This is in response to a letter dated September 10, 2015 regarding complaint ID[redacted]. There is a great portion of this letter that is false and misleading. The following isan accurate representation of what has occurred with this boat over the past 2 seasons.• Fall of 2014 - Boat was brought to...

[redacted] by customer for several issuesincluding the Starboard Engine not charging and the result was changing the alternator.The Port motor overheated the result was changing impeller and housing.o The customer neglected to inform Stivers of any issues they had been havingwith the boat or the work done at [redacted]'s prior to Stivers1 hauling the boat forwinter.• Fall of 2014 - At Haul out at Stivers the port motor had contamination in the oil and theoil had to be changed. Which was identified by Stivers and changed by Stivers.o The customer signed a Work Order requesting repair• Spring of 2015 - Manifolds were removed and tested and determined thatManifolds/Risers/Elbow had to be replaced. They had been in salt water and werescaling (rusting) on the interior. This scaling prevents water flow and caused engine tooverheat. Stivers made diagnosis and repair per customer.• Spring of 2015 - After completing manifold work the boat was launched and driven todock at Stivers to be moored for the season.• Spring of 2015 - A few weeks later the customer made a comment that now he had anew issue with antifreeze coming out of his exhaust. He checked his oil and wascontaminated.• Spring of 2015 - The customer once again requested Stivers to find the new issue.Stivers subsequently did some testing and determined the motor needed to be pulleddue to an internal engine leak.• Summer of 2015 - Stivers' hauled the boat and pulled the motor and put in the shop.o The mechanic noticed witness marks and damage to the fiberglass• Summer of 2015 - A day or so later [redacted] from [redacted]Shop came to Stivers with a camera to look down the cylinders and determined thecylinders were too badly damaged to rebuild that motor.• Summer of 2015 - Stivers quoted the customer a price for a remanufactured motorthrough Mercruiser.o The customer stated that he could not afford that motor.• Summer of 2015 - [redacted] came to pick up the motor from Stivers' and saidthat the customer wanted him to see if he could rebuild it.• Summer of 2015 - [redacted] rebuilt the motor against his better judgement.• Summer of 2015 - Customer stated that he wanted the motor installed by [redacted]Marineo Atthis point the boat was hauled out in Stivers bam on blocks. Stivers pulled themotor out of the boat and [redacted] was rebuilding at their shop.o Stivers refused to rebuild motor in existing condition - no work had beenperformed by Stivers on the motor.o Stivers said that the boat had to be paid to date in order to launch.o Customer and Stivers agreed to a lesser amount than invoiced and madepayment and Stivers launched the boat.The customer stated many false and misleading statements in their complaint as follows;• "Everything that Stivers did to the motor was wrong."o We did not do any work on the motor, all of the motor work was done by[redacted] Engine Shop.o See invoice for work performed.• "charged us a total of $7,000, and left us with a motor that still didn't work, andnumerous broken and damaged parts, along with damage to our fiberglass (holes)throughout the boat."o See invoice for work performed.o That motor had been removed in the past and there was prior damage.o There was additional work performed besides pulling a motor as detailed on theattached invoices.• "(never used the dock 1 day)"o The customer was at the dock when he found additional damage to his boat.• "no itemized bill was provided"o Please see attached invoice signed by owner.This is a problem that we find with salt water boats. They do not assemble anddisassemble easily. There is often a lot of internal damage that cannot be seen. The customeris a victim of this and trying to blame Stivers. We advised them every step of the way and theyapproved all work prior to completing.Should you have any questions, please contact us.
