Dear Mr*** ***,I have been a roofing contractor since I have
thousands of satisfied customers throughout Clark, Floyd and Harrison CountiesYou stated the problem occurred on May 20, I don’t see
how this can be when our records indicate the job had not been started until
June
3, 2009. I also dispute your
statement that you called me back to the job a month after the roof was
installed regarding staining on a vaulted ceilingI have no record of this
ever occurringOur records indicate your first and only claim occurred in
I promptly responded to your claim
in and settled it to your satisfaction at no cost to you.My workmanship warranty claim procedures are very simpleIf
you have a complaint within the warranty period all you have to do is pick up
the phone and call meInstead you sent me a nasty email making unreasonable
demands and actuationsI treat all of my customers with respect and I
believe my customers should treat me with respect.When did you first notice the staining? I expect to be the
first to be notified when you have a warranty claim. As I understand you choose to contact another
roofer before notifying me of your concernsI don’t understand why you would
not contact me first if you expected me to take care of the problemHowever
this is a different situationThe workmanship warranty expired June 6,
therefore I am no longer obligated to make repairs at my cost.Are you certain the roof is the cause of your problem? Are
you sure you don’t have a condensation problem in your atticIt is a known
fact that when the underside of the plywood decking temperature reaches dew
point condensation occurs.You have made several serious actuations about the work my
former company completed on your home located at *** *** *** *** *** *** ***. I would like to
address your allegation that the Ice shield had not been installedThe ice shield
was indeed installed directly over the wood roof decking in the valleys and
along the eavesFelt paper was then installed over the ice shieldThis
procedure was used to protect the integrity of the ice shield due to the
extreme heat during installation of the shingles.My company installed every line listed on the proposal in
which you signed off onThe workmanship warranty term was clearly stated on
the proposal and invoice

I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this proposed action would not resolve my complaint.  For your reference, details of the offer I reviewed appear below.
Mr. Stiles,I don’t doubt
you have many satisfied customers and I wish I could count myself among that
group.  However, that hasn’t been my experience
to date.  If my most recent
communications have come across as “nasty” then I apologize.  That was not my goal and it must be the
frustration coming through.  I know my
previous communications in 2009 and 2011 were very cordial.  You state “If you have a complaint within the
warranty period all you have to do is pick up the phone and call me.” The reason
you don’t have record of the 2009 warranty work is because I called you instead
of emailing you.  The work had been so
recent and you were still familiar with the job that I just gave you a call and
you came right out.  I also mentioned
this 2009 rework in the email to you about the 2011 leak and you did not take
exception to it then (see attached).  The reason I have
been sending you emails and certified letters instead of calling you is so we
both have them for our records.  Not
because I’m avoiding you.  I did not want
to go through the Revdex.com but my first attempt to contact you was October 2nd and I did not receive anything from you until October 26th.  You should have had enough time to respond in
some form or fashion.     Instead of me
attempting to refute your comments one by one, let’s put the he said/she said
stuff to the side.  In your certified
letter, you make a point that some of the damage could be caused by
condensation.  I do want to mention that
we have not added any insulation.  However,
I could agree that some or all of streaking on the tops of the walls could
potentially be caused by condensation. 
In regards to your Revdex.com response, you state that you put felt over the
ice shield.  That would explain why the 3rd party felt the paper instead of the ice shield. 
If you are absolutely certain that is how it was installed then I will
take you at your word.  Finally, let’s
discuss the water staining in the living room. 
The water staining appears in close proximity to where the original leak
occurred back in 2009 and 2011 and it most definitely does not appear to be a
condensation issue.  Per the 3rd party contractor, they did not see counter flashing installed at the
chimney.  What I propose is that you come
out and meet me to take a look at the damage and examine the area by the
chimney.  If you can absolutely prove to
me that the damage is caused by something other than a roof leak then I will
“accept” your response and close this matter with the Revdex.com.  If we find that it is a roof leak I would
expect you to repair/patch the roof were necessary and pay for the water damage
to the ceiling and wall.  While I
understand your work occurred in mid-2009 and your warranty is for 5 years, I would
hope you would concede the fact there have been multiple leaks and you did
re-work in this area as recent as 2011. 
If we can’t agree on what is causing the damage I’m not sure how to move
forward.  Please let me know if this plan
is reasonable.
