I appreciate that Sterling Associates takes the complaint very seriously as this is also the first time for me with filing a complaint against a businessSterling Associates is in the business of dealing with real estate transactions and it is obvious that we entered into a transaction that they were part of and I am not sure where the thought of them being exempt from any responsibilities originates fromI have attached some documentation that shows the negligence on the part of Sterling Associates which caused the damages that we are trying to get reimbursed forThe one set of documents shows the email correspondence between Sterling and the realtor from the previous failed transaction and gives the reason of "To detail what happened, the buyers are purchasing the home with use of cash from a trust fundThe trust fund is controlled by a parent who approves the cash withdrawsThe parent believes they purchasing above their means and therefore will not remove the money from the trustMy buyers are unable to qualify for traditional financing because of a combination of low credit scores and lack of employment." After this failed transaction, Sterling then brought the buyer to our home (listed for [redacted] more than previous attempted purchase) where we go through the entire sales process including moving out of our homeOur realtor was constantly asking for a copy of the proof of funds and the requests were either ignored or answered back that it was a good deal and the funds were thereSterling also told our realtor that the previous deal went bad because of a home inspection issue which proved to be not trueOnce we did receive the proof of funds information it was quickly determined to be fraudulent (second attachment) In closing, I am just looking to recover the costs incurred from the negligence of Sterling Associates in the process of selling our home and will pursue it until it is resolved Final Business Response / [redacted] (4000, 19, 2017/04/03) */ In our previous response I outlined the best method for Mr [redacted] to receive his earnest money as Sterling Associates is not holding this There was no negligence on our part as we represented our clients in good faith The purchase agreement clearly states the remedies the seller can pursue if a buyer fails to closeThe remedies would be pursued against the non performing party Sterling Associates is not the non performing party and will not be compensating Mr [redacted] in any way

I appreciate that Sterling Associates takes the complaint very seriously as this is also the first time for me with filing a complaint against a business.
