A contract was enter by both parties on December 2, 2018 for a small construction/remodel job. As per the contract the contractor provided the job was to start "on or before December 20, 2018. As of January 5, 2019 the project had not been started and there was no communication from the contractor. The contract had been in breach for 17 days with no return correspondance from the contractor. The contract was ultimately canceled and a refund of the monies paid were requested. The contractor has been resistant to pay and a demand letter has been sent and the situation documented. As of the writing of this (February 14, 2019) the contractor has not refunded the money he has been paid for the project. The project had never been started by the contractor or any subs.
