In response to the complaint from [redacted] against Stone Creek Apartments [redacted] [redacted] resided at Stone Creek Apartments 3/1/thru 2/28/Attached is the move out form that was sent to [redacted] , [redacted] was given a copy of the move out sheet that showed all of the charges for Cleaning of apt and garage, carpet cleaning, and full paint of walls doors and baseboardsBags of trash in apartment and garage The bedroom apartment and garage was left extremely dirty The bed apartment and the garage required a full paint [redacted] was behind on his Water bill and $was taken out of his deposit to cover the water bill, cleaning of the carpet was $90.00, cleaning of baseboards before full paint of unit was $275.00, cleaning of oven $40.00, Replacing drip pans on range top was $25.00, cleaning refrigerator $25.00, vent hood and microwave$20,00, Ceiling fans $30.00, Trash removal of trash from unit And garage $ Sweep, mopping and waxing of bathrooms, kitchen, dining room, entrance to front door, cleaning bathroom sinks and tubs, kitchen sinks, washing down and oiling all cabinets, Cleaning inside of cabinets, cleaning all windows (8) and mini blinds and Patio $The cleaning and water bill total charge was $ Less Security Deposit of $left Mr [redacted] owing Stone Creek Apts$ The apt was left very dirty and Mr [redacted] left property without doing a walk thru or paying his final water billPlease let me know if you need more informationThank you, [redacted]

Complaint: [redacted] I am rejecting this response because: This is in response to MsS [redacted] ’s reply I am NOT an unauthorized person as you claim [redacted] and I signed a lease agreement in March, At that time we provided a deposit and filled out the chesheet (showing that painting was needed!), to be assured we would get our deposit back When the lease ended a year later and I moved out ( [redacted] alone stayed with the unit at a different price/lease), I asked for the deposit back You refused and said it would be settled when [redacted] moved out If you say this complaint is not valid because you are only considering the period 3/1/to 6/1/16, then I am glad to file another Revdex.com complaint since Oregon Law Chapter requires you to refund my deposit within daysAnd [redacted] is more than happy to file another Revdex.com complaint addressing these issues in this complaint, in our July letter, and in our June letter We have been trying to resolve this as simply and informally as possible You chose to NOT respond to the follow up letter [redacted] and I sent you on July 16, 2016, so we had no option except to file this complaint The online Revdex.com does not permit multiple parties/emails, so as an original signer of the March lease I filed this, as well as was party to the letters sent you You have not addressed any of the issues we raised in our July 16, letter to you Consistent with Oregon Chapter 90.3, you are permitted to charge us for damages caused by the tenant but not ordinary wear and tear There were NO damages caused by us, the tenants, you have no proof of such, you refuse to provide the copy of the mochecklist, which specifically lists the paint chips as already presentThe “invoices” you provided can be created by anyone For the most part, they have no letterhead, no proof of payment, no hourly rates, no signatures, and the amounts do not even match what you charged us This is from our July letter, in part, and I am repeating it here Except for the carpet cleaning, which we understand you can charge for, the others are without any basis 1) Painting: We identified at moa spot needing paint That is shown on our mochecklist and we should not be charged for any painting We put nothing on the walls or doors to disturb any paintWe requested, but you have provided no pictures or proof of any need, because there was no needThe invoice does not provide a date of service or itemized tasks, and, interestingly, is located at the same address as your business Nothing is provided to substantiate the work done Any painting you chose to do was well within “wear and tear.” Please refund $ 2) Cleaning: We thoroughly cleaned the apartment before moving out We left the apartment in better condition and cleanliness than we received it! Ms***, I would like to thank you for sharing ALL of my personnel information to include my full social security number on this open forum. That is very professional of you.
I have tried to contact your office times to resolve this matter at the lowest level. Your company has my current phone number and email address yet I was never once contacted in the years from the date of the application. After full years, I get a phone call wanting my credit card number for an undisclosed debt. It was only after I did a little checking to include filing a complaint with the Revdex.com that I was able to determine what was going on
If you did not receive payment, why was the application processed?
Why was I not contact by anyone from Stone Creek Apartment or Nolan Real Estate Services within the years, rather than simply turning this matter over to a collection agency, to see what my intentions were in regards to renting an apartment

At that time we provided a deposit and filled out the check-in sheet (showing that painting was needed!), to be assured we would get our deposit back.  When the lease ended a year later and I moved out ([redacted] alone stayed with the unit at a different price/lease), I asked for the deposit back.  You refused and said it would be settled when [redacted] moved out.  If you say this complaint is not valid because you are only considering the period 3/1/16 to 6/1/16, then I am glad to file another Revdex.com complaint since Oregon Law Chapter 90.3 requires you to refund my deposit within 31 days. The invoice does not provide a date of service or itemized tasks, and, interestingly, is located at the same address as your business.  Nothing is provided to substantiate the work done.    Any painting you chose to do was well within “normal wear and tear.” Please refund $165.
2)    Cleaning: We thoroughly cleaned the apartment before moving out.  We left the apartment in better condition and cleanliness than we received it!  Please refund $85.
3)    Carpet shampooing.  At move in, I specifically asked if there would be a fee for carpet cleaning and was told by your staff that no, there would not be a fee.  Because we wanted the unit immediately, the carpet was not cleaned prior to us moving into the unit.  In any case, shoes never touched the carpet, for we always removed them before entering.  Please refund $60.
4)    Countertop stains removal.  Your decision to refinish bathroom countertops is not due to any wear and tear by us.  You have provided no pictures or proof of any need, because there was no need. Cordero is a painting company, not a countertop refinishing company.  This charge is unsubstantiated. Please refund $75.
 
We continue to ask you to address each of these items and return our deposit as an honest business would.  Thank you.

I would like to clarify that [redacted] was not on the lease agreement. If she was living in the unit with [redacted] during the lease term from 03/01/2016 - 5/31/2016, she was an unauthorized person who lived in...

We received a letter from [redacted] and [redacted] about 5 weeks ago requesting copies of third party invoices related to the charges on their account. Our office had sent [redacted] a copy of all invoices from the third party and a copy of the lease agreement that explained what charges may apply to her after she moved out. All charges are reasonable and legitimate.We always practice our business with honesty and dignity.  We will never charge any of our residents unreasonably. If you need me to provide any details of the charges, please let me know. Bags of trash in apartment and garage.   The 2 bedroom apartment and garage was left extremely dirty.  The 2 bed apartment and the garage required a full paint.  [redacted] was behind on his Water bill and $113.77 was taken out of his deposit to cover the water bill, cleaning of the carpet was $90.00, cleaning of baseboards before full paint of unit  was $275.00, cleaning of oven $40.00, Replacing 4 drip pans on range top was $25.00, cleaning refrigerator $25.00, vent hood and microwave$20,00, Ceiling fans $30.00, Trash removal of trash from unit And garage $25.00 .  Sweep, mopping  and waxing of bathrooms, kitchen, dining room, entrance to front door, cleaning bathroom sinks and tubs, kitchen sinks, washing down and oiling all cabinets, Cleaning inside of cabinets, cleaning all windows (8)  and mini blinds  and Patio $90.00 The cleaning and water bill total charge was $773.77   Less Security Deposit of $550.00 left Mr. [redacted] owing Stone Creek Apts. $223.77.  The apt was left very dirty and Mr. [redacted] left property without doing a walk thru or paying his final water bill.
