This sale was done in October of and the resale listing was good for one year, so the listing would be expired at this timeAs I told Mr*** that per the contract we do not guarantee resale of other units, not that he
should have read the contract
As for not paying the maintenance fees, they must always be paid and the owners can place the week into the reimbursement program and have a refund of *** sent back to them
We will not cancel and refund this contract based on the resale of other unitsWe will be more than happy to have the unit relisted for Mr*** until it sells at no cost to him
If Mr*** would like us to relist the unit he can contact us at X-XXX-XXX-XXXX and we will be happy to get it done

The company should train the salespeople to explain what is in the contract instead of maing untrue statementsThis is advertisingWe didn't learn until a year later that the *** was for a week every other yearThat is highway robbery we never would have agreed to that had we knownWe do not want anything more to do with such a companyI would hate to stop going to Branson every year because of such unfair selling practicesOur five friends who were with us can be contacted to substantiate what was told to us
As for maintenance fees, Mr*** said if we decided to skip using the timeshare the next year we would not have to pay maintenance fees for that yearHe got Mr*** on the phone and promised us it would be sold within six months
We do not wish to sell the *** timeshare now because it is much better than SummerwindsIt's of much higher quality, lower priced, and we have not encountered sales presentations which were untrue like the ones at SummerwindsAlso, it is paid for
We feel they should cancel the contract based on the salesman's presentation aloneWe told him we could not afford another payment, and we did not know the contract was not as describedKeep the money we've paid and cancel the contractIt was a farce from the beginning and we do not like to deal with dishonest companiesThis should become common knowledge to all people over years of age and the company should be put out of business
Can you please advise us the next steps to take in the process to get out of this mess and keep our credit rating goodIt's hard to work all your life, retire and have someone put on a slick sales presentation to take advantage of seniors
We will contact the mayor and the public service commissionerDo you have any more suggestions?

Again we have looked into this and the resale is not guaranteed, copy enclosed
Mr*** paid the fees and made the choice to bank the week with II so no refund of the fees can take place, if he would like to be reimbursed for the fees, he can call us in October of this year and we will have his week placed into the program
The *** price is right for an every other year unit as our annual units sell for about

Again we will not cancel and refund the contract over lack of resaleIf Mr*** would like to do the release with no refund as he states, he may contact me and I will get the paperwork started

By way of response, IF *** means that he will cancel the contract, not mess up our credit in any way, and charge us NOTHING for the paperwork involved, he may go ahead and process itThis is the only way we will accept the proposed resolution
He may keep the *** plus the *** down-payment, plus maintenance fees for a year, plus the cost for listing the other timeshare for a yearThat is quite an expense 4-night stay
To set the facts straight, we stayed nights in October this is when we learned that the contract was EOY (every other year)This was the first we heard about thatAlso, he has said nothing about what his salesman said compared to what was in the written contractThat is the fraud that we are talking aboutHe mentioned nothing of this in his response
If he can live with this, we can also
If we need to do anything else, please let us know, and thank you for your help

We have looked into this and find that the resale of other unit is not a guarantee as per the contract.(copy enclosed) We will be happy to have the unit relisted with the agent until it is sold

As for the maintenance fees they can be reimbursed to the owner if they call us before March 1st of the use yearI see the ***'s have paid the fees and we will be happy to place the week into the reimbursement program for them for the week, this will allow them to recover *** of the
*** fee that has been paid

We have looked into this and find that Mr. [redacted] can use the unit every year or as often as he wants just by purchasing the time as he needs it. Mr. [redacted] has the right information, he just needs to call us at X-XXX-XXX-XXXX...

to book the time and pay the fee as he wants to use it within 30 days from the date he is wanting.
His first year of use is for 2017 and in 2017 he can set a date up to one year in advance for his week.
We will not cancel this contract based on this complaint, we are more than happy to help Mr. [redacted] to better understand the program and how to use it by calling us at X-XXX-XXX-XXXX.
