This complaint from the Parkers stems from work they hired [redacted] Construction (STC) to preform on their rental property in Asbury Park, and was to take place in June 2008. A year later in June 2009 the Parkers decided to go ahead with the proposed job. STC ordered the materials, went to the site with men and materials. STC called the Parkers to tell them that the damage over the year had increased because of the winter weather and so did the scope of work, the Parkers told STC to hold off once again. The crew had to be paid for the day and a restocking fee was incurred for the materials being retuned. The Parkers state that STC has not responded and requested their money back. Cell phone records and email show that there was correspondence on both parts. October 2009 the Parkers filed a complaint with NJ Department of Consumer Affairs to which STC responded to on November 2, 2009. On December 19, 2009 the Parkers responded to Consumer Affairs with incorrect information regarding phone numbers that they called and asking for receipts. Consumer Affairs sent a letter to the Parkers in January 2010 asking for a settlement; they refused to settle this matter. In November 2009 the Parkers also filed a claim with the New Jersey Office of the Attorney General, not willing to or wanting to settle. April 26, 2011 the Parkers placed a complaint with the Revdex.com. In one answer there complaint, STC and his attorney have rectified all contract violations and the remainder of the complaint is the same as above. None of STC’s correspondences or records were included in this or any other complaints filed by the Parkers. The Parkers refused to settle, and decided to escalate the matter by serving both STC and [redacted] with a Civil Action Summons on February 1, 2012. They requested via their attorney they would settle the matter for $7,500.00. This continued with attorneys back and forth and on 4/30/12 stated they “do not wish to resolve this matter by way of any reasonable settlement amount” In June 2012 the Parkers changed attorney’s, STC once again offered $3,500.00 to settle the matter. August 2012 STC’s attorney reached out to the Parker’s new attorney, not mention of settling. January 7, 2013 the Parkers agreed to settle for $4,000.00. STC signed the Stipulation of Settlement, which stated “The Parker’s agree to voluntarily dismiss their complaint against STC and [redacted] without prejudice. Each party further agrees to release and give up any and all claims and rights which they may have against the other arising out of this action. This releases all claims including those of which they parties are not aware and those not mentioned in the Stipulation of Settlement.” STC signed the Settlement agreement and mailed it along with a check for $4,000.00 on January 14, 2013. This should clear STC and [redacted] and return his rating to a positive one. Thank you, [redacted] Office Manager [redacted] Construction, LLC
