Hello my name is [redacted]. I am responding to the complaint by Marty at Stirling Motors. He is still holding my car and will not tell me where it is. I told him I am not signing the car over to him which is why he moved it, and now is claiming that he wants $20 a day for holding cost, although I offered to have it towed multiple times and he is refusing. The bad engine he purchased is still in my car. He is also refusing to take it out also.  He said in his response he was going to take me to civil court and now is also refusing to do that because of that cost. I am exhausted by him and all of the games he is playing with me about my own car. He purchased a bad engine and put it in, never billed me, refused to take the engine back out to return to the company which he is being sued by and has moved my car to a hidden location.  I feel this is all illegal and I have waited patiently for months and have not given him an problems. He is now threatening to call the State Police and get an abandonment title for my car, which I have never abandoned.

RE: ID#[redacted]Dear Revdex.com:We have been in the car business for twenty years. We are family owned and operated and have been at the same location for all that time. We have never had a complaint filed before with the Revdex.com. We have a separate repair/detail facility...

located away from our sales facility. We employ mechanics and detail personnel at this location in order to properly prepare our inventory for resale. Occasionally we will perform outside work depending on the work load in house. [redacted] came to us asking if we could install a used engine in her vehicle. We went on line to car-part.corn's website and located an engine for $650.00 (we did not mark up the price of the engine). [redacted] gave us cash to cover the cost and we ordered the engine from [redacted]. I was told by them the engine was a good one and had been tested. The engine was delivered and a check was written for it. In the process of removal and installation we replaced 2 severely cracked serpentine belts and one engine mount which were deemed necessary for proper operation (the cost of these 3 parts totaled $87.32). Motors Labor Rate Book lists this job at 13.0 hours. Our labor rate is $50.00 per hour, which comes to $650.00 + $87.32 + $34.95 for the oil change now totaling $772.27. Unfortunately when installation was complete and the engine was started, it missed profusely and was quite noisy (a bad engine).I immediately called [redacted] about the condition of the engine and was informed they wanted me, at my own expense, to pull it back out of the vehicle costing me even more money. I was lucky enough to put a stop payment on the check. Prior to this I had informed [redacted] of the situation and had given her all of her money back she gave me for the engine. [redacted] stopped twice at our facility and removed belongings she needed. She also stated that she was going to scrap the vehicle at [redacted] for $130.00. According to NAD A the weight of this vehicle is 3,118 lbs which at the current rate of $4.50 per hundred lbs equates to $140.31. This understandably upset me because I was out $772.27 at this time as previously stated. On June 3, 2016 I received notice from the District Magistrate that we need to appear in court over the stop payment on the check! At this point in time if I should loose this civil suit I could be out another $650.00, not to mention my time and effort to address this hearing.Enclosed is a print out of the Manheim Market Report as to the value of [redacted]’s vehicle in running condition which it is not! I certainly feel bad about the situation which [redacted] blames entirely on me. How could we be held responsible for a part sold to us which was stated to be tested and good. So to put things in perspective, [redacted] is out merely $140.31 (the value of her vehicle if she had someone to haul it to the scrap yard for free). Incidentally, on two occasions I was willing to meet her to retrieve any remaining belongings at our storage facility. She did not contact me to follow through and do this. Legally, at the time of this response, [redacted] owes me $772.27 for labor and parts, in addition to storage at $20.00 per day since May 20, 2016 coming to a grand total of $1,452.27.In conclusion, I do feel bad about the whole situation and actually wish I had never gotten involved. Review: My engine in my 2001 Chrysler Sebring blew. I had my var at my moms . Marty F[redacted] of Stirling Motors said he found a good tested use engine and would install it. He had my car for over a week working on it then called to say then new engine was bad. My car is at his shop and I have been asking him to remove that engine that he said he Is returning do I could have my car towed. He refused to remove the engine that was not mine. He then called me and asked if he could just have the car and I said no. Then hr started to say I owed him all kind of money and that he was hiding my car and not letting me have it back. There is no signed or written bill between us. He never discussed any kind of payment when the issues occurred. The day I refused to let him keep my car for his own he stole and hid it. I have called the police and am filing a civil complaint as well . mine and my sons persinal belongings are in that car. I have the title for the car and there is no documentation on anything this man is claiming to be holding my car for. Hr had hid it and won't tell them Jeannette police where it is. They don't ever do their job anyways which is making the situation a lot worse .
