 equivalent offer.  This will be my final offer.  This offer is good for 10 days.Original answer below The client entered into a contract with our office on January 8, 2013.  At the time, the client contracted for a 5.76 kilowatt solar energy system.  The system was installed and was commissioned by the utility company.  In response toinquiries made by the client, we have sent our field personnel to the client’s home on several different occasions. During these site visits, the solar energy system was inspected and determined to be working properly.  Stealth Solar does not establish arbitrary production standards for the systems we install.  Rather, we rely on both the manufacturers guaranteed energy production levels as well as the standards established by the U.S. department of Energy through its internet cased performance calculator “PV Watts.” This site calculates the standard production level to be expected from a solar energy system, adjusted for the size of the system, the geographic location of the system and the alignment of the system relative to the sun.  This program then calculates the production rate that should be achieved by that system by month.  Our inspections of the system concluded that the system is operating at a level that produces more power than estimate by either the manufacturer’s guarantee or the U.S. Department of Energy’s production calculations.  Clearly, the system is operating properly. The client has complained that the system is not producing enough savings.  In reviewing the file, the client does not have any savings guarantee.  It appears that the client is basing their position on a working paper that is used by our company to estimate the appropriate size of a solar system.  This working paper is not a part of the contract.  In point of fact, our contract with this client includes the statement that “This contract constitutes the entire understanding and agreement of the parties and they acknowledge that there is no other understanding or agreement oral or otherwise, and the only inducement to the purchaser to enter into this agreement with Stealth Solar, LLC is herein contained.”   In an effort to address all of the concerns of this client, we approached the utility company that provides service to the client and obtained a standardized energy profile of a home in the same area as the client’s residence, of the same size and same number of occupants and compared that to the actual utility bills being received by the client.  After reviewing actual utility statements for five consecutive months, we concluded that the client’s home is operating at an energy consumption arte that is 24.79% below the level considered to be “standard” by the client’s utility company. We believe strongly that our services and products have provide the customer with outstanding results, producing more power than anticipated and providing a savings in the form of a 24.79% reduction from the energy utilization levels predicted by the client’s utility company. Our company stands behind our products, our services and our contracts.  We do not want our clients to have any reservations about our company in any way.  Therefore, we are offering to provide this client with an additional two solar panels at no charge.  We will also cover all of the costs of materials and installation of these panels. These additional panels will provide even more energy for the client and will result in additional savings in annual energy consumption when compared to the utility company’s standardized model for similar homes in the same development. We do not work to merely meet the terms and conditions of our contracts with our clients. Mr. [redacted],
I have forwarded the email with the ROI Calculations attachment. It seems that you are unwilling to accept the fact that we were presented with your company's sales presentations which bares your Stealth Solar logo by your sales rep, [redacted].  How clear and concise do you want me to be? Unless, the ROI worksheet wasn't anything more than a complete fraud used to make the sale anyway possible?.. In the worksheet, it states our "Net Out of Pocket Expense" of -$10.65/month...we never saw that.  "New Utility Bill" of $28.18/month...our [redacted] bills are averaging over $200/month. "Percentage reduction of Utility Bills" of 115.7%...again, never got to see those savings.  "System Cost Per Month" of $197.53...we are definitely paying that every month.   "Annual ROI" of 12.77%  "27% Guarantee" and "5 Year Cash Profit" of $13,803.65 -$230.06/month"...we shall see or never see.  "Net System Cost after rebate & tax incentives" $19,569, "Balloon Due $12,286.87"....we definitely have that due by April 1, 2014. The bottom graph entitled "Current Bill or Lower Bill?" showed us netting more money every month from -$28 to -$71/month.So you mean to tell me that the only things that are correct about your worksheet is our monthly payment to the lender of $197/month and a balloon due of $12,286?  The rest were all "verbal accusations" by us right? You are lying to us just like your sales rep, [redacted].  You're telling me you will not honor this supposed "verbal accusations"?....Excuse me, but your rep, Mr. [redacted] was representing you and your company; showing us the worksheet with your company's logo.  Who's accusing anything here but showing you with evidence of your sales tactics of bait and switch.? Now you will not own up to the bait and switch tactic that has been presented to us by your sales rep.  If you would have "rejected this outright" then why were we presented with these fraudulent worksheets in the first place? The worksheet was explained to us for our purchasing decisions by Mr. [redacted]...or was the worksheet nothing more than to lure us into buying?  We would never have accepted under any other conditions if it weren't for the numerous questions and presentations to be "actual savings" given by Mr. [redacted].  Isn't that what most people are buying solar systems for anyways?  We've asked [redacted] that "so you are saying that we are essentially gonna be replacing our [redacted] bill for making payments to the solar system instead?"...Mr. [redacted] kept assuring us that we were gonna be doing just that. You say you "would have never accepted a contract between us with a statement of 115% savings" yet you assume that we would accept that you and your company had nothing to do with your ROI Calculations? This was your sales tool and sales tactic used to gain a sale at any cost...is that what you meant by saying "verbal accusations"? Your "legality " ..."with the contract only" isn't anything more than weaseling out of your sales agent's fiduciary responsibilities to you, your company and most importantly, to us as customers.  You and your company have no "honor" and ethics. There were other emails of which I've had communications with [redacted] that you should have been aware of since April of 2013.  However, apparently, you really show that it is really about the sale and not customer satisfaction as you implied.   It took you almost 8 months to have finally contact me via email only because we've been complaining every where from the Revdex.com, FTC Consumer Complaints, State of AZ Attorney General's Office, [redacted], and [redacted].com.  It's shameful to think that we had to have gone thus far to get your attention. Back in April 2013, we spoke to Carlos, an [redacted]. rep who told us that we wouldn't see any difference in kWh used for the entire year even with your highest system of 7.92 kWh.  We expressed our concerns to [redacted] Back at the time even before the go ahead of the [redacted] coming out to turn on the switch.  We wanted to put a stop to the process but [redacted] Back pressured us into going through with it because he said that our contract was already in motion and we couldn't back out. The point of fact, the worksheet attachment presented by Mr. [redacted] undermines the fraudulent sales tactic.. In overall summary, it is not a question of if the solar system was functioning properly and giving us a 24.79% reduction but the matter of agent implied statement with documentation of 115% reduction. The "impossible...115% of figure that never existed since you did not even live there the year before" was the statement that should have been made by Mr. [redacted] to us then, so then we would have been told the truth.  At which at that point, we would have evaluated the whole solar purchasing.  We would have never purchase the solar system had we known now that it was giving us 24.79%  We were fraudulently lied to. We will have to come to a  more than two panel offer by Stealth Solar to satisfy the fraud.  We shall see what happens from here on out.

Revdex.com:
I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this proposed action would not resolve my complaint.  For your reference, details of the offer I reviewed appear below.
The details are not up for discussion any longer due to pending ongoing investigation with the Attorney General's Office against Stealth Solar.  I will not discuss any details but will outright reject any offers by Stealth Solar.    I do have a case number that I will reserve to hold until further notice.  I regret to say that the disputes against Stealth Solar will not be resolved by any mediation of the Revdex.com.  At this point, I will leave it up to the Attorney General's Office.Thank you Revdex.com for your involvements thus far.  I will keep you posted as I receive more information.
