I am Writing in response to the Complaint you received (D [redacted] ) from [redacted] I am not aware of what this former client is talking aboutI never made such an agreement with him, We only had a listing agreement, which expired Aug I had a standard listing agreement with him with no clause promising to pay any money to him if did not sell in a certain timeframe, in fact, I took a loss for paying for the prep and marketing of his homeI usually charge a retainer for Shorter term listing agreements, but Waived it for him [redacted] 's listing agreement has been expired for almost weeks and there has been no mention of this until nowThe listing agreement between [redacted] and me did not include any guarantees of the sort mentioned in his complaintFurthermore, he insisted to have a short listing agreement and claimed he could sell it himselfI wanted a longer listing duration due to the location and price of his home because I knew it would take a few months to achieve what he wantedTo add, his "desired settlement" (per the letter) makes no sense because there could be no refund when he never paid me anything at allHe paid me nothingI pay for marketing on all my clients' behalf, so he lost no money during this endeavor, and I owe him nothing.Warm regards, Lee S [redacted]

I am rejecting this response because: my complain to this realtor is not a desired settlement or a refund for not selling my house but for him to comply with an offer he sent me electronically offering $5000.00 if he didn't sell my house in 60 days. He also sent me several times correspondence with an offer that if he didn't sell my house in 45 days he will sell it for free.These offers made me select him from other realtors I interviewed. If 60 days were not enough time to sell my house then these offers are false advertisement. The listing agreement was from 06/03/16-08/03/16 the best time to sell a house in our area. He mentioned in his response that he needed more time to sell my house because of price and location, he set the price of my house citing his expertise. I agreed to a price reduction also. Other realtors sold houses in our location at higher prices and houses that were not as updated as mine.When I called his office to claim my $5000.00 to his assistant told her that I had the offers in writing for further review. Left messages but I never heard from them again. I want to voice my complain to different institutions to stop business from using false advertisement if they don't plan to honor offers.
